I was wrongfully terminated from a private college program and I have substantial evidence and filed a grievance about this same instructor who has been harassing and has been discriminating towards me and other students. When asked what I did it wasn’t clear or told to me exactly, they rather was fishing and giving me a variety of reasons which were untrue and they told me regardless I was terminated. What are my rights in a private college setting? I wasn’t given an investigation, nor did I have a meeting. My campus director is away at a conference and was told that I have to wait until he gets back.
I'm really sorry this has happened to you, Rina Jay. Your situation does not sound like the typical student conduct code violation scenario. However, there are usually procedures in place to address these types of issues. Since I'm not familiar with your school's processes, I'd recommend speaking with a local attorney who may know more about how you can address your termination. Hello, I have an upcoming meeting with a housing administrator over a late form which has resulted in a non-academic charge. This form is utterly superfluous in that it confirms I still occupy my residence under the original conditions of my lease, but apparently needs to be completed annually even though my situation has not changed. I have since submitted the form. They are charging me with failure to comply with any "reasonable" request from an administrator. The meeting is designed to present me with an unspecified "responsible option" to remediate the harm I've allegedly caused the university or the matter will be escalated to a hearing if I refuse the "responsible option." The administrator I will be meeting with to get "(my) side of the story" is also the one who filed the report against me. What should my strategy be heading into this meeting?

I’m currently in pharmacy school, and they have changed the curriculum from 80% passing test grade (one test per subject) with 2 opportunities and a third one called remediation (you can only have two per semester) To only 1 opportunity and immediately to remediation which is basically having a foot out the door, also they remove back tracking during the test. Considering I will be taking 16+ exam a during the fall semester what are the odds that I don’t mess up 2 or more and get kicked out ? It’s a three year program, I don’t know why are they implementing this changes on a current class instead of just the new one ? It’s there anything in my power to do ?

I have a conduct hearing for failing to submit my covid-19 tests for two weeks honestly my course load started to pick up a bit and time began to escape me. I am accused of plagiarism for a university essay. My hearing date is yet to confirmed, but I got a mail regarding this. The concept of this essay was developed by me and my friend in 2016, our bachelor days. We were actually trying to develop a paper on this. But due to some family issues, I backed out from that and the paper remained unpublished. After these years, as I had a draft with me, I decided to use the concept for my present essay. I checked the whole internet for the further the developments on the essay and couldn't find anything significant. I submitted the essay. But in the mail it says that my friend has already submitted the paper as his own ( which I don't blame him because we were at the initial stage). How can I overcome this issue and convince the board?

Hello sir, i was notified of a hearing of misconduct for plagiarism that is set for tomorrow morning. I did not plagiarize and the assignment they are saying i did it on was an open note final exam that was multiple choice, written, and true or false questions. I don’t know how to defend myself considering i have not a single idea what they would be trying to get me on. I feel completely blind going into this. Thank you for your question. Having a disciplinary history may affect acceptance, depending upon the nature of the history. Even so, I've had clients accepted into a new University despite their student disciplinary history. It may also depend upon the new University and their policy. I would not let a history deter you from applying. The worse thing they could do is tell you "no." Good luck!!
the University was lenient .i was charged with possession of crib notes during a test in 2017 i haven't been expelled. I am currently a postgraduate. the outcome of the hearing was that i should be expelled but then my expulsion was suspended on condition that i don't repeat the mistake. Its like a university probation
Upon making an application to the other University i came across the part where they asked me if i had any disciplinary disclosure. I still don't know if i should answer yes or no because my expulsion was lifted and i am still a registered graduate student. Will it still affect my acceptance if i answer yes?

i’m 2 months from completing a medic program. Last week, i was brought to a meeting accusing me of academic dishonesty. They pulled my “time stamps” for at home quizzes and found 5 (out of a total of 60+ quizzes) that have time stamps similar to another students. They say this is enough to claim I cheated. I had a valid explaination for the time stamps, we studied together and when we both felt prepared we would begin our quizzes but did not in any way discuss the questions or help each other. I’m appealing the accusations because i stand by my truth. Any advice or words of wisdom for my hearing? is this evidence ENOUGH to say we cheated or were dishonest?
Unfortunately, the burden of proof in these university hearings is very low. That means they can find you responsible based on very little evidence. Just do the very best you can in defending yourself. If you have the right to an advisor, I would recommend enlisting the help of one. Unfortunately, the vast majority of schools allow simple majority vote by the jury/student judge panel to convict. The burden of proof is also usually preponderance of evidence (unlike the beyond reasonable doubt used in criminal cases). Not to mention intense amounts of pressure on jurors/judges to convict and lack of "judicial" independence. Getting railroaded is quite common.

So I was caught smoking. I have a few problems. I have a hearing next Wednesday, and my only goal is to not get kicked from my dorm. I certainly understand your position. University discipline hearings are not like court since the school considers these proceedings as educational to the student. If you have the right to an advisor, look for a lawyer who has experience with these hearings. Also remember that things you say can be used against you in criminal courts.

hello, I am a first semester freshman with no prior offenses at a University in Tampa. I currently got into an issue and I will be having a hearing on Friday. I was in a fight on campus outside of dorm room with someone. This person was waving a glass bottle in a threatening motion before I struck him, took the bottle and threw it at him. Cops and Campus security got involved. this person also had threats on video that night saying that they were trying to kill someone and clearly stated that he wanted to fight me to my roommate before our argument in which he waved the bottle. What do you think will happen to me and is this terms for mitigation?
Unfortunately, I don't know what will happen. But you have two competing interests here. First is any potential criminal case that might be filed against you. Second is the University disciplinary process. These two interests are opposed to each other since everything you say in the University case can be used against you in criminal court. I'm sure you are entitled to an advisor in the University matter. I would hire a criminal defense attorney immediately to help you navigate these competing interests.

Hello. My professor is accusing me of academic dishonesty stating that I cheated using chatgpt when I really was studying using chatgpt. The stuff I wrote in the test were pretty lob* paragraphs, but I have long pages of notes of my studying and used to do mock trial and moot court so i am very familiar with memorizing long pages of stuff. I just had my hearing for my appeal for my academic dishonesty trail. It’s a very long story but the short story is I sent the wrong text message to the wrong chat room. This has caused intentional infliction of emotional distress. I pray the hearing officer finds me innocent .

My university was made aware of an alleged incident involving me, but chose to give me a warning instead of pursuing disciplinary action. Is there any general wisdom on what to do here? Everything I've read both in general and specific to my institution is on what to do if you are actually accused. To be clear I have told them *nothing* and not interacted with *anything* they have sent beyond reading it.

I have an absurd case against me. My professor claims that I have cheated because a student who was sitting beside on the test told the professor when she finished her exam (before I finished mine) that I was using my phone. I turned in my test 15 minutes later and the teacher told me what the student said. And asked “why did you use your phone” I said “ I was checking the date to type it in the test” as I am required too. Then the teacher literally said “ I don’t know what to do; I will look at your answers and figure out if you were cheating or not”. Now I have gotten an email from the university and I have scheduled a hearing. The professor also claims that she found on my test “things that are hard to remember that do not necessarily answer the question”. So what do you recommend me doing before and during the hearing? This was a writing test that is generally hard to cheat on and I have studied for it pretty well and I’m 100% sure that my answers are very close to the notes that I studied from and that I still have at the moment as the professor provided a study guide and 90% if not more of the questions that were on the study guide were on the test. I’d also like to point out that the teacher never saw me cheating (because it never happened) So it’s pretty much my classmates’ word against mine at this point. These types of University charges usually allow you to engage an advisor to help you. My first recommendation is to find a lawyer who is willing to help you. If you can't, then maybe a parent or other trusted adult. Next, you must review the charges in detail (with the help of your advisor) to understand exactly what the University must prove to establish you were cheating. This is where you may identify weaknesses in the University's case. Next, you must review and understand (with the help of your advisor) the University rules and regulations related to how the hearing will be conducted and what your rights are regarding how to defend yourself, calling witnesses, etc. And you are correct, it may come down to your word against the other student's word. Im in California. My son receives special ed services. After being forced to file a due process to get him an I.E.P. in which he was entitled because of his diagnosis. Within a week the district charged my 12 year old son with two out of three reasons a child can be expelled. Possession of controlled substance and sexual battery. The witness who actually saw that my son didn't touch anyone (sexual battery) was not interviewed. I have emails dating back 2 years that the children who are part of both allegations have been bullying him all this time. I am 4 days away from my expulsion hearning. Do you have any advice? The witness and his mother Will be attending the hearing with me. The district, conveniently, sent me the paperwork at the last minute leaving me no time to send in my written request to bring my lawyer.
Presenting a defense to these types of allegations is always difficult. If there is any way to delay the hearing until your lawyer can be secured, then start with that. A lawyer knows how to present evidence most effectively. If you cannot utilize an attorney, then make sure your witnesses are available to testify at the hearing. I don't know the rules at your son's school for how to present evidence, so I'd probably contact the person chairing this hearing to inquire whether witnesses can testify in person, or whether their testimony needs to be in writing. I was expelled by my college a year ago because of violating the code of conduct due to my disability autism spectrum disorder. Can students use disability as a defense. I was told that I have to follow the code of conduct regardless of disability. I don’t understand why high schools and colleges handle disability differently. This just prevents people with autism from getting jobs they are qualified for. People with autism are 50 percent unemployed. All I allegedly did was send friend requests to someone who signed a no contact order because they felt my disability was annoying to them.
Do you know the difference between right and wrong? That’s the key question in criminal law. Educational institutions may take a different approach, provided they provide due process.
@@GustitisLaw I mean that’s arbitrary. But my argument is that my disability forced me to violate the no contact order. A university disciplines me to educate me and prevent the action from happening again. But I can’t control my disability and this makes student discipline inadequate.
Do universities care if I have a disability in a conduct hearing? My disability Tourette’s syndrome made me say racial slurs online and I got placed on interim suspension for it.
They might take it into consideration, but I cannot tell you for sure since I have not investigated this case myself.

I have a charge of falsification of documents against me. I wanted to get into a course but did not complete the the pre requisite class so I created a document from a community college saying I passed the pre requisite class so that I could get in. I ended up taking the pre requisite but I took it after my other class was finished. The school ended up finding out and now I have a hearing. My intentions were to just get into the class. They were not to get credit for the pre requisite class. Is this a serious charge? I am going to tell them the truth because they have all the evidence they need from when I transferred my transcripts. What possible disciplinary actions would I face? This is my first academic dishonesty offense.

I am being denied access to my midterm because I am being accused of Non Academic Misconduct and they are saying the midterm has nothing to do with this issue but the midterm is a huge part of my defense. I know it well enough to be fine, and I have plenty of other evidence, but this is all part of it. I would not have stood up for myself and my classmates had there not been a question with no right answer on the exam, had there not been a question worth 46% of our grade at the very end of the exam, had we not been told that we could not go backwards in the exam, and had we been completely unaware of how the marks were being allocated in the exam That means we dare not skip questions, we were unaware of the value of the last question, and we wasted time on a question that was impossible to answer. I am going in tomorrow and I am being denied access to part of my defense, and with virtually no information on the accusations against me. At least I was smart enough to contact the student advocate, and to collect as much evidence as I could from other sources. Wish me luck, tomorrow 10:30 am.

@@GustitisLaw the student advocate came for the first meeting but could not make it for the second meeting. We ran out of time in the first meeting. I have a very solid defense, and the ability to view the Discord server live. Some of the accusations made were ridiculous. I had a zoom meeting to explain a question to several classmates, i did NOT do the question for them, but I explained HOW to do it. The professor accused me plotting against him and using Zoom to turn the class against him. How is that even a legitimate accusation? Now we wait and see. If anything happens, I will hire a lawyer and appeal.
I was in a breakout room on zoom doing a group assignment on the lab she showed us right before. I was sharing my screen with the group and we were answering the questions together. We got stuck on a problem and asked the professor to come to our breakout room but it said she was in another room and couldn’t join. So we all looked through our notes and couldn’t find anything to help us solve the question. That is when we found a quiz let that we used as a reference to help us solve the problem. My professor came into our break room and saw I had a quiz let tab open and took a screenshot and reported it to my university. I have a hearing tomorrow morning.
What is the allegation against you? Are old quizzes available as study aids? Where did you find the old quiz? It seems if a quiz is accessible on the Internet, it is open for public consumption.
@@GustitisLaw the allegation is that we used this online website to solve the problems on the assignment. The website had all of the answers but we only used it to help us with one question.

@@GustitisLaw I believe the syllabus states we cannot use information from online without giving the author credit but in our case it was a math problem. I just had my hearing and the judicial officer told me that I will most likely receive disciplinary probation for one year. It is possible I would receive a warning but she said to prepare for probation. If it does end up being probation do you think I should appeal it? I am supposed to apply to Physical Therapy school this fall and wouldn’t want this on my transcript when applying.

I was accused of registering to my course as if I was present but I actually wasn’t.. I did that because I already lost my 3 absence days. Lol💀 I feel like this guy will hate me forever (It’s my first year)

I am guilty of stealing phones and laptops on campus at the dormitories. On one fateful day ☠️I was caught and beaten up by the students in a mob justice. I received a letter, but I know it's my fault and I'll take any consequences they put on me.

The problem I find is colleges are becoming to picky with referencing. I even had to sign something. I don’t take chances I reference everything however, some teachers are becoming so strict that even if you accidentally reference something wrong it can lead to a zero. If I ever got kicked out I would be like see ya later! I have plenty of other colleges bookmarked I could go to!
It's especially simple for professors to find evidence of plagiarism in the Internet age. Even unintended plagiarism.

Honestly I have no respect for the school disciplinary hearing. It’s frankly a joke given in my experience and observations you guilty until proven innocent. Instead on innocent until proven guilty. My college threaten me with it because I was falsely accused of harassment. Now they never proved it and they never presented any evidence. But the way it worked is the university would rather die on this hill then admit they’re wrong. I had to threaten to get an attorney involved and the employee respond that he can see I’m not going to take responsibility for my actions. Despite them not proving anything. If they did take disciplinary actions most likely I’d dump them and finish my education somewhere else. I was ready to do it and had all arrangements prepped.
It's just moments like this that make me wonder how they even got into college.
