Rhode Island files lawsuit against 13 Washington Bridge contractors

  • Rhode Island Attorney General Peter Neronha said Friday that the state has filed a lawsuit against 13 contractors that provided services related to the Washington Bridge in an attempt to recover funds stemming from the bridge's closure.
    The lawsuit will try to hold accountable those companies allegedly responsible for the closure of the bridge and to recover significant resources, according to a joint release from the attorney general's office, Gov. Dan McKee, and the governor’s legal team of Max Wistow and Jonathan Savage.

    I'm an engineer. Where was the State DOT oversight on those contractors. No contractor ever did an inspection in my plant where I did not stay on top of them and ensure that they were doing a good job; and I've kicked contractors offsite and hired replacements where they were not.

      @@RedtideFla Very unlikely. One or two contractors might be guilty; but most contractors do in fact meet their contracts.
      I'm betting that most of the contractors successfully defend themselves.

      In their offices, pretending not to notice...Last one hit their 30, and retired to FLA...Imagine if we go back, we would find they were informed, just not officially on any official document...

    This is not business as usual. No other State has ever sued every possible contractor alleging such poor performance. Yes there are occasional lawsuits against a specific contractor. But nothing like this.
    And RI wonders why none of these contractors even considered bidding on replacing the bridge.
    Personally, I believe it's the State DOT trying to cover up how incompetent they are - and thinking that lawsuits against every company possible is going to produce good results in the future for the State.
    What it will do is increase the cost of every major project by at least 50% - and possibly double the cost. Companies have to be paid for the risk they are taking - and RI is yelling at the top of their lungs that you can expect to be sued if you do a job for us.

      @@newmobile1455 Because it would have been built to the then-current standards. Inspected by the state and local authorities while being built. Where were the STATE inspectors? The STATE engineers?

    These companies didn't build the bridge.They Ware hired to assess the bridge and recommend the repairs.If the state did not make the recommended repairs,then why should these companies be liable?

      The lawsuit claims that those companies which were hired to assess the bridge FAILED to report the repairs that were needed.

    Remember the Rhode Island Resource Recovery(landfill debacle?) 75 million disappeared. Only about 21 million recouped. Some of the recouped money(3.5 million) went to balance the state budget in 2011. Read Ted Nesi’s 2015 article about it. This stuff has to stop. Welcome to Rhode Island.

    Has anyone asked who wrote the specifications for the bridge? Typically bridge construction is put out for bid. Those bids are predicated on the specifications set by in this case the state. The oversight of the construction rests with the engineering firm that the state hires/state engineers to inspect and confirm that every phase of the specifications are being met. It might be interesting to find out how this all worked and who inspected it and put the approval stamp on every phase of the construction.

    This is BS. What happened to the 'overloaded truck' that damaged the bridge, a bridge that was 'perfectly OK' at its inspection only months before the closure? This is next level CYA stuff. They wanted a bridge to be kooky retro looking back in the day and used construction designs that were not typical in order to achieve this. The FHWA requires bridges be inspected every two years (no matter what the DOT guy says about his instituting it).
    I read the 100s of pages of the last inspection report performed before the closure. This is no different than Pittsburgh's Fern Hollow Bridge. It collapsed due to mismanagement and mismanagement alone. In the RI case, the state had detailed inspection reports (with photos) that painted a picture of a failing structure. The state knew that replacing the bridge was both cost and politically prohibitive and sought a cheap fix as an alternative. They then directed an engineer to draw up plans for said cheap fix, put it out to contractor bids, inspected every inch of the contractor's work along the way, and called it good - over and over again. Now, they want to blame someone else for their own decisions.
    This is no different than the 35W bridge in Minneapolis. That bridge's problems were well documented by engineers with seized expansion joints, corrosion problems from road salt and pigeons, two additional lanes of traffic with much heavier loads than designed for, etc. But the state of MN still blamed the original designer (from the 1960s!!), contractor performing repairs, and consultant engineers that had warned of the problems.
    Bottom line: The state knew about it, kicked the can down the road, and now want to spread the blame amongst those that warned them and those that they hired to cover it up with mortar and paint (per the state specs). SMH.

    If I were an engineering company, I would not be tendering for work in RI in the future.

    Sounds like if they would have brought up the problems in 2015 they would be sued for not mentioning before that since they talk about the early 90's. Most things don't last forever and bandages are temporary
