I believe and I hope the 28th will be something along the lines of barring representatives and their immediate family members from trading individual stocks for their time in office.
The problem with that is that they'll just find another way around it, and more importantly it'd restrict people for no fault of their own. Like, what if Musk became a representative? Should his daughter who openly hates him and doesn't have a relationship with him have her stocks frozen just because she has his blood? The ideal solution would be more akin to establishing a more clear way to FORCE congressmen to recuse themselves from committees whenever they act on something that could impact their financial investments, coupled with a clear and central publication of their assets similar to the Nancy Pelosi + her husband stock tracker, coupled with harsh penalties (beyond monetary) for any who violate it. Then build in a way out for them - a clear and transparent trust system - so their incentive is to willfully recuse themselves of management of their assets during their service. Basically, make the path that is more fair to those outside the system the most appealing path to them. After all, at that sort of level *stability and safety* is the primary concern. A safe 5% benefit is far more appealing than a risky 20%.
We need to get rid of the 19th amd 26th amendments. Society has absolutely gone down the drain because of those two. Then pass an amendment to ensure laws like 'The Patriot Act' can never be passed again. Followed by an amendment to stop the goverment from improperly classifying drugs to make them illegal. The final amendment I can think of is removing all 'Native American' tribal land and removing any special rights they may have. The fact they operate under different rules and even have special LAW ENFORCEMENT is just insane. They need to assimilate once and for all. Oh! I almost forgot. An amendment should be added that allows citzens to give up certain rights they don't believe in. Anti-Second Amendment? No guns for you. Anti-Free Speech? No free speech for you. Etc etc etc.
January 6th is when the Senate and house get together to certify the election from November, January 20th is the day the new president moves in and takes over. And yes we can have to amendments added but it’s has to be a huge majority between all 3 branches to get one passed.
The two-term precedent was set by George Washington. It wasn't a law, but the thinking was "If Washington voluntarily gave up power after two terms, everyone should give up power after two terms." US Grant and Theodore Roosevelt both tried to go for a third term and failed. FDR went for a third term because A) He was immensely popular and B) It was 1940; the Nazis were sweeping through Europe and voters thought that only FDR had the foreign policy experience to deal with such a threat.
In the United States, it is possible to be tried for the same crime separately in both state and federal courts due to the "dual sovereignty doctrine," which means that state and federal governments are considered separate entities, allowing each to prosecute a crime even if it violates both jurisdictions' laws, without violating the double jeopardy principle.
The 17th Amendment changed us from a federal republic to a populist one and eliminated one of the significant checks and balances that existed from the start. It made the government a three-legged stool where a more solid 4-legged one existed before, and it has been suffering to maintain the weight ever since. It also created the only thing like royalty that exists in the US system of government: the US Senate. In recent years I visited the Constitution Center in Philadelphia. I highly recommend a visit to anyone form anywhere. At the end there's a place to say how you would amend the Constitution if you could. My answer was to repeal the 17th Amendment. Ronald Reagan won *49 states* in his re-election in 1984, and only lost Minnesota (the home of his opponent Walter Mondale) by a few percentage points. He would most surely have been elected to a third term, putting in doubt every president who followed him.
I wish people here understood freedom of speech protects you against criminal prosecution, not public ridicule or censorship by a private business like FB or Twitter.
Public ridicule is absolutely part of free speech. The exception to your second part would be made for collusion between social media and the federal government to censor people which we know has happened.
Even less than that. It protects you from criminal prosecution within public spaces. The first amendment doesn't protect you within any private property, let alone within private businesses like Facebook or Twitter.
The idea of hate speech crimes is quite literally the government prosecuting you for speaking freely, even if it’s awfully racist or hateful. We don’t have these laws yet, but in cali where I live, people want to create them.
The majority of Americans dont know the Amendments, the Constitution or the Bill of Rights...they dont even know that Washington DC is not a State much less where the White House..But they know Taylor Swift
I said the same thing but to be fair they live dropping this knowledge when kids are least likely to soak it up and seems to never come up again unless you pursue the albeit dull subject or choose higher education.
Amendments can be made, but it is difficult. A lot of people argue that nothing gets done in congress, but that’s kind of the point. When it comes to amendments there must be, I believe, a 2/3rds majority in both houses of congress- house and senate. The amendment has to be ratified by the states too. There really haven’t been too many amendments added to the constitution though there have been hundreds presented. The idea is that ideas should be discussed and the best measures placed as amendments, not just changes on a whim or emotion based on current events. There are still issues… people don’t understand you cannot have hate speech here. We have absolute freedom of speech- minus a call to harm or threat of violence. So if I call someone a name or insult Mohammed my consequence my public image, loss of character, or being unliked (hated) by people. There’s no criminal act there. The second amendment is also not understood. The idea is that a well regulated militia, defined as armed population according to the founders writings, was necessary to prevent a tyrannical government. Citizens have the right to defend themselves, and maintain arms to prevent a government that may be corrupted as governments tend to do. They saw a pattern: Free Republic, to Democracy (majority rule), to socialism, to either communism or fascism. Governments don’t tend to last forever. It is also believed that a government, in order to remain good, should be reverent of God. Rant over. I enjoy your reactions!!
You were asking about the transition of power. Yes, general elections involving the President, Vice President, I believe half of the Senators, and the House of Representatives, and some of the state Governors, and other state house offices, takes place every 4 years on the first Tuesday of November. Midterms, like the next one in 2022, take place every other 4 years and give elections for all other elected officials not included in the general election. Like in this election, the President and Vice President are elected and become known as President-elect and Vice President-elect. Before taking over the newly elected leaders will establish and hire their team and inner circle, this is known as the cabinet. This includes a whole host of officials that includes Secretaries of State, Homeland Security, Defense, and many others. What's slightly different about President Trump's is that many of his picks were already in the works before the election, but all president-elects usually do something similar but wait until after the election by using what is referred to as a "transition-team." Then the current President, Vice-President and other cabinet officials will remain in power until January 20th of the following year when the inauguration takes place at the US Capital in Washington, DC. But this is after the election is certified by the current Congress on January 6th. Following the 20th the new leaders go to work and remain until the next presidential election cycle.
Some clarity on a huge misconception about the 2nd Amendment. The 2nd Amendment doesn't actually give you the right to own weapons. That is something that is already recognized as a right Americans have. The 2nd amendment actually states that the right to bear arms cannot be infringed upon by the government; meaning the government cannot make legislation that bans the people from owning and carrying firearms. If you get into semantics, you could say that any regulation at all defies the definition of the word "infringe," and that's where a lot of the arguments come form this topic.
@darrinlindsey Again, it's all semantics. The absence of something saying you can't means that you can by default and the 2nd amendment ensures that the government cannot take that right away.
@@TwistedSisler It's not going to ever happen... But, it can be taken away, by an Amendment repealing the 2nd Amendment. Just like the 21st Amendment cancelled out the 18th Amendment. Also, you should read the majority opinion in Heller v Washington D.C. The Conservative God of SCOTUS, Antonin Scalia wrote that the 2nd Amendment is not unlimited. Which means limits can be put on it, such as the Assault Weapons Ban from 1994-2004. Congress added it's definition of what they were calling Assault Weapons.
We just held 50 elections. One per state. Next each state must certify it's results and list of electors. In December, the true, national election of President will occur when all the electors, or electoral college, meet and cast their vote. In Jan the result is certified by the federal Congress.
You mean that is all you know. 😂😂😂 And your statement is false by the way. Maybe study the 2nd Amendment and understand why it was put in to begin with.
