As former members of DBSK, JYJ are entitled to be able to sing their old songs, just like they are entitled to have possession of the actual tracks--but this is something I doubt SM will allow them to do. So the next best thing they can do is just sing pasts songs freely without intervention from SM.

They were in their right to sing those songs even during their legal issues with SM. But knowing SM's history and of their corruption, they would have found a way to try and stop that. SM can't do anything to CJES without justifiable reason, seeing as CJES isn't actually JYJ's managing company--they've stated this before.
