  • In March, a draft majority opinion from Alito leaked to the public, showing the Court's intention to overturn Roe v. Wade. Let's discuss that opinion, why Roe v. Wade will be overturned, and what will happen in a post-Roe world.

It’s interesting to look at this issue from a legal perspective. Just about everyone has an opinion on this issue, but few actually understand the legal reasoning of why Row v Wade could be overturned.

Thank you guys for providing the purely legal reasoning regarding RvW.

Is it reasonable to assume if Roe were overturned, other laws based on the right to privacy would be overturned? Can you guys do a tiktok/video on that or which laws may be affected?

I’ve never seen the implied right to privacy as the “shaky” foundation of the decision, but instead combining it with the idea of viability of the fetus. Either the right to privacy covers the government not having the authority to even know of the pregnancy or the government always has a vested interest in legislating the situation of the fetus. By trying to have it both ways, the Court put in place the reasoning to overturn its own decision.

So we still have the “right to privacy” via the griswold v conneticut ruling?

If the right to privacy has been the foundation of other cases without issue, why is it seen as so problematic here?

According to their most recent video, it is due to the fact that none of the other cases related to a potential life. Making the right to abortion different compared to the other rights that align with the right to privacy.

The first amendment does say the right to peacefully assemble though? That does mean the right to associate does it not?

One year after Roe vs Wade, women gain the right to apply for a credit card without her husband’s permission due to the “right to privacy law.”

What about when a woman from another state will have access to health care when it comes to abortion and others from other states won't.
    Isn't that unconstitutional?

Same for states and 2A, or castle doctrine.
How come some States has perfectly well rounded castle doctrine and right to bear arms, and shit hole like NYC and the entire state of Commiefornia don’t

@@natehammar7353 Really? The constitution of the US mentions no right to healthcare? That's weird.
But isn't abortion more of a healthcare issue for both the baby and the mother rather than a privacy issue?

    • @LucielStarz123
      @LucielStarz123 2 года назад

@@geha9450 because healthcare is a privilege not a right
Having a “right” to healthcare is the neo-enslavement of medical professionals; you wouldn’t go demand anyone to give you their hard earned skills for free.
There’s no functional constitution with a “right” to healthcare except for failing countries

@@LucielStarz123 And yet owing a gun in the US is? That is absurd.
Btw that is not true only in failing countries(whatever that means for u). Many Eu countries have healthcare as a basic human right. Also the 1948 Universal Declaration of Human Rights mentioned health as part of the right to an adequate standard of living (art. 25). The right to
health was again recognized as a human right in the 1966 International
Covenant on Economic, Social and Cultural Rights.

Wow, what a tragedy. Women who have pre-marital sex and are too irresponsible to use birth control won't be able to murder their baby and will have to endure several months of discomfort. My heart is really bleeding for those women.

If you think having a baby results in several months of “discomfort” please stop reproducing. Having a child is a life long commitment financial, mentally, and emotionally. Also, do you think just non married people want to have abortions??

@@JacobStein1960 anti murder is something most of society is in agreement with. I’m unsure how you think calling women irresponsible and your sarcastic tone has any need in this conversation. You can have your opinion on abortion but don’t judge others for something you know nothing about. Also, you don’t need to post them here on a very impartial representation of the law.
