To be a bricklayer, you should at least know what a brick is. To be a plumber, one should know what water is. To be a cop, you only have to know what a lobotomy is.
Police are meant to enforce thousands of laws. What is funny is that citizens are meant to follow hundreds of thousands of laws which we are not taught during our 12+ years. Now people are complaining about police enforcing some laws instead of complaining about the amount of laws and selective enforcement. If we could get police to enforce every law on the books, the peasants would learn fast that they know nothing about the law and want to reduce the amount of laws.

They should be locked on for the entire shift and no mute button. Maybe a pause button for restroom use, but the cop should state....going on pause for restroom and the bathroom and camera should have a sensor to show entrance and exit with time stamp.

There is absolutely no way that notebook would fly in court. The pages must be numbered and removing a page is difficult. I did basic security guarding and we were required to have a proper police-grade notepad. I would have been written up for what that cop is using.

The only time cops have to stop asking questions is after they utter the words you are under arrest. Even after they say you are under arrest they can still ask you questions they just cannot use what they learn against you in court.
unfortunately courts have decided that saying "I need a lawyer" is not a request for a lawyer. @matissozols8498 The problem is not everyone finds the same things offensive. What if you're joking around with some friends, but someone on the street near you hears it, and gets offended? Should you then be arrested? Even in the best case scenario where "everyone" decides "this is what we find offensive", that just means that you've now decided that anyone who doesn't fit in the "normal" mold, is now committing crimes simply for being different. It doesn't have to always be that way, but when you make laws about what people can/can't say, you always have to take take the worst case and keep it in mind. What if you make a law, and 10, 20, 30 years down the road it's been slowly modified, just a little at a time, until the people that made the law don't even recognize it anymore?

All the cops had to do was speak to the dormitory admins for them to search the room and Joel is screwed. Dorms are only half sheltered from the 4th amendment, especially if you sign your rights away to live in the dorms. Also hearsay is usually enough to establish probable cause, so the request for identification wasn’t unreasonable, he’s lucky he didn’t get arrested.

If you’re talking about the second kid, in some states the middle finger is seen as an aggressive gesture/act of aggression. Personally I don’t like that because it gives grounds to law enforcement to do whatever they want in cases like that. Reality is though, if you don’t give people the finger, you’re already ahead, especially when it comes to law enforcement.

Depends on the evidence. There is an insanely high burden of proof, guilty beyond a reasonable doubt. Their evidence has to be enough to leave zero reasonable doubts about who committed the crime. This is why most convictions of robberies and violent crimes are either confessions or they were caught in the act.

Most people are convicted on their own admissions, talking to police thinking it will help them (regardless of guilt/innocence). By far the majority of people questioned by police and ultimately prosecuted/convicted began by making admissions in some form or another. Most will attempt to validate/justify their actions, thinking if they can make it sound "reasonable" they might be let go. They usually do this by giving a narrative that closely resembles the truth of what occurred, but changing the part that makes them criminally responsible. Talking to the police, innocent or guilty, limits your ability to later change your defense. This just gives police the ability to pick apart any plausible defense, element by element, and negate a persons defense in order to achieve a conviction.

Miranda doesn't guarantee or compel the cops will give you one. The court actually has to order one to take your case. They can still ask questions. Not good for their case but, they can. There will be no penalty for refusing to answer them. If you choose to, that's on you.
They kept bringing him back to his cell and would let him withdraw. He came back one time because it sounds like they promised him methadone, and the second time because they offered him a coke. Thats why the detective kept marandizing him, he was treating it like a "new" interaction, instead of what it really was. A junkie going through withdrawal and he was trying to take advantage of him feeling weaker, except Jeff didn't break. It's really slimy when you think about how this is probably a common practice
They have all kinds of tactics to get around even that. Example: you say "I want a lawyer before I answer any more questions." They say, "that just means you said you would have liked to have one, not that you're requesting one. I can say I want to be a billionaire, I'm obviously not requesting a billion dollars." There are many examples of them playing these kinds of semantics. Sometimes it even actually holds up in court, sometimes it doesn't. But even if it doesn't, you've still been jammed up for however long they want to fuck with you, and they face no repercussions. It's all a game and the game is rigged.

@jerry2357 Australia beat you to that. Police officers in most states do not need a warrant to enter your home, just reasonable suspicion that their presence might be needed on the property. Experienced this first hand when I had three plain clothed detectives jump the construction fence on my father's property, circle around the house like common criminals peeking into our windows through the curtain gaps and eventually breaking in through the french doors and destroying them before announcing that they were searching for my brother, still not identifying that they were officers, I simply shouted at them to get off my property and barricaded myself into my room. All three of them then proceeded to force entry into my room and pinned me down, reading me my rights until one of them said "He doesn't look like the kid." Mind you I'm the eldest brother of three and the one they were after is my junior by a whole decade, has a completely different hair style, different hair colour, different eye colour, he's shorter than me and has a smaller frame/build than me. Didn't stop these 'heroes' from scaring the shit out of me and making me think my dad had borrowed money from thugs who were there to collect on payments until at long last one shouted in my ear "We are police, who are you? Identify yourself!" All I remember at that point through the fear and tears in my eyes was shouting "My wallet is in my bedside table," Didn't get an apology the station didn't pay for the $3000 in damages, or even mention the fact they traumatised a 25 year old who had prior to the incident been recovering from a sickness. It was that incident alone that taught me never to trust the police, never give them anything they don't have the right to and n ever believe anything that comes out of their mouthes, they are no different to the criminals you dodge in city alleys, just dressed nicely and put through government training to become thugs.

There seriously needs to be a law making it illegal for cops to blatantly lie during an interrogation to coerce a suspect into admitting to something. Way too many innocent citizens have been intimidated and coerced into admitting to something they didn’t do because the cops lied about something else.

What it does mean is that you should remember to say nothing until you are charged and they are forced to publish any evidence they do or do not have. That is true even in countries with fewer protections than the US. It's their job to gather evidence and not yours to supply it if accused. Let them make arses of themselves and cost the taxpayer a fortune then if not charged litigate for wrongful arrest or if charged dump your alibi/counter evidence down their throats. Costing them money is the first port of call when they misbehave, often it's the only satisfaction you'll ever get. BTW, why are most US cops obese?

And the fact that the police don't have the same rights as in totalitarian countries and most post-communist countries is good in my opinion. In Poland, the police in a small town can come in and search non-stop because someone claims that someone has kidnapped their cat and is keeping it in their apartment... The only thing I don't like is the fact that in the US you can use vulgar words towards a police officer... that is not optimal in my opinion.

Perhaps because several are quite notable. But, lots and lots of students in a more rural area so...students & farmers, odd combo? We understand that drinking beer in your college years is the right time to do it? It's when you're drinking like a 20 year old and you're in your 30's or older it becomes a problem. Freshers week can get a little messy, but mostly they quickly realise they have to ration the student loan. Wednesdays, after the BUCS sporting events, can be a little noisy, particularly the rugby teams, but mostly they are as good as gold and the cops leave them well alone, they have real criminals to chase.
Imagine: they know your name is Joel, and you live in residence.. and they have your room number, but somehow they need your ID to figure out who you are.

I have a kid with mild autism and have instructed him to politely decline to answer any questions from a law enforcement officer and to demand we be present if they continue to ask questions. We know how corrupt cops try to manipulate suggestible individuals into confessing things they have not done.

As a person with autism, who has been through the process of being arrested over a misunderstanding - what you're teaching is incredibly stupid. "Mommy and Daddy" aren't gonna be a factor in a cell. Between arrest and court, you won't even see him. Prepare the guy for how to handle police interaction, don't just.. "demand you be present" because that's not a legal requirement even in places with very progressive mental health policy. If you're under arrest, you don't have the right to demand anything except a lawyer. Teach him to do that. Also, the blanket "answer no questions" is kinda stupid, too. Say, for example, cops are searching your residential area at night for an active at-large criminal, and you're outside smoking or something, one of them shines a light in your face and asks who you are and why you're there, you're going to make your situation really bad for yourself by not just dropping your name and stating your business. "Don't answer questions" kinda depends on the circumstances. Suspicion of guilt? Silence. Confirming you're not who they're looking for? Answer away
Asking for a lawyer is not enough. You have to keep silent after that, or repeat that you want a lawyer. That's the only thing left you shoud say untill you actually get a lawyer.

The only time cops have to stop asking questions is after they utter the words you are under arrest. Even after they say you are under arrest they can still ask you questions they just cannot use what they learn against you in court.
unfortunately courts have decided that saying "I need a lawyer" is not a request for a lawyer. You have to be explicitly clear that you want to speak to a lawyer immediately and that you will not speak to them further without a lawyer present. It's bullshit that a non-legal expert has to be so legally specific with their wording but that's the state of US justice right now.

Should you then be arrested? Even in the best case scenario where "everyone" decides "this is what we find offensive", that just means that you've now decided that anyone who doesn't fit in the "normal" mold, is now committing crimes simply for being different.
It doesn't have to always be that way, but when you make laws about what people can/can't say, you always have to take take the worst case and keep it in mind. What if you make a law, and 10, 20, 30 years down the road it's been slowly modified, just a little at a time, until the people that made the law don't even recognize it anymore?

All the cops had to do was speak to the dormitory admins for them to search the room and Joel is screwed. Dorms are only half sheltered from the 4th amendment, especially if you sign your rights away to live in the dorms. Also hearsay is usually enough to establish probable cause, so the request for identification wasn’t unreasonable, he’s lucky he didn’t get arrested.

If you’re talking about the second kid, in some states the middle finger is seen as an aggressive gesture/act of aggression. Personally I don’t like that because it gives grounds to law enforcement to do whatever they want in cases like that. There is an insanely high burden of proof, guilty beyond a reasonable doubt. Their evidence has to be enough to leave zero reasonable doubts about who committed the crime.
This is why most convictions of robberies and violent crimes are either confessions or they were caught in the act.

Actually, that's not the case. Most people are convicted on their own admissions, talking to police thinking it will help them (regardless of guilt/innocence).
By far the majority of people questioned by police and ultimately prosecuted/convicted began by making admissions in some form or another.

Most will attempt to validate/justify their actions, thinking if they can make it sound "reasonable" they might be let go.
They usually do this by giving a narrative that closely resembles the truth of what occurred, but changing the part that makes them criminally responsible.
Talking to the police, innocent or guilty, limits your ability to later change your defense.
This just gives police the ability to pick apart any plausible defense, element by element, and negate a persons defense in order to achieve a conviction.

Miranda doesn't guarantee or compel the cops will give you one. The court actually has to order one to take your case. They can still ask questions. Not good for their case but, they can. There will be no penalty for refusing to answer them. If you choose to, that's on you.
Once you ask for a lawyer after you've been mirandaized and arrested, they cannot ask you any more questions at all.
They kept bringing him back to his cell and would let him withdraw. He came back one time because it sounds like they promised him methadone, and the second time because they offered him a coke. Thats why the detective kept marandizing him, he was treating it like a "new" interaction, instead of what it really was. A junkie going through withdrawal and he was trying to take advantage of him feeling weaker, except Jeff didn't break. It's really slimy when you think about how this is probably a common practice

Example: you say "I want a lawyer before I answer any more questions." They say, "that just means you said you would have liked to have one, not that you're requesting one. I can say I want to be a billionaire, I'm obviously not requesting a billion dollars."
There are many examples of them playing these kinds of semantics. Sometimes it even actually holds up in court, sometimes it doesn't. But even if it doesn't, you've still been jammed up for however long they want to fuck with you, and they face no repercussions.

Experienced this first hand when I had three plain clothed detectives jump the construction fence on my father's property, circle around the house like common criminals peeking into our windows through the curtain gaps and eventually breaking in through the french doors and destroying them before announcing that they were searching for my brother, still not identifying that they were officers, I simply shouted at them to get off my property and barricaded myself into my room. All three of them then proceeded to force entry into my room and pinned me down, reading me my rights until one of them said "He doesn't look like the kid."
Mind you I'm the eldest brother of three and the one they were after is my junior by a whole decade, has a completely different hair style, different hair colour, different eye colour, he's shorter than me and has a smaller frame/build than me. Didn't stop these 'heroes' from scaring the shit out of me and making me think my dad had borrowed money from thugs who were there to collect on payments until at long last one shouted in my ear "We are police, who are you? Identify yourself!" All I remember at that point through the fear and tears in my eyes was shouting "My wallet is in my bedside table,"
Didn't get an apology the station didn't pay for the $3000 in damages, or even mention the fact they traumatised a 25 year old who had prior to the incident been recovering from a sickness.
It was that incident alone that taught me never to trust the police, never give them anything they don't have the right to and n ever believe anything that comes out of their mouthes, they are no different to the criminals you dodge in city alleys, just dressed nicely and put through government training to become thugs.

Not really, it's no different than other tactics such as undercover work. What it does mean is that you should remember to say nothing until you are charged and they are forced to publish any evidence they do or do not have. That is true even in countries with fewer protections than the US. It's their job to gather evidence and not yours to supply it if accused. Let them make arses of themselves and cost the taxpayer a fortune then if not charged litigate for wrongful arrest or if charged dump your alibi/counter evidence down their throats. Costing them money is the first port of call when they misbehave, often it's the only satisfaction you'll ever get. BTW, why are most US cops obese?

Contrary to what Law and Order tells you, when you’re a cop and a suspect asks for a lawyer, you shut up, you end the interview, and you see to it that they get a lawyer. Keeping the conversation going is a great way to lose your job and your pension.

I have a kid with mild autism and have instructed him to politely decline to answer any questions from a law enforcement officer and to demand we be present if they continue to ask questions. We know how corrupt cops try to manipulate suggestible individuals into confessing things they have not done.
This reminded me of the story of a undercover cop who manipulated a mentally challenged student into helping a friend find weed and then charged the poor kid :(

Rather than tell him to demand you be present you need to tell him to demand a lawyer - “I will not answer any questions or make any statements I request my attorney” - demanding parents be present is not enshrined in the constitution. But having an attorney is….
As a person with autism, who has been through the process of being arrested over a misunderstanding - what you're teaching is incredibly stupid. "Mommy and Daddy" aren't gonna be a factor in a cell. Between arrest and court, you won't even see him.
Prepare the guy for how to handle police interaction, don't just.. "demand you be present" because that's not a legal requirement even in places with very progressive mental health policy. If you're under arrest, you don't have the right to demand anything except a lawyer. Teach him to do that.
Also, the blanket "answer no questions" is kinda stupid, too. Say, for example, cops are searching your residential area at night for an active at-large criminal, and you're outside smoking or something, one of them shines a light in your face and asks who you are and why you're there, you're going to make your situation really bad for yourself by not just dropping your name and stating your business. "Don't answer questions" kinda depends on the circumstances. Suspicion of guilt? Silence. Confirming you're not who they're looking for? Answer away
