  • Human Rights Act 1998 was passed in the UK to incorporate the European Convention on Human Rights in English law.
    Section 6 of the Human Rights Act states that it is unlawful for a public authority to act in a way that is incompatible with the Convention.
    Section 3 of the Act states that where possible, primary legislation and subordinate legislation must be read and given effect in a way which is compatible with the ECHR.
    Under section 4, a declaration of incompatibility can be issued if a statutory provision is incompatible with a Convention right.
