I think she was just being such a nuisance, getting in their faces, screaming at them, physically blocking them and being generally obstructive that they just needed to get her out of the way. I'm pretty sure police are generally allowed to do that if someone at a potential crime scene is behaving this way. If they are investigating a crime they can indeed survey the immediate area and opening up a trash can to look at the surface contents isn't against the law. But the moment they found those other bags that are implications of additional crimes which now give them authorization to do a full search. (This differs depending on the state you're in)
Not true at all. Searching a home, without permission (and to be fair, the brother in this situation, gave the cops permission), is not legal. Any evidence found from an illegal search will always be thrown out of court if they didn't issue a search warrant, in *every* state. A house is different from a car, which they can search at anytime if they have "probable cause" due to XY and Z. The cops can't search a whole house because they found evidence of a crime found in trash cans (for obvious reasons like someone dumping their illegal items in your trash, which happens all the time, just look up how many dead bodies end up in random trash cans). Outside of a warrant and permission, the only reason cops could enter a property is if they had any evidence or tip that someone at the time was being physically hurt. At least in America...

She was not being protective, she said, "Don't let them search the bathroom". She knew what was going on. They don't have to tell her why her brother's house is being searched, that is none of her business.
To address concerns about the legality of what the cops did: -Obstruction is an arrestable offense and she was absolutely obstructing. Also, the second she said something about the bathroom, and they found the stolen backpack in the bathroom, they also now have reasonable suspicion that she may have also been involved in the crime. -In states where Marijuana is illegal, a police officer can further investigate without a warrant if they smell Marijuana because if they smell it, then they have probable cause. -Police officers can search trash cans and dumpsters outside the residence without a warrant if they have probable cause. In this case they did because the citizen that reported the crime, was able to digitally track the stolen item to this residence. -The officers can count what she said as a threat because she said it followed by "I'll remember your name". Also, like you said, it's the officer's discretion and if he adds that to her charges, she can contest it in court. The judge will also review the footage, so if the judge feels like she wasn't trying to threaten the officer, then it'll get thrown out. Separate note: Just because the body cam is available to the public, doesn't mean there was no wrong doing in that footage. In the US, the public has the right to review all body cam footage. The station with first review it to blur faces or remove audio that contains the private information of a citizen, but no other editing or tampering should be involve with that footage once it's made available to the public. Some do try to tamper with the footage to cover wrongdoing, but that's easily trackable, so if they're investigated by another officer or by IO, then tampering with that footage adds a serious charge to whatever they may have done in the footage. Most cops will just either leave the footage there, thinking that the citizen won't press charges or sue, and others try to cover their cam, turn it off, or cover the receiver to mute the audio. So, it's not really a good indicator of innocence that the public can view the body cam footage. This is also the premise for Audit the Audit's channel because he's reviewing body cam footage to uncover or further explain wrongdoing according to the law.

Signature means she will be released without having to pay anything as long as she goes to all the meetings and trials on time-only if she fails to go will she be forced to pay the bond amount. so hers might be higher but she will likely not pay anything as long as she isnt dumb and miss court. The brother will definitely be out 1000 if they want to get him out of jail.
Most non-violent criminal bonds are low. And all cash bonds only require 10% of the amount for someone to get out of holding cells. So the brother likely only paid $100 to get out of jail. He will have to pay the $900 back to the bond loaning agency obviously (unless he paid in full), but they have really long term loans from what I have heard.
@@victorm.6760the 10% is the bondsman payment. But, the person doesn't get any back. If he paid the full upfront cost to the city, I think they can get it back. The bondsman doesn't get 100%, except maybe if the person fails to show to their appointments.
For the first question about the doccuments: Military members generally keep several documents on them if off the base. They don't hold much information but are still documents. If he works for the government it could have been any number of things but also he could have just been heading home on leave. There are a number of things that could be in that bag and 90% are just papers approving leave. They just still count because getting them reprinted often means you no longer have leave. And yes they make you have physical copies depending on branch.
As far as I know, they would need a search warrant to enter the house. They had probable cause to search the trash, but as far as entering the house, I’m not so sure about that. No one should be arrested for simply showing disrespect to a cop. That’s ridiculous
@@TheReluctantVloggerthe whole part where she is running around screaming like she is off her meds, they are getting a warrant, as they say in the video, because of the smell of weed (which we the viewer will never know if there was or wasn't but given Mario's...well he seems pretty high to me) they go in and do a sweep of other occupants but they dont search the house, however the bag with the airtag is in plain view in the bathroom. The fact she tells mario while she is being put in cuffs to "not let them go in the bathroom" in my personal opinion, makes me believe she is the one thieving. They have a mountain of probable cause though, the air tag location, the other purses/wallets/credit cards in the bins, so they would get the warrant. They even at one point say to mario "we are getting a warrant now, but you can also give us permission to search your house"
There are pretty good reasons for not completely disclosing a case at the time. Stuff like this are small so it doesn’t SEEM like a big deal to say what’s going on, but you’d be surprised how many people give themselves away by talking about simple info that hadn’t been mentioned. They don’t know who is or isn’t involved in a crime, so it’s best to not tell anyone right away. Especially someone who is related to the culprit and says she goes there often (I am not saying this automatically means she’s guilty, I’m just saying you can’t just determine if it’s related or not at the time). People will sometimes slip up and give a detail that you would only know had you been there at the time. It’s usually a small one that they don’t even think much about, so they out themselves without realizing it at first. Edit: im at the part where she talked about not letting them go into the bathroom, and i completely missed that when i watched this in the past. The stolen bags were found in the bathroom. I rest my case
The brother in question acknowledged the odor of marijuana VERY CLEARLY when the officer explained why they had a right to search the premises. Based on his reaction to the officers statement about the smell, they DEFINITELY DID NOT make the allegation up.
No sh*t she got a higher bond! She threatened the officer with "I H0p3 y0ur w!f3 g3+$ r*p3d!" and "I'm g0nn@ r3m3mb3r y0ur name!" Who wouldn't think that she'd send someone on the outside after this officer or his family!
In the US cops can search property without a warrant if there probably cause for suspicion of a crime being committed. In this case the air tag did point to the location and a combination of the smell of pot and the thrown out purses, wallets, credit cards, etc did give them probable cause to search the property.
You need a search warrant or probable cause to search people’s property. Since the air tag is saying the bag is on his property, that gives them probable cause to search. (I think?)
You need probable cause to search a vehicle not a house. Only a search warrant is legal unless cops have seen from outside you have committed a crime in your home and they believe you will get rid of evidence before they can get a warrant (or any violence or kidnapping has been reported. Cops will always break down a door without a warrant for that). For all the cops knew someone could have dumped everything in this guys trash, that clearly weren't out for pickup. Regardless of the airtag, that doesn't justify a search without a warrant.
@@victorm.6760what are you talking about probable cause can definitely apply to a home lmao😭it is usually dismissible in court but it can occur especially in this case where the police had a clear smell of weed and since he had already been found of being in possession of stolen items they could have right to search more of his property
Police can search your property including cars and houses without a warrant if they have reasonable suspicion to do so like drugs or stolen items report which is what happened in this case and they did have the right to arrest this woman for obstructing trying to stop an officer from doing their job is illegal
Technically she was interfering with an ongoing investigation which indeed is a crime. Funny enough if she didnt go ballistic they probably would have let her go on her way.
Thats not how it goes. If you have taken some pills and you have the box of the pills left, you have to throw it in the garbage but if someone sees that box then he is seeing private information about you and thats why he is not allowed to search your garbage.
Depending on the state, trash cans can be screech since it is clear you don’t want it. People will put good furniture near trash bins free for the taking.
The legality of a warrantless search will depend in large part on the location of the trash bin. The U.S. Supreme Court has had to rule on a case where the crux of the matter was a police search of refuse. Ultimately, it ruled that such searches were permissible once someone puts the trash out for pickup.
The protective sister only got arrested because she was obstructing and was being very aggressive. If she had been calm and stayed out of the way she would have been fine.
Saying someone's wife to be sexually assaulted is enough reason for me to bust their ass. Some people can't really shut their mouths when things goes ''hot''.
You don’t need a warrant to search through trash cans first of all and with all those stolen items found in the garbage that is probable cause to search inside the house without a warrant. Sissy is wrong and genuinely made the situation worse.
Old video I know, but just to clarify: Law Enforcement 100% needs a warrant to search a home or private property that they don't own or have permission by the owner to be on. To cite a specific case, a man was arrested due to growing a Marijuana farm in his garage, Law Enforcement used a heat scanner and detected abnormal heat in the garage, upon searching the garage obviously they found the Marijuana, however in court all charge were dropped because they did not property obtain a warrant, so even with finding the contents they suspected, it had to be thrown out because they got the evidence illegally
I remember this. The guy they stole it from had potential classified information in there because he was a soldier or something like that and someone took the bag. Which is why it had a tracker on there from the beginning.
There is literally no reason to be this mad if you know you’ve done nothing wrong. She was upset that they searched the garage can because she knew what was in them

The search of his garbage cans was illegal because it was still on his property NOT the curb which is public property. They needed a search warrant to do that. "Generally speaking, the vast majority of courts have found that when garbage is placed in a location that is accessible to the public, law enforcement is legally permitted to search that garbage." From my understanding, the search of the sister's car was also illegal.
if you want to cover your friend from arrest, the least thing you want to say is “there is nothing in the trash, don’t even check it and there are no stolen wallets! And do not go in his house!
I would do that as a KID when hiding something. Standing in front of the closet doors and when the person wanted to check the closet, I'd be like "Its not in there :)" Very rookie mistake 😂😂
The AirTag and bags in the trash are enough for probable cause to search the house without a warrant. And yes, it is 100% legal for cops to search trash.
With the location of the AirTag being placed around that guy’s house, I’d say they had probable cause to search the trash cans As the cop explained, he wasn’t allowed to perform a thorough search, but because he smelled weed he was allowed to secure the residence in preparation of pursuing a warrant and ensure there was no one else in the residence and in the course of that they discovered the stolen backpack which means it’s fair game, or rather they can arrest him for it.
@morepegasus hear me out. My theory is, The sisters driver (probably bf) was telling police that the brother ("thief") DOES have mental problems, that's why the sister was ordering him around, telling him not to let them in his house while he was just complying and wanted it over and done with. The sister knew exactly where the bag was, in the bathroom, and tried to take command of the whole situation very aggressively because she "frequently visits" her brothers house. My theory is - SHE stole the bag, used her mentally deficient brothers house as a stash and thought she could get away with it, then when an airtag blew that plan out of the water, we get this beautiful demonstration of crisis management.
Yeah it went from difficult to a crime when they ordered her to stay back (as he has to turn his back to go in the house) and she continued to follow him repeatedly. Thats what shw got arrested for not for screaming. She followed him while screaming and repeatedly pushed back against his hand and she obstructed. Also it is legal, once the shit is in the trash it is in a place they can legally search. They do this all the time to catch murderers etc. Go through trash because its considered like i cant think of correct terminology but it is public property or something because you have put it in the cities trash cans. This was all legal. They had probably cause too etc.

@@victorm.6760 you are incorrect my good sir if they have reason to believe that a crime has occurred inside of the residence all they have to do is supply the court with a reasonable explanation for why they needed to search the area.

Not to mention securing the area is a thing.
And if you think I'm incorrect show me the law that says that they can't.
And I'll start digging up all of the laws and regulations that say that they can as long as they have reason to suspect that there is a crime and it is able to be proven in court

In most states trash is considered to be public property when it is placed out for pickup, meaning that they absolutely have the right to just go through it if they see fit
To add to your statement, even in states that searching a trashcan on private property would be considered illegal. They had probable cause to do so since he was being investigated for theft (or really any crime for that matter)
It's not out for pick up on the curbside, it's adjacent to his house
Trash is fair game. You know how they get suspects DNA. Private Investigators follows someone suspected of whatever person has a coffee from Starbucks throws it into any trash anywhere. She was not being protective, she said, "Don't let them search the bathroom". She knew what was going on. They don't have to tell her why her brother's house is being searched, that is none of her business.
To address concerns about the legality of what the cops did:
-Obstruction is an arrestable offense and she was absolutely obstructing.

This just goes to show how much worse it gets when you don't comply with the officers...the girl ended up with a higher bond then the ACTUAL criminal!
No sh*t she got a higher bond! She threatened the officer with "I H0p3 y0ur w!f3 g3+$ r*p3d!" and "I'm g0nn@ r3m3mb3r y0ur name!"

Didn’t the sister say don’t search the bathroom and it was there? she could also have been a criminal.
The digging through her neighbours comment thats so specific she definitely did it
In the US cops can search property without a warrant if there probably cause for suspicion of a crime being committed.
(I think?)
Yeah, and finding other purses in the trash would also be probable cause

If it's in the garbage, it's free real estate.
Thats not how it goes. If you have taken some pills and you have the box of the pills left, you have to throw it in the garbage but if someone sees that box then he is seeing private information about you and thats why he is not allowed to search your garbage.
It’s %100 legal for police to search your trash. You don’t need a warrant for trash either it’s the city’s trash once it’s in the trash
The garbage is fair to search in my opinion. and given his cans were full of wallets and bags.

Depending on the state, trash cans can be screech since it is clear you don’t want it. People will put good furniture near trash bins free for the taking.
I think they were allowed to detain her if they felt threatened. Getting in his face and agressively screaming got her there
The legality of a warrantless search will depend in large part on the location of the trash bin.
The sister is clearly involved. She KNEW about the stolen backpack in the bathroom. That should be probably cause to search her vehicle.
