  • Fairytale Farm Animal Sanctuary is a refuge for abused and neglected donkeys, goats, rabbits, ducks, and more. The sanctuary is also the home of Kimberly Dunckel and her family. But when the Dunckels invite visitors to their home, they risk being cited by city officials for running afoul of the zoning code.

    Winston-Salem’s zoning code would allow the Dunckels to operate a home day care or teach music lessons. But because operating a nonprofit animal shelter is not explicitly allowed, the city says that the sanctuary cannot have events, teach classes, or host groups of volunteers. Because engaging the community at their home is critical to supporting Fairytale Farm, the Dunckels teamed up with the Institute for Justice (IJ) to file a lawsuit in state court challenging the restrictions on visitors.
    “Winston-Salem’s zoning power does not trump Kimberly Dunckel’s right to use her property to serve the community,” said Institute for Justice Attorney Anna Goodman. “She’s not hurting anyone, she’s only helping. And the city cannot prohibit her and her family from using their property as an animal sanctuary just because it was not creative enough to consider that potential use.”
    In 2017, Kimberly and her husband Art began searching for a property that would serve both as a home and a place to host the Winston-Salem community. After purchasing and restoring their 3.3-acre lot, they started caring for animals, many with special needs and some referred to the sanctuary by the local government animal control. In 2021, they registered Fairytale Farm as a non-profit. They hosted groups of Girl Scouts and homeschoolers, held themed events for people to meet with the animals, and welcomed groups of volunteers to help with care and upkeep of the sanctuary.
    But earlier this year, the city ordered the Dunckels to close the sanctuary completely. After an outpouring of community support, the city changed its mind but gave the Dunckels new and confusing restrictions on the visitors they could host at their home. Those restrictions have made it difficult for the sanctuary to fundraise, threatening its long-term sustainability.
    “We hoped that the animals we invited to Fairytale Farm would have a happily ever after, but the city’s senseless restrictions are making it difficult to care for these rescues that have already been through so much,” said Kimberly. “We’ve been operating for over a year without complaint and taking in animals that local shelters don’t have a place for. It seems like we’re being singled out for doing something good that doesn’t fit neatly into the zoning code.”
    Zoning codes in the U.S. often seek to prohibit people from using their property in safe, reasonable ways. IJ is currently defending a Texas mother seeking to operate a home daycare, a Texas mechanic required to provide an impossible number of parking spots before he can open his shop, and an Idaho woman who can park her tiny home on wheels in her town but is banned from living in it.

      This is how I view thing. Can someone take something from you? Can they tell you what you can do with your thing?
      If the answer is yes to any of this, then it isn't yours. Which means nothing is truly yours, other than your body. And that is questionable at best if your body is really yours.

      @@zippythechicken I looked too. They aren't "tiny" pieces of property, and it's not what I would consider suburban. I'm glad you're probably fortunate enough to have acres of land for yourself, but for the vast majority of people, that isn't the case. Regardless, if they aren't causing a nuisance, neighbors aren't complaining, then they should be able to save disabled animals on their own property without you and the government trying to shut them down.

      We all live in a controlled state. The government is not a robot or being from another planet. Although they usually behave as it they are from another planet, they look human. How is it that in a free country we don't live free of someone telling us what we can and cannot do? No wonder there are people trying to overthrow the government. AND its gets progressively worse.

      Ike! It’s absolutely ridiculous! I recently bought a home in town where there’s a very small yard however the privacy fence that was/is already up, turns out can’t be moved back towards the road behind us without at the very least a permit?!? It’s not much but moving it even 6 ft back gives my Cane Coro/Mastiff more room to have. It’s been a nightmare since day 1. The neighbors on 1 side refused to let me on one side of my house because they have been using the privacy fence attached from the edge of my home (I’m assuming because it was a lot cheaper to go from the edge of my home back rather than the property line. According to the city paperwork their garage is a foot or so on my property… however we was told to hire a survey crew which we did only to be told the city property lines were wrong and I have about 3 inches along that side of the house! It makes no sense! How can even regularly check that my home doesn’t have any issues or repairs needed let alone… GOD FORBID when the day comes I DO HAVE TO DO ANYTHING IN MAINTAINING MY PROPERTY. She RAISES MASTIFFS & actually what started this is when my 75 yr old mother was using our restroom and one of the neighbors massive dogs jumped up onto the window ledge right next to my mom and started barking at her. It sounded very aggressive and my Mom nearly fell off the stool! All that bad enough but she was fighting cancer and didn’t need anything upsetting her let alone possibly causing her an injury had she fallen. My story is NOTHING like this heartbreaking story but just goes to show us all that it doesn’t matter that we own outright our own home/property… THE GOVERNMENT HAS THE FINAL SAY IN OUR LIVES. It’s insane to put it mildly 😔 I hope this sanctuary finds a way to overcome all of this and continue the work that God himself would want.

This is horrible since we take in critters all the time and we do understand that they'll need help for some unusual problem they'll encounter.

      Not just cities. I have some land in an unincorporated county area. I was going to put in a vineyard and then, open a winery. The county only has 6500 people in it, with a land area of 6200 miles. My land is in the actual "middle of nowhere". I was told that I could plant a vineyard, but I could not make wine. I was also told that I could not move my warehouse and manufacturing business to my property. I called all of the people at the county offices "collectivists" and said I might sue them. Of course, I would never win. So...there goes my dream and wasted resources.

    What was the city's motive for enforcing or interpreting the code in a way to shutdown the sanctuary? I have to assume someone claimed animal abuse, noise disturbance, or something else. It was probably a bogus claim, but cities are stupid when it comes to those things.

    The people are not doing anything wrong. Fairytale farm is a wonderful serve for the community to learn and teach future generations about helping, looking after animals. I'm on the side of Fairytale farm.

    I'm so sick and tired of cities coming up with bogus bylaws which block people from doing good in the community...telling this sanctuary they can't fund raise or only have 4 volunteers at a time...come on..the city isn't giving them a pay check...what's it to them if there's 4, 5 or 10 volunteers...they make me gag..thank God there are families helping the challenged, neglected animals..the city wouldnt

    If things go wrong, there’s this nice animal sanctuary in Virginia called Poplar Springs that I’m sure would be happy to help.
    I know the family well, they’re amazing people, there’s lots of land and they take great care of all kinds of animals including disabled ones

    So INSTEAD of sensibly and quietly reforming the zoning code, they would rather hurt these incredible, kind, peaceful people and taxpayers AND all their innocent animals.
    I'm just gobsmacked.
    May god save us from the utter psychopathy of the sick people who win public office here. If it's not one thing it's another. And from my experience plus the reports here- it's literally everywhere. It's depressing to realize the filth always floats to the top, but it's better to know these things than not know.

    It's a shame no one challenges aggressors to morally justify their threats of violence against peaceful people. Bullies have peaceful options but choose to use rules like "laws" as excuses to threaten, extort, and punish their victims. If you can't morally justify doing something then don't do it. You can legally justify all kinds of evil and they do!

    The city had the opportunity to shine. Instead they chose this opportunity to be a bully.
    It's simple. Have the sanctuary and city attorneys agree on an exclusion for this organization.
    Afterwards the city can have an interview with the local news displaying their service to their constituents. It's a win win for all.

    Hmm, INAL, but the summary above says this "...because operating a nonprofit animal shelter is not explicitly allowed..." I am assuming it says that it does not say it is *not* allowed either? I'd tell the city to politely take a flying leap off a cliff. Seems like some bureaucrat just has an axe to grind to justify their pointless job and forcing a family who do this to spend money on litigation instead of where it needs to be which is helping the animals. Good on IJ taking this - I hope they win.

    Can’t see how the city can regulate volunteers. I understand if the sanctuary was charging an admission fee, but for ordinary citizens to use their free time to care for animals is of no concern to government.

    Volunteers? No, they are pastoral assistants!
    Group of friends? No, they are clergy!
    Visitors? No, they are churchgoers!
    Classes? No, they are sermons!
    Events? No, they are religious rituals!

    The restrictions of numbers allowed to volunteer is unjust & outside the county's jurisdiction IMO. If there's no impact to adjacent properties & the sanctuary was originally approved, what's behind the change? Much like jailing folks trying to help with feral cat issues, this seems an unwise use of local resources when private citizens are stepping up to provide services the county can't or won't.     The government often tries to exercise "ownership Rights" over the private property of it's citizens. The Constitution spells out exactly what can and must be done in this situation. In order for the government to exercise ownership Rights on someone's property, they must decide what specific public interest the property is required for them to be able to fulfill. Maybe a needed public road coming through that spot, or whatever else they can dream up. Then they can use imminent domain to take the property. However, they must also pay the owner fair market value in exchange for the property they are forcing the owner to transfer to the government for public use.
    Very simple, cut and dried. They have no other option, as long as the owner sticks to taking cover under the protection offered by our Constitution. They must not allow the government to change the subject, or lead them down a statutory rabbit hole. Statutes are NOT law! In fact, the "judges" this case will most likely be heard by, are not even real judicial officers.
    Their power does not come from the Judicial branch. They are under the Executive branch. Look up the Department of Justice (through which they exercise their authority), and you will find it is administered by and under the Executive branch of government.
    Their authority actually comes from the Legislative branch, through a convoluted arrangement with the Executive branch to run the lower Courts. You know, the State Superior Court, or State Supreme Court, etc., etc.
    That's why you can see senators and congressmen stand there and ridicule judges for things they've done which the lawmakers didn't like. They would never speak to a real Judge, one on the United States Supreme Court, in such a disrespectful manner. They are real Judicial branch employees.
    The owners of the property must insist that their Rights be respected under our Constitution alone, and they should prevail in the end.

    It should not require a 'permit to', because our rights are inherent.
    The closest the government can cook up, is a law barring the specific act.
    Sometimes, we the people need to remind the government of this.

    Zoning, city codes , permits . Let’s face it you’ll need a permit to breathe the way things are going . All the rules and regulations restrictions all neatly packaged as being “ Good for the community” “ Good for the citizens “ Good for the children . “ Good for the environment “ . Almost everything classed as “ For our own good “ coincidentally makes money for “ Someone “ gives more power to “ Someone “ over our lives and how we choose to live .
    However well intentioned the original premise of a rule or regulation , there is always “ Someone “ who will take it to the extreme and way beyond the original intent for their own ends or gratification. That’s why we need to watch that “ Someone “ and when they take rules and regulations a step to far we need to step up and make some noise , challenge ,
