    The front number plate thing is an issue the Met traffic police want to crack down on but dont have resources. Apparently super car owners can opt for a stick on front number plate as a fixed one spoils the line of the car for the poor didums. They then “forget” to apply the front stick on plate. Police have threatened to report the cars they do stop to DVLA and have a Q plate assigned which destroys the cars value.

    • @ianmason.
      @ianmason. 2 месяца назад

      It's a hollow threat. Q plates are assigned to cars whose age or identity are unverifiable or unknown. Anyone who can afford a supercar can afford to sue the DVLA for not following their own rules and issuing a Q plate as a punishment that isn't provided for in law. That would be misconduct in a public office which is a criminal offence and which would fall on the shoulders of the individual at DVLA who took the action - no job, no civil service pension, and probably a moderately hefty jail sentence. The Court of Appeal has held that “save in exceptional circumstances, the gravity of [misconduct in public office] and the high public interest in deterrence means that it will attract a sentence of immediate custody”. As there are specific offences that may be charged with relation to failing to display a number plate the threat to inveigle DLVA in an extra-judicial scheme of punishment also leaves any police officer doing so open to charges of misconduct in public office. The police are there to enforce the law, not make up their own punishments and enact them.

    DRIVING AND MOBILE PHONES: this was covered in Vol 317 and these were the two comments that answered Tony's question:
    From SHM5547:
    regarding phones in cradles, I believe there are three laws that apply:
    1. Road Vehicles Construction & Use 1986 (amendment 2 2022) Regulation 110: the well known can't-use-it-if-hand-held, updated in 2022 so that 'using' doesn't just involve communicating, but also illuminating the screen or unlocking device etc. Just having it in you hand is still ok though (if you just moved it without illuminating the screen - bit dicey if you have 'raise to wake' enabled!).
    2. Road Vehicle Construction & Use 1986 Regulation 109: this is not widely known, but this regulation makes it illegal to display on a 'cinematic screen' information that is not related to the vehicle, it's position on the road (e.g. reversing camera) or navigation. This applies whether mounted or not. So technically, it appears to be illegal to use a mounted phone for any other purpose. This even caught the police out, as their in-car ANPR system had to be redesigned as the driver was able to see ANPR information, which would have breached this law.
    3. Road Traffic Act 1988 Section 3: your classic careless driving, where the offence occurs if the driving falls below the standard of a careful and competent driver.
    And my comment:
    MOBILE PHONE LAW: Road Vehicles (Construction & Use) Regulations 1986 - Regulation 110 creates the offence of using a device which is handheld. Reg.110 does not prescribe any restriction of how that device may be used when handsfree. HOWEVER, Regulation 109 does. I am hoping there is a Road Traffic Police Officer reading this who can check this fact, because not even the Black Belt Barrister was aware of this, until I wrote him a letter! Regulation 109 - firstly, the restriction on Cathode Ray Tubes (CRT) has now been superseded, the Reg. applies to all types of display screens. In paragraph 2 of Reg. 109, it sets out four criteria to decide whether a display screen is classified as a "television receiving apparatus". Can the screen (A) receive a television broadcast = A "smartphone" can receive a television broadcast via a data connection, I was watching BBC News 24 live on Monday on my "smartphone". Can the screen display a recording? A "smartphone" can, such as RUclips or an MP4 video stored in memory. (C) view an image on from a camera? Yes a "smartphone" can do this and, (D) view an image from a computer? a "smartphone" is a PC which generates imagery. CONCLUSION - a "smartphone" meets all four Criteria, but it only needed to satisfy one! The END RESULT, if you have a smartphone in view in your car, you can only view 4 types of information - (1) Information on the status of the vehicle's EQUIPMENT (not music or other entertainment), (2) view information about the location where the vehicle is located (eg road temp./ altitude/ gradient), (3) view the proximity (reversing) cameras, or (4) view information for Navigation. If a driver is viewing absolutely anything else, THEY ARE COMMITTING AN OFFENCE. That includes music on Spotify, list of SMS text messages etc.
    SHM5547 mentions in paragraph 2 that even the Police were caught out, and here is the explanation of how they found out:
    @tanderson278 2 months ago
    I raised the issue of Regulation 109 and Smartphones with the Police in December 2018. Initially the Police replied saying Regulation 110 allows the driver to view a Smartphone when driving. A day or two later they changed their minds. I received a short email from the Police Officer stating "I agree, you are right!" What followed - Police Officers were issued with a waring stating that if they view the ANPR screens when driving, they would be committing an OFFENCE under Reg.109. In November 2020, a amendment (Vehicle Special Order VSO) was passed in Parliament, giving special dispensation to the Police, so that they could drive their Police cars legally.

    The first clip reminds me of a couple of things I saw from a driving instructor.
    I won't name the 3 letter name of the driving school, but our nickname for them is Bull S**t Method (you can probably guess what the name is).
    The first one was approaching a set of traffic lights, me in the right lane and driving school car in the left lane. The lights change to amber so we both slow down. As the light turns red I stop, and I see the instructor wave his hand telling the learner to go through the rred light.
    The other one was a driving instructor probably on his way to pick up a learner. Driving around a roundabout with his phone clamped to his right ear with his shoulder, left hand on the steering wheel and right hand holding an A to Z map.

  • @paulwinstone4825

    That keep clear one reminds me. Near me outside a school there is keep clear. The reason is there is a light controlled crossing to the left as you come out, so the whole point is don't enter from the right and anyone wanting to leave the school (which also has a leisure facility there) can do so when the lights turn red. Or at least they can if no cyclists go through a red light.
    On Sunday, I'm passing from the right and the lights go red so I stop outside the keep clear. Two drivers emerging from a road on my right think I've left this space for them to get out and they ignore my protests, instead "thanking me" for letting them out while the lights are still red to block the keep clear. Might have it on camera...

And a few years before that, I was gobsmacked at the number of people not wearing seat belts, esp a local motor factor business with lots of vans. They said they didn't need to as they were delivering. The law stipulates that as long as your drop-off points are within 50 m of each other (ie postmen in vans) you don't need to wear a seat belt. Taxi drivers don't need to - mainly for safety if they are attacked by their fare. You can remove seat belt if you are reversing.
