    The 3 meters one also have another cause - if the new foundation is not deeper than the neighbour's, there is no need to serve a party wall notice.

    Thanks for the useful information. Am I correct in saying that I can write and serve a Party Wall notice to my neighbour without involving a surveyor? A surveyor would only be needed in the event of an issue. However, if I don't involve a surveyor from the outset, there will be no report on the condition of both properties. Therefore it is better to involve a surveyor throughout the entire process.

    Very helpful. My neighbour already done extension on his side that joined with his neighbour. I would like to know.. do I need to hire solicitor to send a letter for agreement of party wall to next door neighbour?

    Hi Joe,
    I am curious, I am looking to do a double story extension which my neighbour has agreed for me to carry on with. My only concern is can he use that wall in order to also build a double story extension and in essence making my property and his a terraced house rather than a semi detached which will significantly reduce the value of my property?
    As well as does that also mean he can paint the wall in a colour he wishes or potentially use it to hang plant pots and garden decorations etc?

      Does the new wall sit within your boundary ? If so, your neighbour can’t utilised the wall. If the new wall sit in between both boundaries, then you might want to get party wall agreement in place. Technically speaking your neighbour can build on a boundary wall, subject to serving a valid notice and following the processes set out in The Party Wall Act.

    he has been through all the scenarios except option 3. Your neighbour refuses to sign and have any surveyor whatsoever. What then?
    What if you start work without any signed agreement and its built. what then?

    My neighbour constructed a new two-storey extension, to replace a very old single-storey kitchen, several years ago, but did not seek my approval via a Party Wall Act notice. I have only just recognised the existence of the Act and know that the neighbour aligned the party wall such that the cavity of the new party wall, rather than the outer leaf, runs along the shared boundary. I have approached my neighbour but he refuses to recognise the Act. Do I have any recourse at all, given that the structure was built a number of years ago?

      Hi William. Thanks for watching and the question. The Act protects you against damage caused to your property by your neighbour but doesn't cover boundary disputes. Your situation is very common and is difficult to resolve as it is now a boundary dispute. You could pursue legal action but it will be costly and will probably result in a major dispute with your neighbour.

      @@williamevans9426 You won't be out of time if your neighbour has built on your land as the boundary is the boundary and he is not permitted to build on your land irrespective of how long ago it was done. The problem however is that it will be costly to sort out now. Your best option may be to build something similar on your side. 👍

      Why would anyone allow neighbours to build the outer skin wall of their extension on his land? Do you walk round with your eyes shut?
