  • Under disparate impact, the employer does not need to make any conscious decision to discriminate in order to violate the law. The relentless expansion of the ideology at the heart of civil rights law always meant that it would eventually need to be applied to criminal records. Some minority groups commit crimes at a significantly higher rate and therefore have a much higher likelihood of being excluded from employment by a background check.

    Don't think that this is limited to the USA. I work in Ireland, and all five of the graduates hired in 2024 in the IT sector where i work were either black or indian. None of them seem to do any work...

      I've had this exact experience... You'll find more work ethic among some random White guys side hustles or playing in strategic games in their free time, over ten Indian employees hired to do an actual job. Seriously. I have personally received CEO levels of competence and responsiveness from random dudes running small businesses, who should really be in big shot positions at big companies. The amount of anti-White racism in the hiring process is profoundly bad...

    You can also be sued for negligent hiring if you do hire a person with a criminal history that they repeat in your place of business to someone else’s detriment.

      It's called the ASVAB. The military uses this.
      It is an IQ test. Or at least the closest to one we have.

      There's far more to gain that just that - how does $1.7 trilion sound?
      If only the top 10% went to university, like it used to be, instead of the top 50%, then the lower 40% would extend their careers by 4 years, which is about 8% or 9% of their working life. But they would gain that at the end of their career, when they are most highly skilled, so their additional productivity would be greater than 9%. The workforce participation rate is only about 65%, so assuming very few graduates are not working, that lower 40% is about 60% of the workforce. Because of Pareto's law they would not be 60% of GDP, but might be 40% of it, and could easily be 15% more productive if they extended their careers.
      That's a 6% boost to GDP, which is worth $1.7 trillion every year. That's the opportunity cost of expanded education opportunities, but as Auron stated, it is the cost of employers not being allowed to use IQ tests.

    Meritocracy is dangerous as well. Merit should merely be one attribute assessed alongside things like loyalty & character. Otherwise you will eventually hire an individual who will use their own competence against you.

      I wouldn't want to employ anyone who thinks loyalty and character are not part of what merit is. Merit is not just the ability to do the tasks of the job, it's also being able to turn up on time every day and get along with people.

    Can I sue them if I'm injured by a worker since they were negligent for not taking the obvious safety step of criminal background checks?
    By the way, schools have more stringent background checks generally so keep an eye on this. Could be a way to help them abuse more kids.

    I use to work at an Aldi where it became obvious they had 2 conflicting value hierarchies at play. One was the efficiency task master time equals money approach where they'd ride you about speed. I was often confused why the rode me about my performance because I figured if I couldn't meet the requirements then they weren't realistic. The second value hierarchy was diversity and so they'd hire a lot of women. I specifically remember them hiring a 4 foot tall Asian young woman and seeing her try to stock a shelf. It became obvious they had no reason to ever ride me about my performance after that and that they should have been grateful to have me but of course they never showed that gratitude. It was clearly a job where diversity was valued but didn't really matter at the end of the day because it had nothing to do with the job. Why should I work harder and do the heavy lifting when I'm getting paid the same as the women to wipe down counters and sweeping up dust bunnies?

    Even if we all woke up suddenly and started pulling in the same direction it would be too late, certainly too late to fix it through the established channels. I'm not sure what there is left to do at this point beyond fortifying yourself and your family if you have one, and I don't mean an arsenal because lets be real that's more copium than anything, the lone farmer with an AR fighting the gubment is just a meme. And FFS get clear of the cities, well clear of them..

    On hearing this, i could report a mental glitch on the issue -- i forgot about Disparate Impact in favor of another sort of original sin. That feelings of inferiority (e.g., someone's playing with dolls that look like you) are a constitutional evil with the remedy of forced association, and that this formula applies to both gov't & private action. (Jesse Merriam to Tom Woods). Best to feel-inferior yourself first if that's how to succeasfully invade, huh?
    Explains things like the trans cult & "trans-women" in female spaces -- and maybe playing with Barbies. The general principle was probably dressed up aesthetically by replacing "feelings of inferiority" by the "oppression" or even the "literal violence" of whoever lefty seeks to abuse and invade lately. Since that's, e.g. Asians & real women, now, "feelings of inferiority" remains the more accurate justification. (Might match Joyce Benenson's Froendship Rules?)
    But yes, Disparate Impact is hilarious!
