    The four Madhabs have never been an issue for nearly 14th centuries. Only in the last fifty years we have some brothers unnecessarily raising this issue. Jazakallah Khair mufti saab

      Only ones getting fingers pointed at them is the hanafis for being glued to a madhab evven when evidences are shown to them. Its not something that has emerged recently.

      These Deobandis don't need Quran and Hadees. Their sheikh -ul-islam says, Mufti Taqi Usmani says in ‘Taqleed Ki Share’e Haisiyyat’:
      For a muqallid, his imam’s fatwa is sufficient. He has no need of looking into Quraan and Sunnah for daleel (evidence). Having said that, if there occurs an issue whereby the muqallid finds a hadith which goes against the ruling and opinion of his imam, its necessary for him to have faith that he has not understood the hadith. If he leaves the ruling of his imam and takes the hadith of the messenger then he will go astray. Taqleed Ki Sharee Haisiyat Urdu copy page 87 - Mufti Taqi Usmani.
      This principle( usool e karkhi) has been laid down by Hanafi jurists about 1100 years ago and the Hanafi jurists / muftis still follow it.

      “The ayah of the Quraan that opposes the statement of our ashaab (ie the Hanafee scholars) should be considered to be figuratively explained or it should be understood to be abrogated. Similarly any ahadeeth that contradicts and opposes the statement of our ashaab it will also be figuratively explained or understood to be abrogated.” (ar-Risaalah Fee Usool al-Hanafiyyah pg.169-170 and also commonly known as Usool Karkhee).

      Wahhabism is aims at the calling (da‘wa) of people to restore the “real” meaning of tawhid (oneness of God or monotheism) and to disregard and deconstruct traditional disciplines and practices that evolved throughout Islamic history such as theology, jurisprudence and the traditions of visiting tombs and shrines of venerated individuals.

    Madhabs are explainers of Islam and they are not contradicting Quran or Sunnah,it’s just that they tried to explain Islam according to what knowledge was available to them, some had extra evidence to back up their understanding some may have less as well as they never went against any genuine evidence of some Hadis and Sunnah.

    Kinda like doing math with PEMDAS. depends on how you use this method..it will give different answers . This is why you can't mix and match the madhabs.. because they have different ways to come to a conclusion

      Shame and Modesty in Hanafi Fiqh.
      'awra' in front of (Muslim) Mahrams (unmarriageable kin)
      The Awra of a woman in front of her Mahram men (those with whom marriage is permanently unlawful), such as the father, brother, son, paternal uncle (father’s brother), maternal uncle (mother’s brother), father in-law, grandson, husband’s son (from another marriage), son in-law, etc consists of the area between the navel and knees, and also the stomach and back.
      Thus, it will be permissible for a woman to expose the following parts of her body in front of Mahram males: head, hair, face, neck, chest, shoulders, hands, forearms, and legs from below the knees. It will not be permissible to expose the stomach, back or any area which is between the navel and knees. (See: al-Fatawa al-Hindiyya, 5/328 & al-Hidaya, 4/461).2/10/2019

      This ruling is based on the verse of the Qur’an in Surah al- Nur:
      “They (believing women) must not display their beauty except to their husbands, their fathers, their husband’s fathers, their sons, their husband’s sons, their brothers, their brother’s sons, their sister’s sons or their women…” (24-31).
      It will also be permissible for a Mahram to touch those parts that are permissible to expose in front of them, provided there is no fear of temptation or desire.
      Imam al-Quduri (Allah have mercy on him) states:
      “There is nothing wrong in touching those parts that are permissible to see” (Mukhtasar al-Quduri).
      However, it should be remembered that if there is a fear of temptation (fitna), then it will be impermissible to expose these parts even in front of Mahrams, neither will it be permissible to see or touch those areas of a Mahrams body. (See: al-Lubab fi Sharh al-Kitab, 3/218).

    I have to say as much as I like Mufti, there is a lot of hair splitting in the discussion. The ‘fifth’ madhhab he talks about is presumably the salafi movement.

      ‘In 90% of the issues, the madhhabs are all the same.’ Agree 100% !! However the rest of the discussion goes on about ‘conflicting methodologies’ and ‘cheating’ and ‘Nats’ etc. Frankly for most educated Muslims, this is complete nonsense. Perhaps the Mufti has forgotten one of the very last ahadith quoted in Muslim and Bukhari, where the Prophet[saw] made it clear not ask him about matters he has left unspoken. Thus matters he has left spoken about, he has clearly spelt out the nass that pertain to ‘amr’ and nahy [ command and prohibition] . The Nass of the Qur’aan is clear and laid out, the Nass of the Sunna has to be proved to be sahih[authentic] because they are the only ones which are legally binding. The Qur’aan insists on certainty in matters of religion. Thus the Hanafi school Invented ‘qiyasis’, deduction by analogy. This is not legally binding on Muslims, it is simply a fiqh technique to bring out a ruling when no Nass exists on a particular issue. Imam Malik based his fiqh on the amal of the people of Madina. His idea was the major companions lived in Madina, so it would be hard to believe in the basics of the deen, I.e. salat, fasting, hajj, umrah, marriage, zakat, divorce, death and inheritance would not be the same as the Prophet[saw] did. So to me personally, there is NO real differences between the madhhabs in the basics of the deen. You only have to look at the Ibadi sect in Oman, they were the first breakaway sect in Islam. Is there anything different they do in the basics of the deen ? I believe one of their scholars was a student of Aisha[rduh]. The second Sheikh goes on about the Sunna of the rightly guided Caliphs. If taken literally, it would make no sense. The Caliphs were all elected to be the head of the Muslim community in 4 different ways, so none of the legal judgments of the four Caliphs is legally binding on Muslims living now. This is just not some bida I have invented, classical scholars were already pointing out issues with fiqh rulings over a 1000 years ago, the most famous being Ibn Hazm. For a real understanding of the problems of fiqh, see the book by Muhammad Asad, ‘This Law of Ours and Other Essays’.

Does the verdict for Mufti sahib need to be updated for hanafi followers based on the recent research by Shaykh Haitham? Or is it still impermissible?

    The Criterion Of The Correct Path.
    Maalik Ibn Anas RadhiAllaahu Anhu narrated, “The Prophet Messenger of Allaah Sallalahu Alayhee Wasallam said, “I am leaving behind 2 things amongst you, as long as you adhere to these two things you will never be misguided, they are the book of Allaah (ie the Quraan) and the Sunnah of the Messenger Sallalahu Alayhee Wasallam) Muwatta Of Imaam Maalik)

    These 2 things are pivotal and act as a criteria for every aspect in Islaam. So People who attempt to guide and lecture the Muslims without reference to the Quraan and Hadeeth are in essence not instructing us in Islaam. Sticking and understanding the Sunnah has great importance in our guidance to the straight path.

      I don't ask anyone to follow me. I am a scientist, engineer and researcher in theoretical physics, theoretical CS and mathematics. And not an Islamic scholar or a Sheikh.
      However, I am a student of Islamic knowledge and Islamic spirituality. My focus is on purifying my heart and nafs (to gain love, closeness, marifah and pleasure of Allah ﷻ) and coming as close to the Sunnah as possible. To become a person of Taqwa and Ihsan.
      That's what I find the scholars and sheikhs I love and respect guide others towards. I have my Sheikh and I try to live as per the teachings he gives based on Shariah and Sunnah.
      You can read about Sheikh Ahmed Sirhindi, especially his maktubat. He emphasised on following not just the external Sunnah but also the internal ones such as having a pure heart (filled with love of Allah ﷻ and not dunya), having nafs e mutamainna (as opposed to nafs e ammara, and other higher spiritual perfections. He is known as he founder of Naqshbandi Mujaddidi path.
      I am sure if you sit in company of the naqshbandi mujaddidi mashayakh you'll see how they have stricter adherence to Shariah and Sunnah than we may have. The Silsila goes back to Hazrat Abu Bakr Siddique (ra) through the chain of mashayakh and from him to the Prophet ﷺ. Many of the mashayakh spend years without commiting a single sin. That's their level of Taqwa.
      While people calling them misguided sin with their eyes, ears, tongue, and so on and so forth.

      All sahaba were mujtahid.All sahaba were followable as ruled by Prophet (PBUH).Besid es s this Shahaba solved and had ijma on many issues like 20 rakat of taraweeh and 1st juma azan etc.Four fiqah evolved organically afterwards.

      This principle( usool e karkhi) has been laid down by Hanafi jurists about 1100 years ago and the Hanafi jurists / muftis still follow it.

      “The ayah of the Quraan that opposes the statement of our ashaab (ie the Hanafee scholars) should be considered to be figuratively explained or it should be understood to be abrogated. Similarly any ahadeeth that contradicts and opposes the statement of our ashaab it will also be figuratively explained or understood to be abrogated.” (ar-Risaalah Fee Usool al-Hanafiyyah pg.169-170 and also commonly known as Usool Karkhee).
