A letter to the CJI of India regarding an interesting episode and an SC judgment thereto.
A two judge bench of SC didn't grant anticipatory bail to the former Opposition leader of Odisha,Mr Mishra, as during a protest march ,he allegedly slapped a woman inspector .A couple of days ago, a two judge bench of the Supreme court issued strictures to former opposition leader of Odisha J.Mishra for the misdemeanour. The bench mentioned that the said leader ,must know how to behave with a lady police officer. Let me tell you sir that the police inspector was in the wrong for the following reasons:
1.She being a female officer, shouldn't have faced a male crowd all alone, for as we have seen on news channels of that day, she was pressed by the crowd all around. She should have asked some of her strong and clever male colleagues to face the situation with tact. . A king doesn't go to face his opponent directly to show his heroism ,he must send his generals to do the job.
2.The lady police officer is supposed to have the ability to understand the situation. She should know that the opposition leader Mishra, didn't come directly to her office to slap her. He was a part of the crowd, his movements (he was a kidney patient) were unsteady; it was controlled rather by the superior force of the crowd. It is known that the lady with her military style boots crushed the feet of Mr Mishra underneath, which wasn't visible because of the crowd, and the opposition leader acting upon his reflex action, pushed her face by his hand to get relief from the excruciating pain on his feet.
3.Now a days, lady officers on duty, request the court to award 10 times heavier punishment to the manhandlers - 1 punishment for manhandling an officer on duty and 9 more punishment because the male fellow ill- treated a lady. Now the Indian law should make it clear that a lady officer on duty is basically an officer without regard to her gender, since in the modern age there is women empowerment and gender equality and they mustn't take gender plea asking the court to mete out severe punishment to the concerned man.
    4. However, if it was badly necessary for her to face the public protest led by the opposition leader, the lady inspector should have come along with her strong and clever staff members to handle the tense situation. And in this case, the police personnel should have given proper respect to the opposition leader who holds the rank of a cabinet minister. They should have urged him and his select assistants to sit in their chamber over a cup of tea ,encouraging them to tell their public grievance. . And not doing this which they should have done ,the police folks have committed an error relating to state protocol.
    5. In one such similar case, the CM of Odisha Mohan Majhi, a fighter himself, blocked the road in Keonjhar, along with other village women with empty water containers to protest water scarcity in that place since,as we know, no officer was doing anything worthwhile to address their problems despite several complaints. At that time, a hero came on the scene to confront the villain, and that hero was a male police inspector; he misbehaved and scolded the MLA Mohan Majhi and detained him in the police station for several hours, never giving him courtesy. Lo and behold! after one month,Mohan Majhi was crowned the CM of Odisha . But he was broad minded enough to pardon the Police inspector who had abused him a month ago.Was it not ,therefore, the courtesy of the lady police inspector and Police department and home ministry as a whole, to ignore the little aberration which was done unintentionally by Mr Mishra? Moreover, , humans don't have control over their reflexes - won't you unknowingly slap a mosquito sucking your blood at night ,when you are fast asleep?
In conclusion, let me present before all of you, sir, an immensely interesting fact . Now the home minister of Odisha is the CM Mohanji himself, and he is supposed to arrest his senior party man, former opposition leader, Mr Mishra, who the SC says did a grievous crime in touching a lady in the face in a dense crowd. Mohanji is great, BJP is praiseworthy, in pardoning the police inspector. And in the same vein ,we suppose, the woman inspector, Nabin Patnaik and the police dept should have been broad minded enough to have ignored the little extravagances of public spirited persons, such as Mishra.
So I would request the honourable CJI sir,to comprehensively consider this people related matter, trail blazing a new path for all Indians.
    Yours truly,
    Prof Nanda kishore Negi.
