      Different states have different laws. You need to contact your representatives and suggest changes. This isn't just a blanket "cops can just take your stuff" situation. It's more along the lines of cops can seize your vehicle if you're using it to transport kilos of coke. Yes, there are always one or two "shocking" hardship stories. But these laws were put into place to discourage people from breaking the law.

Police and special drug task forces have stolen billions in cash and property this way. They often don't even charge people with crimes. If their state tries to outlaw the practice, or a judge orders them to return the property they hand it off to a federal program called "equitable sharing" then claim they can't give it back. The feds then give money back to the local cops as a kickback. When they don't even charge anyone with a crime, it has nothing to do with stopping drug dealers. It's all about stealing.

      @@naijaplayer They only released it once IJ got involved, they were afraid of the precedent this case will set if it gets ruled on. I think IJ is still pursuing this case and it will hopefully be the one that the SCOTUS uses to strike down Civil Asset Forfeiture

      This was a bad case to do it on, but they did signal that if they get a good case they probably will. Institute for Justice is working on this & will get a good case to them in the next couple years I would bet.

    I read the Opinion. It does NOT say that the police can keep your stuff for months or years. It only says that a preliminary hearing is not required to test the legal sufficiency of the forfeiture., that the test is applied at the forfeiture hearing. The speed at which a forfeiture hearing is docketed depends on how quickly the owner files a challenge and raises defenses, whereas a preliminary hearing takes place within days. By the way, in the recent opinion, the cars taken were later returned. The long delay in returning the cars was due to the owners taking months to file an objection and demand the return of the cars.

      @@N0b0d17 A challenge to the forfeiture is an easy enough task. The State files a seizure notice and the answer is simple enough. Any innocent owner will get the property back, as the complainants did in the cases SCOTUS was reviewing.

    This subject can't be covered in a simple comment. Our laws concerning civil asset forfeiture is so sick, it is pure organized legal confiscation that in oppressive dictatorship countries would be considered too intrusive.
    Violent crime is NOT down, merely convictions and the reporting is.
    People are agents of their own lives, they get together and make children in free will. I really like the idea of children enjoying music after school in music classes but I am at a complete loss in understanding how the cost of such leisure time spending could ever be a freaking government function.

    Crime is not dropping - the stats are incorrect. The DOJ changed the reporting system around 2021. It is more difficult for LE agencies to use, which has lead to decreased reporting. The system now also allows agencies to estimate the numbers of crimes. Yes, estimate. Also, with the defending of LE agencies, fewer crimes are being reported due to unavailable officers, hours-long response wait times, and requiring people to go to the police station to report non-life threatening crimes.

    3:25 Please correct your info; crime is NOT coming down. It has been on a sharp rise.
    The methods of reporting crime have obfuscated things, but if you research correctly you will see that crime is at an all-time high.

      Legality without a well developed framework of ethics behind it is not a beneficial social tool. Don't start by asking if it's legal, but if it is ethical unless you want atrocities to develop.
