  • Bodycam footage shows the full incident that led to a criminal conduct investigation into Florida police chief Melanie Bevan. Authorities said former officer Hannah Kalchbrenner filed a complaint against Bevan, alleging the chief improperly detained and searched two people and a home without a warrant on July 14. The Bradenton Police Department released video of the incident after Bevan was cleared of any wrongdoing Monday.

    I'm a bit confused why she invited the cops to go through her house to get to theirs, and then gets worried about them searching around. I'm not letting the cops go through my house to access another house unless somebody died back there!

      I actually wasn’t aware they can’t jump the fence, I thought they were using the “excuse” of the fence in order to get into the front house to search it… learn something new today.

If someone murdered someone in the backyard or it was a serial killer and the only access was through your house or something like okay, I guess that’s different but come on, this was a petty probation thing and then they are in there creeping through their things even after they already had the subject in custody without a warrant so that whole officer safety bs goes right out the window cus they weren’t the subjects of the arrest warrant and without a search warrant they don’t need to be creeping through their thing after the arrest was made.

      The residents allowed them into the residence and never told them to stop searching for the suspect who did live on the property. You do not need a warrant for a search if the residents allow for the search. If anything else is found in plain sight during that search that is on you. The residents were never threatened or coerced into allowing the officers in. So how in your mind was the a civil rights violation?

      @@go06bolts Well, it only applies to the officers who are assigned to the defendant or it is related to the probation. Other law enforcement cannot force them to comply if they are there for anything unrelated to the probation case. A whole dump of info given by my assigned officer. The conditions of my release (and avoid extended jail time and a worse charge), I am to report to my PO once a month for two years and if they suspect I am violating my conditions of release, such as failure to report, they can come to my house and do a search without a warrant. I am not allowed any firearms during my probation period, and not get in trouble with the law for anything. I am, however, allowed to refuse a warrantless search by officers if it is not relating to me and my probation. They know it won't end well for them if they forced their way into my house again without my consent. Only reason I'm not in prison on felony charges is because of that very reason. Tried to pin charges on us that didn't stick. The most I got in trouble for was a messy house...which got CPS involved and thus my probation.

    This is my city. They investigated themselves like always. They have multiple pending lawsuits against the department for excessive force and violations of civil rights. I've been a fan of the channel for a while and never expected it to reach my city. Thank you for the work you do.

    They had an arrest warrant but NOT a search warrant. Once inside if they find illegal items in PLAIN VIEW then they can seize those items and add further charges. What they CAN NOT do is dig through things open, cabinets, draws, move things around to find stuff! And YES good going Blonde ponytail officers for speaking up!

      An arrest warrent is not a search warrant. Claiming plain view after entering what is classified as the personal line,which is the immediate line around the home peeping in windows or the porch is hands off. It's called the curtilage,

      The impression that I got, somewhere in between her comments about their weed, and when she started talking about not having women's sizes in some brand of shorts, just to lead up to her question of "who are these people?":
      These other people are fine with her personality- although, they probably don't care for her much, on the same token. They have to be nice because she doesn't play by the rules. Can't trust that one.
      My more personable impression of her:
      I would want to like her, just because she tries so hard to be liked; but, I would never put faith in her ability to have intelligent and pertinent forethought. She's an obstacle to herself, only to then try to cover her mistakes with loopholes and illusions- which, ultimately makes her impossible to trust.

      My father is literally a prime example of this. My sister has multiple health issues that she has been dealing with since she was 12 and is in and out of the hospital alot. The seizure medication they give her makes her tired and this one night, it was Christmas Eve, she was in the bathroom and "took too long". He busted open the bathroom and she was just on the toilet like "uhh why?" No voices were raised at all. Then like 2mins later, the police were at our door. They said they got a call from a neighbor that they heard shouting which was a lie (I overheard my dad later admit that he was the one who called). The whole time he was saying "I don't know who called them. I wouldn't do that." They arrested her because of an unpaid traffic ticket. She spent Christmas in jail away from her kids and family. It was just awful and unnecessary. My point is that your comment reminded me of my father. That's just one example out of a ton of others, unfortunately. I just feel like if you are "just wanting to protect your daughter or son" or have "good" intentions, then at least be honest. Don't lie about it.

    I’m confused, because at least in my state, when you are out on probation or parole, whichever address you list on your paperwork as your residence, legal or temporary, you are subject to searches of that residence, or your person, at any time or anywhere, without a warrant and without notice. I’m assuming it’s different by state, but that’s the “law “ in Colorado. They can literally show up at your house to do a weapons/drug/ compliance check/search, and if they pull you over, or stop you on the streets, you must comply or they’ll take to jail for probation/parole violation. Crazy.

      Plain view! Anything out in the open is an arrestable offense. The police had a active warrant to arrest, upon finding the suspect, they see drugs, guns or the alike out in the open, they can take into evidence and make an arrest based on plain view. They are not allowed to open door, drawers or look under things.

This is also a probation search, and this was the listed probationers residence, so anywhere in that house that the probationer has access to, can be searched without a warrant, including closed containers, drawers etc...

If I understood your comment about the arrest in this video correctly, despite the guy being handcuffed (therefore incapable of grabbing anything), the officers retained search authority. I recognize the officer's safety was still at risk because of the (presumed) girlfriend who became quite upset about the guy's arrest as well as the woman who had initially allowed the officers into the residence but then began to show agitation after the guy was taken into custody, but I do not believe this allowed them to search. It is my understanding that any search (beyond observing what is already visible) is limited to a specific area and the item(s) they are looking for must be specified prior to the search. So, I would like clarification on what you mean by search, the grounds for the search, and the search limitations. Thank you.

    WHEN SOMEONE IS ON PROBATION THEY ARE WELL AWARE THAT YOU CAN BE SEARCHED AT ANY TIME WITHOUT A WARRANT. They go over all of this with you at your very first meeting with them. Plus whatever address you register with them can also be searched to make sure you aren't in possession of anything prohibited. The only questionable thing I saw here was their guests being searched on their way out.

      The people were illegally detained searched and I'd. The probation officers can search a his location in the apt or house. This means his room only common living spaces are exempt. Line of sight is obviously what you can see. Since he was in the room they can search that area.

    The "In plain view" law comes into play. If they unzip a purse without a warrant, then the contents cannot be used as evidence against the loser.

      There are a lot more legal justifications without plain view. First this was a probationer, and this was his listed residence. Probation can search any where in that residence where he has access, including inside that purse. Next he was a probationer with an absconder warrant, that allows any LE to enter the residence (his listed address) to effect an arrest of him and also search any area of where he was arrested that is in his "grabbable area".

    SMH, Some of yall need to learn law and the dos and donts. The first two guys were probation officers looking for the dude that is on probation, when you are on probation you give up some of your rights one of which is refusal to search your home and since this guy has that as his registered home then thats how they could gain entry without a warrent. Second as for them searching the home and finding the drugs, they are out in the open so they could collect that and pursue charges if they wish, its the same thing if a cop pulls you over and see's drugs on the seat, thats probable cause for them to search a car. There is no wrongdoing here and this channel is just click-baiting.

      I don't understand people saying stuff like that. I get it if you have a bad experience, but everything is recorded nowadays. It's awfully hard for bad actions to not be brought to light once attorneys and lawsuits enter the show.

    By the way these were allegations by an ex officer and the chief was cleared of any wrongdoing by DA’s office and was all legal as the defendant was on probation and the person greeting them at the door allowed such approved entrance to officers.

    Wow, departments are really lowering their standards, I'd hate to see these cops in a use of force incident. This is the reason we are having so many police shootings the past few years, they can't hold their own in a fight, so they resort to shooting them 5 times in the chest. *not an example of

      While I don't necessarily disagree, they shouldn't have to be 'fighting' anyone in the 1st place. If people could simply act like decent human beings, hold themselves accountable for their own choices & get a grasp on their emotions, we wouldn't see a fraction of the crap we do regarding law enforcement in general.
