      For sure it shouldn’t be an option. I understand that these body cams are publicly accessible, and it would do some harm for the public to hear police tactics, but they can edit the actual parts that can’t be shared post recording. In reality when they mute their bwc, nobody except for them could possibly know what they’re discussing.

      They always do. It's a meme at this point: "We have investigated ourselves and found no evidence of wrongdoing."
      Any time a PD self-investigates and finds nothing wrong, then loses or settles a lawsuit over the same incident, every investigator and leader in the PD should be fired, as they have been proven to be untrustworthy or incompetent.

      They generally back the officers unless the incident was bad enough to get the whole department upheaved. It's a way for them to deter you from continuing your lawsuit. If this case had a large public backlash, they would side with the public and fire the officers

    They essentially took the word of an anonymous caller who believed the house was foreclosed. The cop essentially forcibly stole the license. These cops have zero business being cops and are unable to investigate anything.

      ​@@JustMe-fo4ev Well there's also the matter of the legal term reasonable articulable suspicion (RAS) of a crime.
      A RAS is a low standard, but it is a higher standard than a hunch and the court made it clear an anonymous call who is not directly witnessing a crime is not enough to form RAS. Although the anonymous caller allegedly witnessed people on the property, as the non-owner and being anonymous they cannot say without a doubt the persons on the property are in fact trespassing.
      ^^ This was proven by 2 factors:
      1. The house was not in foreclosure
      2. The "people" on the property were in fact the owners
      I'm sorry for the long explanation, but this is important as the police cannot legally detain you without reasonable suspicion (RAS). Additionally, civilians are not obligated to assist the police in their investigation. As a person operating a motor vehicle the driver was obligated to present his ID to the officers, but the officers technically had no reason to detain him and ask for ID to begin with.
      What really could have solved this is the cops understanding what the words on the sign meant, asking for ID (which they technically could not demand and technically did receive), and releasing the civilians once they realized that their address of record was the property on question.
      We are not obligated to help the police investigate; so after whatever questions we choose to answer have been answered the police have to let us go unless they find additional evidence (or we self incriminate which is why you should invoke the 5th). It's the job of the police to investigate on their own. 911 systems record the phone number of the caller so why did the police fail to back trace the number, and speak to the caller in person?

      They never go after the callers. Because those calls = revenue. They'll never make people think twice before calling because that would invalidate most of their employment and negate a good amount of their revenue. For most of the officers out there, if they get a call, someone is going to pay. They love getting calls.

    Okay, so apparently in Utah, if you call the police and tell them your neighbors have been foreclosed on, they’ll come right out to harass them regardless of the facts or even the law.
    However, if you report your neighbor is beating and starving their kids, it takes 3 goddamn years and one of the kids climbing through a window to get help for them to respond.

    I’m a 71 year old lady living in the UK. I came across this channel by accident and I’m transfixed. So impressed with the format of videos and quality of USA law information but I am beyond horrified at the behaviour of the police.

      Atter seeing videos such as this one I think anyone would be horrified at the police behavior shown. The good news though is that cases like this are actually very rare here despite how these videos make it seem. While this channel has hundreds, possibly thousands, of cases of officers behaving badly, you must remember that we are talking about years of real world time across a land mass the size of the USA, in which every single day there are probably millions of police interactions nationwide. When you are talking about billions of total police interactions having only a failure rate in the three to four digits long while still tragically too big is well within statistical norms for any country.

    So we have a policy where we can mute body cameras that we control and that we can audit/blur out any information before submitting it for public view. Body cams should never be allowed to be changed in any form by court purposes. If it’s sensitive information, I’m pretty sure it’s not sensitive enough for a judge and 2 lawyers to view in chambers. If they can mute this when releasing it, there’s no need what so ever to ever mute body cams.

    On Nov 22, 2023. The Ogden Police Dept posted on their Facebook page about this incident. It read, ""The Ogden Police Department is aware of a complaint filed by Attorney Bob Sykes. The complaint is in regards to Ogden Police case 22G85110 which occurred on November 29th, 2022. Rand Briem was charged with Interfering with an Arresting Officer. The case is still pending in the Ogden Justice Court. A complete After Action Use of Force review was completed in November of 2022. There is complete Body Worn Camera footage of the interaction which was reviewed by the officers chain of command as part of our After Action Review process. The Ogden Police Department is confident that the court will find our officers use of force justified as our internal review did."" That last sentence says it all. Bunch of tyrants. The whole department.

      So many stories like this, with people on their own property. And yes, i understand as a cop, you do not know who that person is, but a simply check with their radio to dispatch, get the owners name/date of birth based upon the address, ask the person on the property their name and birth (no need to ID as its extreme unlikely that a trespasser knows the exact name and birth year/date) and done. See, how easy that is and it did not involve the need for any ID. How many people even carry their ID on them, when they are on their own property. 99% of them need to enter the home to get the ID, and then we enter the whole cops that enter with people into their homes issue.

      It doesn't sound like a call that can be solved in the field. At the end of the interaction those cops don't have any clue if the house was foreclosed on or when. So they don't know if he can be there or not. Getting his ID doesn't advance that. They needed more information before arriving at the house.

      Personally, I would have simply let the man leave. After all, the supposed illegality was him staying on the property so him leaving the property should have been allowed. I would have simply written a report that I arrived at the property in question, witnessed an elderly man leaving the premises in a vehicle and finished by putting in a request to the department for a follow up visitation / investigation.

      It is a crime. Violating the constitution is also a crime. Excessive force is also a crime. And not a single one of these cops will be charged with it because they are considered above the law and don’t have to follow to same laws me and you do. It’s a disgrace.

      I personally dealt with the latter recently.
      Cop tried to force his way into my house without a warrant and without any exigent circumstances.
      Filed a report and requested the body cam footage showing him doing it.
      "We don't have any of that footage b/c officers are only required to start recording when they make contact with an individual."
      I told them "So as long as there's no one looking, you guys can do whatever the fuck you want and violate any amendment you see fit and it's all gravy b/c you don't record shit. Or you probably do record it and just delete it when it incriminates you. Nice job on the internal investigation. Not corrupt at all..."

    This is infuriating. The way these officers discuss the incident exactly describes their mindset: "You took a hard fall." Do you mean when you pushed an elderly man to the ground when he tried to get his ID back after you grabbed it from him? "You tried to run us over." Do you mean when he tried to leave his property and you were standing in his driveway trespassing? Unbelievable.

    Without an eviction notice posted these clowns have no reason to detain or arrest them.
    These kinds of criminal cops need to be charged, jailed and their pensions should be forfeited to their victims.
    End qualified immunity and disband the FOP.

Not only this but the files don't even need to be hosted on police servers themselves, they can be hosted on the Internet Archive which is the case for a lot of government documents already, like the unsealed Epstein/Maxwell documents.

    The man was on his own property and had broken no law. He had no duty to identify to aggressive officers that had performed absolutely no investigation whatsoever. The fact that officers physically attacked a man in which had broken no law is testament to their lack of confirming any crime had occurred before resorting to violence. And understanding that even if that homeowner was in fact a criminal, the criminal would be set free because of a “technicality” that police had not established any reasonable suspicion or probable cause to detain a suspect. It’s “fruit of a poisonous tree” doctrine.
