Jurisprudence: Legal Positivism [1]

In this course, we consider the theory of legal positivism school of law in jurisprudence, which is founded on lex lata.
This theory is a stiff opposition to the natural law school of though in jurisprudence and it focuses on law as “it is”, and not law as “it should be”.
Covered in this particular session of the course are: definition of positivism, philosophy of positivism, impact of positivism on natural law, convergence of positivism and natural law, separation of positivism and natural law.
Essentially, the course teaches us that lex lata is the principle of positivist school of thought while delege feranda is the main principle in natural law school of thought.
