Levine doesn't own the IP, he and some other employees split off a long time ago. 2K (Cloud Chamber) is supposedly working on their own Bioshock. Frankly I think this is a good thing, Levine is great at creating new experiences, and less good at continuing them (i.e. Burial at Sea)
