The Tender Process

Check if you are familiar with the tender contract process, especially in terms of what the contract opportunity is all about.
It might help you to keep in mind what the Court said in the Hughes Aircraft case (see: Hughes Aircraft Systems International v Airservices Australia [1997] FCA 558)
In this case, it was said that the tender itself could be a contract.
A key takeaway is your tender documents submitted can become a counter offer rather than accepting the offer itself, so keep in mind whether you want to accept what has been put forward to you in that tender opportunity OR not.
