Need a lawyer to know if this is correct. I believe it was a case from about 1971, Haley versus the State of Michigan. An officer witnessed an infraction and another officer issued the traffic violation. The court ruled that the officer that witnessed the violation was more than 150 feet from the location that another officer issued the ticket, therefore it was thrown out. Court case precedence should say that the officer that is standing on the corner should be the one issuing the citation. The same goes with the use of airplanes to issue speeding tickets, the officer in the airplane should have to land the airplane to issue the citation.

The police sign an affidavit and are under oath. Their testimony is considered credible evidence in court. They can be charged with perjury and given jail time for not being truthful.
Police will sometimes park behind a parked car with their lights on, so you think it is someone getting a speeding ticket, so you don't have to worry. Then the officer pulls up behind you and YOU get a ticket for speeding. Police HAVE used these devious tactics (throughout the USA) for years. If you need to use your cell phone, pull over into a church parking lot. They won't hassle you or threaten to tow you like a fast food establishment.

It’s okay if they are just getting warnings from the cop. Technically, an undercover cop can’t witness the traffic offence and relay that info. to uniformed cop to then write the ticket. Only the cop who witnesses the infraction can issue a fine for it.

Maybe if cops would stop driving 120mph to give someone a ticket for going 70, chasing people down on motorcycles to issue seatbelt tickets, or driving and typing on a laptop while fining people for having a cell phone in their hand, I might be able to take the road pirate/clowns seriously.
Doubt any tickets given would stand up in court, since it's already next to impossible for a cop to prove that a driver was on their phone to begin with, and having a cop allege they saw someone driving by on their phone only will makes things even harder to prove.

The court ruled that the officer that witnessed the violation was more than 150 feet from the location that another officer issued the ticket, therefore it was thrown out. Court case precedence should say that the officer that is standing on the corner should be the one issuing the citation. The same goes with the use of airplanes to issue speeding tickets, the officer in the airplane should have to land the airplane to issue the citation.
More of this, please. Distracted driving is a major factor in our insurance premiums rising - so much so, that the person who rear ends you often times has no insurance because it's too expensive. The cycle of cause and effect.
Not true, accidents and fatalities have been going down for decades while premiums are still going up.

@@nasrhussain9126 I never implied that. I do know that insurance companies use accident rates to justify their rate increases. Personally, my auto and motorcycle insurance rates have dropped steadily over the past decade. But that is probably because I shop new rates every year.
It’s only entrapment if you’re doing something wrong stop looking at your phone when you’re supposed to be concentrating on the road. The car is a weapon and some of these big trucks can do a lot of damage.

People are so addicted to phones the police need to enforce bans on "distracted driving". My daughter and son-in-law gave me a Christmas gift of "Ear Buds" They are still in my kitchen drawer. I'm a military veteran, I need to hear somebody sneaking up behind me.

It's about making someone do something they wouldn't normally do when prompted by law enforcement.

The only thing I disagree with is not telling people when and where they will be doing it. DUI checkpoints are routinely published, at least where I live in metro Atoanta, GA.
If they have enough funding to run around undercover to catch people doing victimless crimes. Then they need to have some of their funding cut.
Tell all the families who have lost loved ones to distracted driving because of people on their phone how 'victimless' the crime is.
This is about cops wanting to search the cars of certain drivers. This isnt about cell phones.
People claiming entrapment apparently don't understand what that term means. It's about safety for other people on the road as well as for the drivers themselves. I would absolutely favor giving these drivers a warning before issuing a ticket that could affect their insurance rates.
For anyone saying this is just another "tax collecting method" normaly I would be inclined to agree....but when you watch the pathetic use of traffic stop police training...the fishing, the lies, the intimidation and escalation. This is not that, distracted drivers are very dangerous, and should be held accountable.

It's no different than when they do speed enforcement from aircraft. As long as both officers show up to court, it's all legal.
The police sign an affidavit and are under oath. Their testimony is considered credible evidence in court. They can be charged with perjury and given jail time for not being truthful.
Police will sometimes park behind a parked car with their lights on, so you think it is someone getting a speeding ticket, so you don't have to worry. Then the officer pulls up behind you and YOU get a ticket for speeding. Police HAVE used these devious tactics (throughout the USA) for years.
If you need to use your cell phone, pull over into a church parking lot. They won't hassle you or threaten to tow you like a fast food establishment.

Good on them to enforce it! Some drivers are waaaay too comfortable staring at their phones while controlling a 2-ton piece of metal in motion. I see it all the time.

It’s okay if they are just getting warnings from the cop. Technically, an undercover cop can’t witness the traffic offence and relay that info. to uniformed cop to then write the ticket. Only the cop who witnesses the infraction can issue a fine for it.

I’m all about less policing with minor traffic infractions but distracted incompetent driving is worse than speeding and needs to be enforced more strictly
If this is really about “public safety”, then they wouldn’t charge money for it and would instead make drivers do community service, suspend their license, or something OTHER than charging fees for tickets.

The only problem with this is the fact that an officer can lie and say that they saw you on the phone. You're being pulled over down the road but the infraction happened a block away and it's not on video. I call bs on this.
Misplaced outrage. Assuming all the people getting stopped actually were on their phones (not targeted for other reasons), the police aren't doing anything wrong here. This, however, is coming from someone way down in the police-state of Louisiana, who's accustomed to cops constantly harassing innocent people who were doing absolutely nothing wrong.

Maybe if cops would stop driving 120mph to give someone a ticket for going 70, chasing people down on motorcycles to issue seatbelt tickets, or driving and typing on a laptop while fining people for having a cell phone in their hand, I might be able to take the road pirate/clowns seriously.
Doubt any tickets given would stand up in court, since it's already next to impossible for a cop to prove that a driver was on their phone to begin with, and having a cop allege they saw someone driving by on their phone only will makes things even harder to prove.
