Seems fundamentally unfair that the police can take your property *without a court order,* and after the case against you is dismissed, your property can be *automatically* disposed of, destroyed, etc., without anything more than a routine, pro forma check-the-boxes form filed by the prosecutor, but if you want your property back after the case is resolved in your favor, you don't automatically get it back with the same ease with which the cops took it, but instead you have to jump through a lot of hoops and draft a motion and draft an order and file them with the court and get a judge's permission! 😡
The original law's of this country states unlawful to seize property while under indictment... or in jail.. happens all the time and to get it enforced..? Good luck... and don't forget if the property was sold at auction before your release...gets better and better... don't gave a heart attack 💔...... believe me... I got that rotten t-shirt....

After they release me, they gave me back my belongings, but there is something missing, my wedding band and one set of car keys. I have 2 sets of car keys with a fat remote on it one in pink wrist band and the other one with and flat remote purple band. The one missing is pink band with fat remote and keys. I had a cash, they turn it into cash, I dont think they place the exact amount in the check. I will complain on this coz this is not only happens to me but my coworker , friends , family of my husband. Mine is happen on thurs night on December . 5057 mendoza took and sorted my things, I saw him have 2 sets of keys and wedding band and touch my cash inside the zipper pocket. I cant check anything what he has in the ziplock because he handcuff me. He only check by himself. San jose police department.
