      Seems very harsh. I don’t understand this one. I’d have given him a cup and a burger out of my own money if I witnessed this.

      He's charged with evading arrest after a previous conviction, that's probably why the punishment is so harsh.

      He has a repeat charge of evading arrest. As long as he didn't have priors, the theft would've been a Class C misdemeanor, class B at worst. That's assuming the police even bothered over a cup of soda.

    I've seen this judge give people who have abandoned their kids less time. How is stealing a cup a felony offense? Why is she so mad at him? It is like this one is personal to her or something. This is so weird.

      Read other's comments, it often explains things. Seems the felony was fleeing, 2nd offense, not the cup of water. A case of turning something very minor into a big deal.

      @@Canucklesammich I get it but 131 days for fleeing after stealing a cup with nothing in it? Why even pursue him? Judge didn’t rly take the facts into consideration in this one.
      Meanwhile I’ve seen 30 days and deferred adjudication given to men and women who get arrested with drugs and children in the same vicinity

      It is honestly ridiculously excessive to charge someone with that many days over such a minor crime. Usually things like this happen because the person has prior offenses or may have some kind of restriction such as probation or bond. Regardless it's disproportionate to the offense at issue. During probable cause when judge first learned that he was arrested for stealing water they should have used their discretion to prevent taking 4 months of a man's life for water.

      118 days and $1000 for fleeing the police for the second time. It would not have amounted anywhere near that without that. He realized he was about to get in a spot trouble and started digging his own grave.

      So it's ok to lunge over a counter, steal a cup, get soda, evade arrest when cops arrive, have it stack onto prior convictions of evading arrest, and then you want to give this guy sympathy and blame the judge for his life choices? Good one

      She read the charges & video put it up on screen in the intro. He's charged with evading arrest wth a prior conviction of evading, that's what makes it jail time & felony, not just the "water theft". He asked for a cup of water, not sure why they said they "don't give cups of water", that's ridiculous, but he didn't have to reach over counter & take the cup either. Regardless, that's why they called PD, as silly as just a cup is, in their eyes he still took it. And if he would've just cooperated & not ran from the cops, this would've been such a simpler outcome but instead he now has a felony conviction. Can't imagine it's that difficult to find employment even for minimum wage, unless he possibly has a deeper record, we don't know. Also stated he has some mental health issues so hopefully he receives some of the help he needs...

    Why would they release people at midnight or 1 AM? That's like punishing them further. No public transportation, would be difficult to get a ride.

    He should never have taken the plea deal. The public defender wasn't looking out for him, she just wanted a quick way of closing his case. Especially since they know he has some mental health issues. Would have been more productive if they plead it down to a misdemeanor and restitution combined with community service/job placement assistance.

      He evaded arrest, and that stacked onto a previous evading arrest case which got him 118 days which is quite the deal. But I guess everybody who makes bad choices just has mental health issues that you can blame it on

    I agree with the statement he needs education. He looks confused over alot of what the judge says. Something she said sounds like he already had a previous conviction and was on probation before he did this.

      He said he graduated high school. Not sure if I believe that. Maybe he slipped through without learning. He seems to have a mental disorder. It’s sad.

      He had a previous conviction of evading arrest, so it stacked onto this 2nd charge of evading arrest which got him 118 days. It's really that simple

    Whattaburger was breaking the Texas law, which forbids charging for tapwater in restaurants. Just how did this case get so messed up. If he had filled the cup with water and not soda could he have been charged?

      That's because he gets this time for eluding, not stealing. The penalty is harsher than usual because of a previous conviction he has.

    This has happened when I have been at a takeout. Homeless people want to eat, and they are run off when they ask for a cup to get water. I am more than happy to buy them food and a drink. Some people are just down on their luck because it is so expensive for many to live in California.

    For the people who are calling this judge names because of the felony conviction, please rewatch the video. He was convicted for fleeing (which is not his first time) and has a history of other crimes.
    As someone who studies law and watches a lot of these videos for entertainment and education, I understand how many people will jump to the conclusion that this is all over the old cup of water trick. It’s how it started, but he ballooned it into a much bigger issue. Judges do these lines of questioning to help defendants that are consistently breaking the law to understand really what kind of situations their behavior is getting into. It’s true that the fleeing got him into the most trouble here but all would have been avoided if he just didn’t steal what’s genuinely a negligee amount of money for most working people. (Like she said, get a job [and stop being a bum])
