The Fourth Amendment protects individuals from unreasonable searches and seizures. Although these protections extend to children, their application in the unique context of public schools has proven difficult. In Board of Education of Independent School District Number 92 of Pottawatomie County versus Earls, the Supreme Court looked at a district’s drug testing policy for students who participated in extracurricular activities.
The Board of Education of Independent School District Number 92 of Pottawatomie County, which we’ll call the district, adopted a policy mandating drug testing of all middle and high school students who participated in extracurricular activities. Students had to submit to random drug testing and agree to be tested upon reasonable suspicion.
Two students who sought to participate in extracurricular activities, Lindsay Earls and Daniel James, sued the district, alleging that the policy violated the Fourth Amendment.
The trial court granted summary judgment for the district, but the Tenth Circuit reversed. The Supreme Court granted cert.
