The 170k Bitcoin was not really Ross' property. Silk Road had custody of that Bitcoin on behalf of all the customers (buyers and sellers). I am sure some of the Bitcoin was his, but not 170k BTC. Probably 5% would have belonged to Ross. And that would have been earned illegally, so I doubt he will waste his time trying to get it back. If he was smart, he put some Bitcoin aside before SHTF.
