Summer was adopted by Drew Spellman after her real dad (Charlie, I think - he's never seen on the show) couldn't look after her for whatever reason. Drew used to go out with Billy I think and they stayed good friends after they stopped seeing each other. I think it was in 2017, Drew finds Billy again and tells him he's dying and asks if he'll look after Summer when he's gone. I think he wrote it in his will that he wanted Billy to look after Summer, so I believe Billy is her legal guardian.
