The most difficult time to interpret the law by a court is when politic is involved.
Even though I'm not a lawyer, someone announce that he is an APC member, but he never register with any ward, he doesn't have any membership card or document, he is not known to APC, he has never attended any meeting of APC, then a lawyer says by mere announcement he becomes a member, so if you announce that you are no more a Nigerian, but you are now an American, without any ID card, no passport,etc how can that make you an American.

So you expect the Court to take judicial notice of the plenary session wherein their defection took place? So ridiculous to say by a lawyer! As a matter of fact and common sense, no letter of resignation was transmitted to their wards or state chairman. The provisions of Sec 68(1)(g) of the 1999 Constitution is silent on how defection could take place. But distinctly clear enough, no letter was transmitted to the party, no evidence of procurement that they've truly defected to APC. I suppose that legal argument or Court ruling/ Obiter is logically sound. Newspaper publication or address on the floor of the house doesn't suffice. Neither is affidavit of facts before the Federal high court is not sufficient.
