  • The judge in the Kyle Rittenhouse murder trial has decided to dismiss another charge against the defendant. Count six of the indictment is for use of a dangerous weapon. The attorneys and judge argued over whether the length of the gun in question would make it a "dangerous weapon" according to criminal statute. The judge determined it did not meet the criteria and dismissed the charge. A charge of being out after curfew had been previously dismissed during the trial.

      They wanted the gun charge so that even if the jury found Rittenhouse not guilty of the murder charges, it would have a fall back position, "well, technically he didn't commit murder, but we still think it was wrong, so we have to convict him of something".

      To be fair, that only ends the possible complaints of the "arm vaporizing" of Gaige Grosskreutz, and that also makes sure he doesn't get the $10M. It does give further credibility to Kyle too, for his proper behavior, but that's about it.

    The M&P 15 has a 16" barrel and overall length is greater than 26". Charge dismissed.

      @Jose Stickman Your missing the point, the prosecution wants to add a charge for an illegal firearm, hence the fire arm is legal to own and carry, and the prosecution knows its legal because it has a 16" barrel and overall length is greater than 26" the prosecution knew this was not a short barreled rifle yet still filed the motion, quite honestly this is getting ridiculous.

    So let us recap the fascists' score card. "He should not have been there". As a free American he had every right to be there. "He brought an illegal weapon over State lines. Demonstrably false on both counts. "He provoked the whole thing". The whole thing had been going on for three days and Kyle repeatedly tried to disengage. " He fired recklessly". All shots were fired at close proximity threats with a much higher hit ratio than any recent police shooting you can name. So at this time the propagandists are batting a flat .000, with no relief in sight.

      Good thing for video evidence. Even though the prosecution tried to have an expert "enhance" (doctor) the footage, the fact that most of these videos were posted to social media so quickly after the event means that the original videos are 100% unaltered and therefore reliable. The original videos don't lie, and that's what everyone is watching from the defence team (thankfully).

    How about the district attorney knew the barrel didn't meet the standard and still tried to prosecute him for a crime he was not breaking. After Rittenhouse sues them for defamation and constitutional violations this district attorney should be investigated by the Bar Association for completely politicizing this case. Using this case to try to make a name for them self and hurt a citizens civil rights and constitutional rights

      1. Charge him with prosecutorial misconduct and house him in prison with some of the people he has sent there.
      2. I have always disagreed with lesser included offenses. The prosecutor should charge the individual with what he can PROVE. If he can't prove or don't charge him.
      Giving lesser included offenses is giving the prosecutor a second chance without a trial.

He came to protect his father's store and to offer aid. The rioters and looters that came to burn the city down and the police not helping left a vacuum and the citizens of this country did what we do, we protect ours and others from Terrorist and that's exactly what those protesters and I used the term protesters loosely were.

      Just shows how dishonest the prosecution has been from the beginning. They knew there was no violation about the rifle, but wanted that charge given to the jury anyway, to manipulate the jury into thinking, "well, he had a bad gun, so he must be guilty".
      Watching this trial, I'm shocked at how it seems impossible for someone to get a fair trial, and be treated fairly in court, if the defendant is considered "an enemy of the state" because Leftist politicians, prosecutors, and news media have smeared and defamed him for his supposed politics.

      @Jose Stickman the ridiculousness of your arguments is glaring! How is an unloaded weapon dangerous? Anything can technically be dangerous depending on how it is used! Hammer, knife, ball bat, car, hot pan of water, stairs, etc etc! It’s not hard to see that lawyers and judges have no common sense and are educated above their intellectual capacities! The laws and legal terminology in this country make it nearly impossible for anyone to receive a fair trial and any idiot can see that! Hopefully the jury, or at least one of them, has enough sense to see it, and the case will end in a unanimous not guilty verdict or a hung jury!

      Any weapon is dangerous, or else it wouldn't be a weapon.
      What I've gotten from watching is that the prosecution was saying the Rittenhouse rifle was somehow especially menacing and illegal because it had a barrel that by law was too short, combined with the total length of the rifle being too short. They provided no proof of such. The one witness they had who mentioned the rifle said it wasn't too short. Yet the prosecution still wanted to send that charged to the jury. The judge offered to have the rifle measured, at which point the prosecution had to concede that the rifle wasn't too short, and the judge rightly dismissed the charge.

      Well, in regards to barrel length the barrel screws into the receiver. Are barrels measured starting at the end of the receiver or is the screwed in part of the barrel included in the length? If so the jury could easily measure the barrel wrong and the prosecution would know this.

      It's not that simple. It comes down to how does one interpret "conformance" to a statute that does not apply to them? The rub is 29.304 which has no provision for individuals 16 and 17 years old. Are those persons "in compliance" or "not in compliance?" If one goes with "not in compliance" then by default no 16 or 17 year old can carry a long gun, even if hunting. It is unlikely the legislature wanted to bar 16 and 17 year olds from hunting while allowing their younger siblings that right. Therefore the best reading is that Kyle IS in compliance with both 29.304 and 29.593 as neither apply to him in his situation. Did the judge see it this way? I don't think he says. It's more than just barrel length.

      The judge had trouble with it and sat on it till the last minute. The prosecution read it like it always had been read.The defense comes up with a screwed up version and the judge rules on it at the last minute and you blame the prosecution? Awfully fishy.

      The craziest part to me about this debacle on this specific charge is that the rifle was purchased from a big box retailer. None of them are selling anyone a short barreled rifle or illegal weapon of any kind. At worst they could have traced the serial, gone to the retailer, pulled the form 4473 they definitely have, and seen it was of a legal length. Maybe even have the store clerk who completed the transfer to testify.
      That it took this long, weeks of trial, to get to the point of them just coming clean about it not being illegally possessed is insane.

    I think the rifle was legal for Kyle due to a basic mathematical measurement . A tape measure will easily dismiss this charge.

      The judge offered the prosecutor the option to either measure it or allow it to be dismissed because it wasn't proven to be a short barreled rifle.
      The prosecution admitted that they knew it was within compliance and not a short barrel so measuring it wasn't necessary.
      The judge dismissed that charge.

They'll charge Rittenhouse for having a short barrel after measuring it and knowing it's legal, yet still argue and try to prosecute Kyle for it anyways.       @Jose Stickman Under Wisconsin Legislature 948.60 Possession of a dangerous weapon by a person under 18 and read the exemptions part 3 section C noting if it's a rifle or shotgun rather than a short barrel you have to violate both provisions not just one and 29.304 you can only violate if you are under 16 years of age regardless of what you are doing. As such Kyle's weapon was legal for him to carry.

      (c) This section applies only to a person under 18 years of age who possesses or is armed with a rifle or a shotgun if the person is in violation of s. 941.28 or is not in compliance with ss. 29.304 and 29.593.

      @Jose Stickman You might want to consider taking your own advice. If the statute is constitutionally invalid rather than just stating due to exemptions listed it doesn't apply to him that would have the same result of it not being enforceable.
      I get you really wish the law was written in a way to lock up this person you feel should be in jail but wishful thinking does not change what the law was at the time of the incident being charged. If laws could be changed on the fly to allow convictions of those the state doesn't like we would have no protection under the law.
      It makes sense that as written the law was not going to pass originally so exemptions that left some restrictions in place for those under 18 like not allowing short barrel riffles but allowed other riffles at 16-17 and below that with additional restrictions. This is part of the life of a bill attempting to become law. They sometimes require compromise in order to pass.

      @@nicholasbarth114 I don't know. But I do know the prosecution made mention in the trial about the skateboard but I think it was the skateboard dude's sister who refused to hand it over. The defense were saying that they wished it was in evidence but it is not because the family refused to hand it over.

    This is a fishing expedition by the prosecution team! Binger just admitted to having a personal conversation with one of the jurors, telling that juror that he/she would be the professional juror in the deciding factor the Faith of Mr. Rittenhouse's future! That's a classic case of tampering with a jury! Binger and the entire Prosecution team were Sworn to uphold the Constitution and Our Laws, unfortunately they're excusing the Actions of the real criminals in order to prosecute a kid who acted in self defense!     As a retired police officer this is very troubling. I would never pursue charges against someone’s liberty or freedom if I could not find elements of an offense to file charges against an individual. I’m not understanding the criminal justice system anymore I guess.

    This prosecution needs to be removed from ever practicing law again! EVER! The statutes are right there in black and white. It is not a maybe it is, maybe it is not. It is NOT a SBR!! Period!! A simple tape measuring event, that even a 2nd grader could do, will prove without a doubt, that this rifle does NOT fall under the guidelines set forth by the ATF on SBR's. This whole fiasco should have been dismissed from the very beginning by the Judge! Clearly self defense all day long!

    I understand the whole rioting stuff and everyone trying to bring attention to the problem with cops getting away with murder, but this was 100% self defense , a lot of people will disagree saying he should have never had an AR next to rioters but imagine what would've happened to him if he didn't have his gun, they would've stomped the kids face in without a doubt , he was scared for his life , got hit in the head with a skate board , kicked in the face with boots on and had a Whole HANDGUN pointed at his head (mind you he had already heard gunshots from another person). The guy with the handgun literally said himself that this kid didn't show any aggression towards anyone , he was asking people if they needed medical attention etc . Do I have to remind everyone that 100% of the people that didn't try harming him didn't get shot. My condolences go out to the families that lost their loved ones and it's a VERY unfortunate situation, but the proof is in the pudding.

      This idea that Kyle would have been killed had he not have a weapon is a logical fallacy. You're totally dismissing that he would have never been a target for violence if he was simply running around with a medic bag to help people. Appearing in a protest against police with an AR-15 on the side of police is provocation by itself. He chose a side and became a target when he could have quietly helped people and put out fires. So, we have no idea what would have happened, but since we're playing a game of assumptions one can assume no one would be dead that night if it wasn't for Kyle Rittenhouse being there that night with a firearm.

      Heroe? More like a punk that the police allowed to patrol the streets with a weapon and kill two people, not even arresting him on site. This after he was caught on audio where he stated he wanted to shoot looters and caught on video helping another punk beat a girl. By the way, after the shooting caught on video having a beer with the Proud Boys while putting up a white supremacist sign. The judge did not permit that evidence in court, but it reflects Kyle's behavior and personality. I worked a career by military heroes; Kyle is a punk that went looking for trouble in another state and killed two people. And yes, he will probably get away with it, and kill again.

    The fat guy really didn't want to admit it. It all comes out in court. This case has shown how the media have covered loads of things up to sway the court of public opinion. That prosecution team should be removed immediately & investigated. I can see a lot of lawsuits stemming from this.

    I have a feeling that they wanted it to go to the jury, even though the length it's a simple fact of measuring the length, because they know that jurors sometimes "bargain" on charges. ie: Well I'll agree to say guilty on this if you say he was guilty on that. It's total BS that that happens, but it does.

      To a non gun person it isn't that simple. The barrel screws into the receiver. Do they measure starting at the end of the receiver or is the screwed in part of the barrel included in the length? Not knowing the jury could measure barrel wrong. Prosecution knows this.

    Letting the jury measure the barrel length. Did I hear that right, that it was even a consideration. A jury is not qualified to measure the length of a barrel, especially because they have no idea where the barrel begins and ends per the legal definition. If they measure it wrong, which they certainly will, the length would appear less than 16". If this was an unmodified, OEM Smith M&P then the very reputable company has already done the measuring, and anything past that is a waste of time.

    Correction: the count was not for use of a dangerous weapon - it was for possession of an dangerous weapon by a minor.
    This was dismissed because there were exemptions listed in the law itself that made it legal.

      1) did he bring the rifle over State lines?
      No, it was already in Wisconsin, as proven in the beginning of the trial.
      2) was the rifle a restricted weapon due to type and size for Kyle's age?
      Apparently, not.
      If Wi. allows minors to possess long rifles and his AR meets the requirements, than it's not illegal.

    I love this judge. He is representing himself with honor.
    He does have bias, and the bias is justice. He is legally eliminating all the non-sense these prosecutors are bringing.     No matter what side you support, it will go down in history. Really a strange series of events, no judgement really of either side. I just feel bad for Kyle for having to have gone through these circumstances. I felt for him when he was crying
