You keep saying Leilani was voted out of the game, but that's not exactly true. Leilani's case is much different from Hayley. Hayley tribe believed they were voting her out of the game, but then she got a surprise reprieve and was returned to the game. I agree Hayley deserves an asterisk next to her name as a winner. But Leilani was NOT voted out. Her tribe were told before the vote that they were voting to send a player to the other tribe, so they knew Leilani was not being voted out of the game. Now maybe they originally intended to vote her out (the edit isn't totally clear on this) - but the point is that at the time they cast their ballots they knew she was not being voted out of the game.
that was the last trbal council his extra vote was valid, so he had to either play it then or not at all.
