  • I want to give veterans some things to think about when choosing a representative to help with their disability claim.

    My experience with 2 VSOs was that you get what you pay for. Zippo. I will gladly pay an accredited representative such as your self 20-30% if I get to put 70-80% of VA back pay in my savings account.. No Brainer in my opinion. Because I know if I tried to file my appeal claims by myself, the VBA would kick my butt around the block forever.

    I have tried to fight the VA on my own and was denied every time. I was at 50 % disability when I decided to hire a veteran lawyer to represent me in my fight against the VA. It was the best thing I’ve done even though I had to pay them 20 % of back pay one time. I didn’t care about because I was going to get that pay every month once they collected their fee. And beside they deserve to be compensated for the hard work they do. The only thing I had to do was sign the paperwork they sent me when they was filling a claim. I honestly think since I hired them I received more than $100,000 in back pay from the VA and just a few weeks ago I received back pay for $70,000 from a claim filed in 2015. I am at 100 % p&t with 3 more claims that are pending and going to produce back pay.😉

    Appreciate your insight and honest take on challenges vets experience navigating the claims process. I sense you do want to advocate for vets, not only as an attorney, but as a companionate service oriented person.

    My VSOs in my area are useless. Here in NC we have a State legislated VSO systems, County, State and then all the private VSOs. The level of incompetence is staggering. I even live close to a Regional Office. I thought that alone would lend itself to VSOs being more informed. Nope. Thanks for all the info. I saved your info for later if can't get things done.

    It's a breath of fresh air to hear someone especially an attorney speak the truth to facts. It's absolutely pathetic what we veteran's have to go through with an "administrative agency" concerning our already proven military service. There simply needs to be another agency specifically controlled by higher law i.e. Supreme Court article III jurisdiction. It's already well known as have been in the news countless times how corrupt and extremely dysfunctional the VA beauracry is. Why should we be sacrificed to that conundrum?

    If I’m working with a lawyer to work some appeals but also have prior initial claims open and those get approved after I signed the POA is the lawyer entitled to his percentage of back pay associated with the initial claims?

      If it was an initial claim, then no one is ever entitled to a fee, but even assuming they were supplemental claims, in my mind the answer is still no. If a decision comes back from the VA, on something you filed before you hired them, then I don't believe the lawyer is legally or ethically entitled to any fee related to that decision.

    How do you find out what your VA doctor has diagnosed you with..looking at your VA medical records? Is it everything in the "Problem List section" ? Thanks

    If I don't need to pay for anyone well why do lawyers try to charge veterans for just to get a low ball rating

    Best Advice! Get an accredited VA lawyer, Veteran! VBA has a legal obligation to review Veterans Disability Claim file especially if you hire an Accredited VA lawyer in your appeal process: HLR, Supplemental, CUE appeal. Otherwise, expect disappointing rulings! Currently fighting a CUE for an undeniable shoulder replacement CFR 4.71a 5051! Surgery took place Dec. 04, 2013. I was awarded 100% the first month and than 20% for 1yr. VBA and BVA both failed to apply the law to my claim, which I believe is criminal. This is a 38 USC 1151 claim.
    I had VSO's intentionally sabotage my claim in Seattle. Claims i never put in were placed in my file. I had a VSO 'copy and paste' my signature fraudulently without my consent or knowledge! If you're not tech savvy beware! I only discovered this after waiting 2 years for my C-file out of St. Louis. And yes, I was homeless at the time! I still want to file a Perjury claim against Nathaniel Sutton, VSO at VHA American Lake, WA. Close to 10yrs! Its impossible to make up a Complex Surgery Shoulder Replacement performed at VHA Seattle. Unless the Contracted Dr. was not Qualified/Credentialed or Privileged to teach Shoulder Replacements outside of his specialty--Orthopedic Knee and Hip surgeon. I was a female veteran human Guinea Pig for his unethical practices hiding in the VA health system.
