      China is actually more restrained than Taiwan. Read up the history of what Taiwan’s navy tried to do when the Philippines citizen seized Thitu Island after Taiwan evacuated the island due to a typhoon in 1971. It is also telling that the Filipino seized Thitu island for himself in the name of “Freedomland” and not the Philippines. In fact, when Taiwan protested his occupation of the island, the Filipino government disavowed the actions of their own citizen. The Taiwanese navy went back to Thitu to confiscate his weapons and burn down his buildings on the island. If it were not for the intervention of the Americans who forced Taiwan to back down, things would have probably escalated further.

    As per the 1950 San Francisco Conference and J.F. Dulles understanding clarified in '55, Taiwan is independent, not being a Japanese territory, but not ceded to the PRC or ROC.
    It is time now for Democratic Taiwan to begin to clean up their defunct ROC nine-dash concept that the CCP have appropriated, dis-acknowledge it in support of UNCLOS and clarify any Island claims with Japan and Philippines to build shared governance and economic/security understandings.
    It is time for Taiwan to be proactive re the legal precedents and their legitimate sovereignty.
    The lunacy of the CCP and the KMT concretizing their anachronistic fictions is over-tired and reactionary. The PRC and Putin de-imperializing foreign policy, stopping the genocides, building human rights law is what the world is waiting for.

    - parts of it belong to some ASEAN countries, including Philippines 🇵🇭,
    - the rest of it is the international water,
    - no part of it belongs to China🇨🇳 or Taiwan🇹🇼.

    The dash line claim (the origins of which was from the Taiwanese government and remains part of Taiwan’s claim to this date) was not declared illegal per se by the PCA 2016 decision. It is true the dash line is not based on the provisions in the UNCLOS treaty. That is because the UNCLOS treaty is not about the international law regarding sovereignty. The dash line is a symbolic collective representation of China’s claims. More precise maritime charts with delimitations and boundaries will be drawn and settled according to the provisions of UNCLOs after the sovereignty disputes over the maritime features have been settled.
    Under customary international law, sovereignty is determined by factors like discovery, historical title, effective occupation, official acts, official documents, international treaties, official maps, acquiescence, abandonment etc.
    Geographical location and proximity are often not material considerations when deciding sovereignty disputes. There are many examples of islands and territories that fly a distant sovereign flag from its adjacent neighbours. There are many examples of this: Phú Qúoc Island, South Georgia and the South Sandwich Islands, The Falklands, Gibraltar, Greek Islands in the Eastern Mediterranean off the coast of Turkey, Puerto Rico, The US and British Virgin Islands, Pedra Blanca….. etc.
    The 2008 ICJ case of Pedra Blanca and Middle Rocks illustrates this point. Pedra Branca is a cluster of high tide rocks with a lighthouse built on it; and Middle Rocks are high tide rocks that did not have any man-made structures at the time of litigation. These rocks lie in closer proximity to Malaysia than Singapore; Malaysia even held the historical title to the rocks via the Johor Sultanate. However, after Singapore gained its independence from Malaya in 1965, Singapore continued to occupy, maintain and administer the lighthouse on Pedra Branca for many decades without objection from the Malaysians. Both Singapore and Malaysia consented to submit the sovereignty dispute to the ICJ. The ICJ awarded the sovereignty of Pedra Branca to Singapore while the Middle Rocks were awarded to Malaysia. The legal principles (acquiescence & abandonment) that established the transference of sovereignty/title of Pedra Branca from Malaysia to Singapore had nothing to do with proximity or UNCLOS.

      The 2016 Arbitral Ruling Declared that the China’s 9/0/11-Dash Line Claim to have no legal basis. This Ruling also applies to Taiwan.
      The Philippines has both the historical rights from when the Spratlys and Scarborough Shoal were part of the Philippines under Spain and under the US after cession. The Philippines also has geographic rights under UNCLOS EEZ.

      @ I am an ASEAN citizen and not from China. In fact, I received and liberal western education in the West (hence am able to read Western media misinformation/disinformation and engage in the discussion). As I have pointed out, settling the sovereignty dispute of the Spratlys is going to be complicated as multiple parties (China-Taiwan, Vietnam, Philippines & Malaysia) are involved in the competing sovereignty claims over the Spratly Islands; Indonesia and Brunei are not asserting any sovereignty claims over the Spratlys but have maritime entitlement (EEZ) claims under UNCLOS that might overlap with China’s claim. The current body of international law is poorly developed to resolve this dispute equitably; if we were to follow historic and legal precedents, younger countries like the Philippines and Malaysia would be disadvantaged and China will probably win the case. It is, actually, in the interests of the Philippines, Malaysia and Vietnam to avoid cooperating and submitting the case for arbitration before a truly unbiased tribunal (if one actually exists). The Chinese will also never recognise the Taiwanese claim as a separate or distinct one in court either.

      Japan renounced it’s claims to the Spratlys and Paracels in the San Francisco Peace Treaty. They were never part of the ROC or CCP before WW2. They were therefore not “returned” to China or Taiwan in any Treaty. Taiwan is there illegally.
