For most middle and high schools, anyone failing two or more subjects aren’t allowed to attend prom unless the student brings their grade(s) up in time. This isn’t brought up last minute, it’s told to the student a series of times before the prom; why his mother didn’t know about his grades is unknown. However, it is not the defendant’s fault, this is a frivolous lawsuit.

Some judges don't like to be called sir or ma'am, to them it's a sign of disrespect. Even more so in the cases of miss and mister -- many if not most or even all judges despise litigants addressing judges by those titles.
I was thinking the same thing. I can understand a simple correct, but she was very rude when addressing her. Ma'am is normally a sign of respect and highly regarded. I'm sure she didn't know.

It depends on where his grades were at and how many points the test was. I had more than a few tests in high school where, if you failed that single one, it would be devastating for your grade.
Nope as a former teacher it depends on how the test is weighted. For instance homework could be 25%, in-class participation is 25%, and the test could be 50%, so if you fail or get a low grade on the test then you can fail the class or be in danger of failing the class. So yeah if a kid is in class and does the homework but the test isn't until a week before prom and the kid bombs on the test then guess when the Mother finds out, right before the prom. It sucks because it is so late in the semester. This happens but most teachers (from what I remember) try to avoid this very scenario because of situations like this one.
One test most certainly can drop your grade waaaay down. In one of my high school classes, our last test of each quarter was worth 70% of our overall grade….(we did not have homework in that class, so we didn’t get homework grades)! The test took 2 days to complete, it was a 50 page packet. My in class work, I got straight As, the first test of the year, dropped my grade down to a D+…needless to say, I worked my ass off the rest of the year to get my grade back up to a A+!
ALLLLLLLLL schools regardless of grade level give progress reports and/or communication via email or phone. Teachers will definitely have a paper trail.💁♀️💁🏾♀️🤫
My thoughts exactly. Additionally, with school protocol, MOST schools alert the students whether they are eligible to attend prom or not; anybody failing two or more grades is NOT eligible, the school doesn’t wait until last minute.

My child’s teachers NEVER contact me about her grades. I’m usually staying on top and contacting them! And they usually take their slow time entering grades. Most are never on time and I have to keep calling about 0’s listed for work done. It’s ridiculous. But there are websites and apps that allow parents to keep up. This parent should’ve known.

Parent teacher conferences are even a thing of the past. They still have them, but the schools and teachers have so many websites and apps now there is absolutely no reason not to know how your kids is doing in school. My wife and I both get messages nearly everyday from the kids schools and teachers!

Prom in middle school? That's part of the problem. I'm in education at the high school level and there are ALOT of parents who put more energy into prom than graduation. It's amazing how many of the kids at prom aren't on track for graduation.

I don't understand how people seem to think they should punish a child who is not doing well in school. Fair enough if the child isn't putting the work in, but some children are not good at academics. We are all different. I have post graduate university qualifications and yet I got good marks at school but could have got so much more but wasn't really mature enough until older, my brother has a mild intellectual disability and struggled at school. Both my kids had the ability to do well at school, but my youngest really needed more individual attention to achieve, the older one did better but could have put more work in and done better but she really struggled in some areas. Its not a blanket thing that it is the child's fault.

Mom, ever heard of Progress Reports? It’s a mid-check in before actual six weeks report cards. We’re in a pandemic, all grades are online now. You can log in and check EVERY DAY. This is a classic case. That was a courtesy that the school called her because they could’ve let him get turned away at the door that night. The teachers probably got word about his *limo* plans. His mind was proactive about getting a date for prom, but not about running those numbers to see what score he needed to obtain on that test in order to remain eligible to attend. Math is important sir! That’s what kept you out of the prom. Boy bye👋🏾

The school would not just spring that up the day of prom. Either the mother knew or the son never told the mother he’s failing and has been warned in the past to get his grades up. If I was his mother, he would’ve worked off that $200 during the summer while attending summer school.
My daughter had done well in school until her last semester. She started partying behind my back, sneaking out, jigging school, and I was notified every step of the way! We had some battles getting her head on straight and get her graduated. But the school was in constant contact with me and I with them. Unfortunately for her, going from an A student to just a passing C in last semester cost her the college of her choice. Oh well. Every action has an equal and opposite reaction. They're called consequences.

As a public school teacher, I can reply that the mother angry with her son not attending a PROM at MIDDLE SCHOOL is the problem with this country! Schools will cya with every attempt to contact parents IN WRITING and EMAILS to inform the parents when their child is close to failing or failing. Numerous attempts are made to contact parents. It seems that MANY parents are more concerned about social skills with their peers rather than getting an education nowadays. This is one of the reasons why so many schools have students with severe behavior problems and coping skills. The schools also need to train students vocational skills for students who are not college bound to find a trade that they can excel in.

It depends on the judge and depends on that judge THAT day. “Your Honor” is more traditional for court. “Ma’am” or “Sir” is more casual in court. I guess the context is that, in court, the judge represents the court which lifts them above the normal casual way of addressing people. But like others have said, that should mean that Judge Milian can’t call litigants “sweetie” or “honey” either.
The defendant was gracious in that she could have shown where the school had provided HER with progress reports for her own kids that may have made the plaintiff look less credible.

Because everyone is ma'am and everyone didn't go to school for over 10 years to become a Judge. It's a sign of respect for the profession, not just a person. Your mechanic is sir or ma'am. Your friend's parents are sir or ma'am. Judges are "Judge" or "Your Honor". You wouldn't call Joe Biden sir, you'd call him Mr. President.
The public school system is horrible, but they aren’t the kind of bad to call you the day of Prom to tell you your child can’t go. That was definitely discussed ahead of time. She was just going to try to force him to go, and the call the day of from the school was to double down that her son couldn’t go. I’ve seen this happen before.

Trust me it doesn’t come as a shock when a school denies a kid prom due to failing grades. The kids is warned a few times leading up to it. Mama was just lackadaisical as it pertains to her sons schooling and her son wasn’t being honest about his progress in school.
This made me love this judge when she said, I have the same problem with the way my kids are spaced out. Then she said let me change that: it's not a problem it's a blessing. _Love it!_
I think that's the REAL truth. Her son was flunking his classes and the school deemed that because he was failing, he would NOT be allowed to go to Prom. His Mom, rather than RESPECTING this, chose, instead, to try to overturn it and that still failed. Its not the defendant's fault that her son couldn't attend the prom. SHE didn't stop him going to prom....the school did that to punish him for failing the classes. I understand he's disappointed, and it cost his Mom all that money for the tux and the corsage and the limo....but she should have been keeping a closer eye on her son's grades. And it even SOUNDED like the defendant was sympathetic to the Mom's problem and she was considering reimbursing her at least SOME of the money, but rather than being PATIENT....the Mom then THREATENS the defendant with a lawsuit....which is ridiculous, because NONE OF THIS is the defendant's fault, so why should SHE be out the money AND the limo for her daughter?

I think it was more of a moral thing for the plaintiff to think that she was going to get her 200 dollars back bc her son is not going anymore. In that case, the defendant didn’t have to refund or reimburse her, but morally she was going to give the plaintiff something back ( 100 dollars) when She could. The plaintiff messed it up for herself when she mentioned small claims court. But morally, that’s what the plaintiff was thinking. And correct I think I would’ve also had my son pick up some gigs in the neighborhood (dog walking/watching, pool cleaning, grass cutting) all summer to pay the 200 back.. so in that case he paid for his share on the limo that he didn’t get to ride in. & get them grades up boy!
Judge Millian, wake up. It's not like the kid didn't know the consequences of his failure ahead of time. Expectations were there and I am sure the teachers made that clear. Now it's irrelevant whether he got consequences on day of prom or before. He needs consequences. Bottom line.
How tf do parents not keep an eye on their child's academics- and especially in the 21st century when schools provide portals to online records for attendance, grades and other important services. It's preposterous. I ain't saying that dances aren't important, but the prom will be a distant memory once he graduates from college and moves on to make a life of his own. But try getting into college with less than stellar grades. It's highly competitive out there. In the end, grades are more important than attending a prom. Parents need to put into perspective the importance of attending classes and on their kids doing their best rather than snapping pics in front of a limo headed for a junior high or senior prom. It's that simple. Don't wait to check on grades until the last minute. Check weekly through the schools' online portal.
Most schools would not make one test affect a grade so drastically, unless he had a D and test brought grade to F, so we gotta let kid know your not going if you have either grade, again most schools do online grades, mid term grades calls home with D, F grades....at least I always let parents know and allowed enough time to make up missing work, improvement, also our school didn't tie events to grades, but if my kid had D, F they would not be going
From the perspective of someone who just got out of High School I actual do believe that the mother wasn't aware of her sons grades. During teacher and student conferences there were barely any parents through out my entire middle and high school years. After elementary school my mother didn't know about my grades or teacher conferences unless I would tell her about them so I do believe her on that part. Although, unless the defendant and the plaintiff had an agreement that the money was for BOTH children, I don't see why the defendant should pay the $200 back. I personally would have but it shouldn't be an obligation that she pays her back the money because her child wasn't able to attend the prom, it's the son's fault. And if the plaintiff was this invested in her child's education as much as his prom than maybe he would've been able to attend.

My Mother was told the day of graduation thatshe wouldn't be able to graduate. This was in Finland where every child in the country graduating from highschool graduates, and the whole country stops and celebrates. My mother went to a Swedish school, and had a German background, but of course had to take Finnish to graduate. Her teacher loathed her, and marked her exam extremely harshly, and she failed. She was devastated. The school board and ministry of education got involved. That morning a re-analysis of her exam said she had not only passed, but with high honours (an A+). She was allowed to graduate, and the story hit the front page news. This was in the 50's, and apparently he couldn't get past her German last name. He was quoted as saying some VERY prejudiced views about Germans (recalling that the Finns were allied with the Germans in WWII, because they were both fighting Russia. The Finns hated that they had made a deal with the devil so as to not be annexed by Russia, and after the war the people tried to dissociate themselves from the Germans.).
There was no clause in the agreement that said if one party can not attend then they get a refund. No mama! Not to mention the embarrassment that the young lady no longer had a date, smh

Tha plaintiff obviously wasn't attending the parent teacher conferences or checking her son's grades to know he was failing. I also don't believe they informed her the day of the prom that her son was failing and unable to attend prom. She ignored the schools warning just like she ignored her sons failing grades and the defendants attempt to negotiate the agreement and give her $100. She comes across as wanting things her way or it's no way. I know she going to be a piece of work by that short, inappropriate dress she wore to court. I'm happy for the defendant and hope the plaintiff gets her priorities in order.

It depends on where his grades were at and how many points the test was. I had more than a few tests in high school where, if you failed that single one, it would be devastating for your grade.
Nope as a former teacher it depends on how the test is weighted. For instance homework could be 25%, in-class participation is 25%, and the test could be 50%, so if you fail or get a low grade on the test then you can fail the class or be in danger of failing the class. So yeah if a kid is in class and does the homework but the test isn't until a week before prom and the kid bombs on the test then guess when the Mother finds out, right before the prom. It sucks because it is so late in the semester. This happens but most teachers (from what I remember) try to avoid this very scenario because of situations like this one.

One test most certainly can drop your grade waaaay down. In one of my high school classes, our last test of each quarter was worth 70% of our overall grade….(we did not have homework in that class, so we didn’t get homework grades)! The test took 2 days to complete, it was a 50 page packet. My in class work, I got straight As, the first test of the year, dropped my grade down to a D+…needless to say, I worked my ass off the rest of the year to get my grade back up to a A+!
ALLLLLLLLL schools regardless of grade level give progress reports and/or communication via email or phone. Teachers will definitely have a paper trail.💁♀️💁🏾♀️🤫

My thoughts exactly. Additionally, with school protocol, MOST schools alert the students whether they are eligible to attend prom or not; anybody failing two or more grades is NOT eligible, the school doesn’t wait until last minute.

It’s not fair to say she ignored it. None of us knows what kind of repercussions were in place for her son due to his failing grades.

My child’s teachers NEVER contact me about her grades. I’m usually staying on top and contacting them! And they usually take their slow time entering grades. Most are never on time and I have to keep calling about 0’s listed for work done. It’s ridiculous. But there are websites and apps that allow parents to keep up. This parent should’ve known.

But my thing is if it’s a deposit so I do feel that she should give her something because her son couldn’t go but to think about it, If her son was only going then she would have still lost that deposit because he wasn’t going.

Parent teacher conferences are even a thing of the past. They still have them, but the schools and teachers have so many websites and apps now there is absolutely no reason not to know how your kids is doing in school. Prom in middle school? That's part of the problem. I'm in education at the high school level and there are ALOT of parents who put more energy into prom than graduation. It's amazing how many of the kids at prom aren't on track for graduation.

I don't understand how people seem to think they should punish a child who is not doing well in school. Fair enough if the child isn't putting the work in, but some children are not good at academics. We are all different. I have post graduate university qualifications and yet I got good marks at school but could have got so much more but wasn't really mature enough until older, my brother has a mild intellectual disability and struggled at school. Both my kids had the ability to do well at school, but my youngest really needed more individual attention to achieve, the older one did better but could have put more work in and done better but she really struggled in some areas. Its not a blanket thing that it is the child's fault.

Mom, ever heard of Progress Reports? It’s a mid-check in before actual six weeks report cards. We’re in a pandemic, all grades are online now. You can log in and check EVERY DAY. This is a classic case. That was a courtesy that the school called her because they could’ve let him get turned away at the door that night. The teachers probably got word about his *limo* plans. His mind was proactive about getting a date for prom, but not about running those numbers to see what score he needed to obtain on that test in order to remain eligible to attend. Math is important sir! That’s what kept you out of the prom. Boy bye👋🏾

My daughter had done well in school until her last semester. She started partying behind my back, sneaking out, jigging school, and I was notified every step of the way! We had some battles getting her head on straight and get her graduated. But the school was in constant contact with me and I with them.

As a public school teacher, I can reply that the mother angry with her son not attending a PROM at MIDDLE SCHOOL is the problem with this country! Schools will cya with every attempt to contact parents IN WRITING and EMAILS to inform the parents when their child is close to failing or failing. Numerous attempts are made to contact parents. It seems that MANY parents are more concerned about social skills with their peers rather than getting an education nowadays. This is one of the reasons why so many schools have students with severe behavior problems and coping skills. The schools also need to train students vocational skills for students who are not college bound to find a trade that they can excel in.

It depends on the judge and depends on that judge THAT day. “Your Honor” is more traditional for court. “Ma’am” or “Sir” is more casual in court. I guess the context is that, in court, the judge represents the court which lifts them above the normal casual way of addressing people. But like others have said, that should mean that Judge Milian can’t call litigants “sweetie” or “honey” either.

The public school system is horrible, but they aren’t the kind of bad to call you the day of Prom to tell you your child can’t go. That was definitely discussed ahead of time. She was just going to try to force him to go, and the call the day of from the school was to double down that her son couldn’t go. I’ve seen this happen before.

I think that's the REAL truth. Her son was flunking his classes and the school deemed that because he was failing, he would NOT be allowed to go to Prom. His Mom, rather than RESPECTING this, chose, instead, to try to overturn it and that still failed. Its not the defendant's fault that her son couldn't attend the prom. SHE didn't stop him going to prom....the school did that to punish him for failing the classes. I understand he's disappointed, and it cost his Mom all that money for the tux and the corsage and the limo....but she should have been keeping a closer eye on her son's grades. And it even SOUNDED like the defendant was sympathetic to the Mom's problem and she was considering reimbursing her at least SOME of the money, but rather than being PATIENT....the Mom then THREATENS the defendant with a lawsuit....which is ridiculous, because NONE OF THIS is the defendant's fault, so why should SHE be out the money AND the limo for her daughter?

I think it was more of a moral thing for the plaintiff to think that she was going to get her 200 dollars back bc her son is not going anymore. In that case, the defendant didn’t have to refund or reimburse her, but morally she was going to give the plaintiff something back ( 100 dollars) when She could. The plaintiff messed it up for herself when she mentioned small claims court. But morally, that’s what the plaintiff was thinking.
And correct I think I would’ve also had my son pick up some gigs in the neighborhood (dog walking/watching, pool cleaning, grass cutting) all summer to pay the 200 back.. so in that case he paid for his share on the limo that he didn’t get to ride in.

The real problem is that she didn’t know her son was failing MULTIPLE classes until 2 days before prom. That’s her fault.

How tf do parents not keep an eye on their child's academics- and especially in the 21st century when schools provide portals to online records for attendance, grades and other important services. It's preposterous. I ain't saying that dances aren't important, but the prom will be a distant memory once he graduates from college and moves on to make a life of his own. But try getting into college with less than stellar grades. It's highly competitive out there. In the end, grades are more important than attending a prom. Parents need to put into perspective the importance of attending classes and on their kids doing their best rather than snapping pics in front of a limo headed for a junior high or senior prom. It's that simple. Don't wait to check on grades until the last minute. Check weekly through the schools' online portal.
Most schools would not make one test affect a grade so drastically, unless he had a D and test brought grade to F, so we gotta let kid know your not going if you have either grade, again most schools do online grades, mid term grades calls home with D, F grades....at least I always let parents know and allowed enough time to make up missing work, improvement, also our school didn't tie events to grades, but if my kid had D, F they would not be going
From the perspective of someone who just got out of High School I actual do believe that the mother wasn't aware of her sons grades. During teacher and student conferences there were barely any parents through out my entire middle and high school years. After elementary school my mother didn't know about my grades or teacher conferences unless I would tell her about them so I do believe her on that part. Although, unless the defendant and the plaintiff had an agreement that the money was for BOTH children, I don't see why the defendant should pay the $200 back. I personally would have but it shouldn't be an obligation that she pays her back the money because her child wasn't able to attend the prom, it's the son's fault. And if the plaintiff was this invested in her child's education as much as his prom than maybe he would've been able to attend.

I had a Jr High Prom too back in 2008. I never had one in elementary in 2005 tho thank fuck
@Ms.C No, I'm just a rebel without a cause. A pet-peeve is people living life by looking over at what the next person is doing to feel "normal". Anything good that comes out of life is due to someone stepping out of the box and doing what they decide is right. If everyone did that this, the world would be a fascinating place rather than brain numbing routine that we all follow every day. There's an old saying: "when you follow the herd, you step in a lot of s***".
My Mother was told the day of graduation thatshe wouldn't be able to graduate. This was in Finland where every child in the country graduating from highschool graduates, and the whole country stops and celebrates. My mother went to a Swedish school, and had a German background, but of course had to take Finnish to graduate. Her teacher loathed her, and marked her exam extremely harshly, and she failed. She was devastated. The school board and ministry of education got involved. That morning a re-analysis of her exam said she had not only passed, but with high honours (an A+). She was allowed to graduate, and the story hit the front page news. This was in the 50's, and apparently he couldn't get past her German last name. He was quoted as saying some VERY prejudiced views about Germans (recalling that the Finns were allied with the Germans in WWII, because they were both fighting Russia. The Finns hated that they had made a deal with the devil so as to not be annexed by Russia, and after the war the people tried to dissociate themselves from the Germans.).
I check my child’s grades every other day! Or every week. That’s being on top of things with your child. It’s called being a parent.

There was no clause in the agreement that said if one party can not attend then they get a refund. No mama! Not to mention the embarrassment that the young lady no longer had a date, smh
She is one of those parents who only be at the school to complain about sh!t... nothing else... no Involvement at all apparently with her child and what he does in school and his teachers! Like what the heck! This pisses me off.

Tha plaintiff obviously wasn't attending the parent teacher conferences or checking her son's grades to know he was failing. I also don't believe they informed her the day of the prom that her son was failing and unable to attend prom. She ignored the schools warning just like she ignored her sons failing grades and the defendants attempt to negotiate the agreement and give her $100. She comes across as wanting things her way or it's no way. I know she going to be a piece of work by that short, inappropriate dress she wore to court. I'm happy for the defendant and hope the plaintiff gets her priorities in order.
