Actually when it is dismissed with prejudice it means they can't refile the same lawsuit however they can appeal to have not only the original verdict overturned but also the "with prejudice", I've seen it happen. Appellate court is completely different than standard Court.
According to Mister Googlepants, an appeal is considered an extension of the original case. But under a bunch of legal principles such as res judicata (already ruled on) if all the appeals fail the plaintiff can't re-file the lawsuit in the original court or any other court.
@@GreenKnight1982 Yep, the "Without Prejudice" is a rarer thing, it's more of a thing where it's one where it seems like the case has something the courts might need to figure out, but that there was something wrong with the case itself or something that couldn't be proven either way and is something that it's possible for there to be more evidence found at a later point.

Often times the actions of these HOA's are dictated by just 1 or 2 individuals that think they have more powers than they actually do. If the rest of their 'constituents' knew what they were up to they'd be trouble.
Why is it that EVERY HOA interaction provokes a reactive response from the intended victims?? Enough tales on YT to suggest IMMEDIATE legal intervention on initial contact with the HOA.
Title story: I hope OP sued the HOA for the destruction of his oak tree. Depending on the age & condition of the tree, damages for it can run into the tens or even hundreds of thousands of dollars.
The first story. Suggestion to OP, Always, always, get money upfront. On your contract, make sure you get a substantial percentage before even ordering the equipment. And use that money to order the equipment. Then get a percentage as you work. The last percentage would be your profit, be it 15, 20 or 30 points. This way, if the customer refuses to pay you on work completion, all you have lost is your profit for the job. You were fortunate you were able to get a lien on the equipment he didn't pay you for. Doesn't always work that way though.
Considering I live in the city of Oak Ridge (see Manhattan Project) I should find that HOA story and then sue them to make them change their name of their Community for besmirching the name Oak Ridge!

What is really annoying about these fake stories is the simple fact that if there is no contract, there is no HOA. They CANNOT just take over someones property, let alone alter ANYONES property.
You would be immensely surprised what these little fascist Utopias actually try to do. I mean they literally try Banning the American flag yet there is federal law stating they can't.
It's not legal for an HOA to do this stuff. But they do it anyway, and hope nobody will fight them. Most people see something official looking and accept it as gospel. Either that, or they don't have enough money to hire a lawyer to fight the HOA. EDIT: In the USA, if you fail to respond to a lawsuit, no matter how ridiculous, the person suing you wins by default. So your access to justice depends on your socioeconomic status.

I liked the first story, very credible, although, from watching just as many cop bodycam channels as ones like these, Blue usually reaches for yellow to taze your ass before going lethal when being bullied by unarmed citizens.
A Lawyer argued that the Association could unilaterally take over a neighbors property? He's lose his Law License. What a preposterous story. I just don't know where to begin to list all the things that do NOT happen as described here. ALL the objections that the homeowner made, are precisely the things that would keep the Homeowner association from even bringing this into court. To have a case, they'd have to mention at least SOMETHING that gave them rights to the property...but from start to finish it was illustrated that they had nothing...and so it would not have even made it's way before a judge. The Police would have jailed the Association Members every time they offended. I bet I lost some IQ points watching that story.

Judge: "That's not how it works, you lose"
