    How is Twitch streamers playing music on their streams any different than listening to music on the radio? This whole act is severely outdated and needs to be reviewed and updated.

      Because Radio Stations pay for the distribution license.

      @@kristiantorres785 the question then is, how can streamers get that license and why are these companies making that knowledge so hard to access?

      The main legal issue is that you're broadcasting the music to the viewers of the stream without a license. Essentially, you're distributing someone else's work without their permission. When you "buy a song", you're really just buying the license to listen to it. You're not buying a license to distribute it. Another issue arises when you're getting paid from that stream. One could make the argument that the music enhances the stream, and thus you're profiting (at least in part) from someone else's work.

  • @JA-xj8hx
    @JA-xj8hx 3 года назад +32

    If I were to make copyright law I would make it so you can only take the money from the percentage of the video that was copyrighted. I would also make sites check if the copyright is valid by sending the money to a bank of sorts, then review the claim. If the claimer was right the creator's money would then go to the company and if they were wrong then it would go to the creator

    • @JA-xj8hx
      @JA-xj8hx 3 года назад +6

      And I would make it so if a site relies on copyrighted material (torrents and so on) you could bring it to a digital court to be reviewed and taken down if it doesn't comply with the law

    If the DMCA passes the new act of imprisoning streamers for having 5 seconds of a song in their background or having a copyrighted in-game sound affect be played, there will be big problems and most likely chaos.

    I still don’t get it. So you’re telling me artists of music for example, don’t want the free advertisement a streamer or a RUclipsr brings them? How many RUclips videos have you seen where people go and ask “what song is this playing?”. Wouldn’t that help an artist gain some new fans and possibly some new revenue as long as the creator was giving the props to that artist so everyone knows who made that piece of music? It puzzles me, if someone could explain I’d greatly appreciate it.

    • @drabberjewel7108
      @drabberjewel7108 3 года назад +5

      That doesn't really have anything to do with copyright law. In the end, the copyright holder makes the DMCA request, so they don't want the infringement. If an artist wanted their song to be used for exposure purposes, it would be best for the content creator to acquire written consent from the label that owns the copyright. The "wishes" of an artist don't matter in the application of the law. If the artist owns the copyright and there is an infringement, they can choose to file a DMCA request. But artists usually don't hold the copyrights for their song, labels do.

    first of all ... what is a copy? .. well a copy is not the original ..or .. a original copy......fine... ok ...its not the original ... ok then ..... now what is a right? .... well a right... is a accordance with fact, reason, and or truth! .....
    ..and so we put those two words together! COPY RIGHT!....now with this in mind. .. let say i have a copy of a song ... its not the original ..it could be a original copy from the original creator that allowed a company to make original copy to sell by the original owners discretion of course.....as a copy .(now where i got this copy from does not matter really it doesn't .as long as i tell you or anyone that what i have... is a copy ) ...AND i go around saying YES THIS SONG I HAVE IN POSSESSION IS A COPY ...NOT THE ORIGINAL ....A COPY!.... that GOOD!....because that is truth .. nothing to hide there... no point too..... with fact and reason.....now if i go around with this copy of the song in my possession saying .. YES! i am the original creator of this song AND no one else made this song but me! ... well ...there a big problem with that! ..... a very big problem....first of all ..... some one who originally created or was allowed by the original owner to have a company /. label ...make the original copy .... .. will find me ...and say HEY!! YOU ARE NOT THE ORIGINAL CREATOR OF THIS SONG! I AM!!! AND I AM SURE I CAN PROVE IT! ..well one thing.... i can decide to challenge that case... but knowing personally that i am really not the original creator of that song ... im totally screwed...especially if i was selling the copy while claiming its a original copy...... so i will reveal the truth to save my own ....saying no its not the original ....its a copy .. sorry for the inconvenience...then they can say good .. now don't let it happen again ..also the people who i sold the original copy too will either forgive me or say ... hey i want my money back!....yikes ..... now that is what copy right is and how it always should be....oh and you can also tell them if anyone want a quality original copy buy it from the original owner label.....it will always be the best to buy the original copy you will always get such great quality with it... .. anywhere else .. is just a copy...now .. can i play this copy ... of mine .. for everyone else to hear? sure.. why not ??? as long as i don't tell every one .. HEY THIS SONG YOUR HEARING .. ITS MINE I CREATED IT ..then i will be in trouble .. obviously .... why would the original owner of the song .. make a song .. to make sure one one else would hear it ....? especially after its already purchased ? does not make sense at all.... am i wrong?
