You should be more worried about the crappy thin box tubes that the manufacturers build those trailers with. Guaranteed the axles would fall off of that thing due to rust and fatigue before the hitch bounces off the truck. Heck with the right amount of weight in the front of it you honestly don’t even need to latch the damn thing and it’ll still stay on the truck. Also that toe out condition is probably caused by turning it. If you look the tire on the same axle is toe in.

Maybe put a hitch pin along with a trailer safety handout in an envelope and place it on his wiper. Maybe he'll get the message and start using it.
The real crime here is that Virginia makes you get your trailer inspected. Never heard of that but I live in a much better state a little south.
