    These hearings are absolutely infuriating. Allegations with just hearsay, no proof, no nuttin. These are so bs. I get family courts proof is a lower level in these specific hearings. But hell, the parent can say everything. Just bs.

    It should be if one parent has to drug test they both do.... anybody can say anybody is on drugs and try and use it against them. They both should have to drug test in custody battles..

      This whole case is hearsay including the alleged violence. 20 to 30 times a year, she could have called later. Also she hasn’t been with him for a year since she “found” out about the drugs.

    So far I’m having a problem with this why has the judge not instructed her that this is a Court appearance and why is she carrying children around and dealing with children while she’s in court this should not be happening and second of all that how are they able to conduct this Without the other party, where’s the boyfriend or husband? You can’t sit there and accuse somebody of all these things and the other person cannot defend them self what’s going on?

      They can not and will not force him to show up for a custody hearing. Also, maybe she doesn’t have any other options for the child bc dad is m.i.a.

      If the non-custodial parent doesn't show up then he's in default. Normally they will reschedule it and if they don't show again I mean what can you do? You can't keep putting it off.

    I don't believe her whole story. I believe that she would have called the law if he had hit her. Most of what she is telling the court is hearsay. I just don't believe her. I would make her take a drug test too.

    Did she just say she has been attacked 20-30 times but no police reports? Talk about nonsense. They haven't lived in Texas in years. I bet he didn't even get notice of the hearing. Where would the state have even gotten his address?

      It's really common for victims to not report, especially if there isn't any noticeable injury.

      @tias2705 20-30 times a year? Come on i know you can't believe that. And then when asked initially to described an altercation she starts talking about an incident with the sister but she has been abused 20-30 times a year? It wasn't until the judge asked that she described anything physical with him and that didn't make sense. According to her he through her outside and locked the door but she forced her way back in to be thrown on the ground? How does that make sense. If I am in fear of him why would I be fighting to go back in?

      @Justmy2centsHOU Yes, I can believe an abuser would smack, shove, hit, or push their victim around every other week or so. When someone is accustomed to being hurt by someone over a long period over small mistakes, it can all blend together unless there's something notable like a significant injury, a special occasion, a witness, ect.
      It was my understanding that she tried to force her way back in because one of her children was locked inside a different room with the sister. Is that incorrect?

      ​@@tias2705​that's incorrect. She never stated the kids were present or locked in the room. What's also telling is as she finished describing the may 2023, supposed incident, she actually says this was all the times he laid his hands on me.

      @Justmy2centsHOU Could you link a timestamp the part where she talks about being locked outside and forcing herself back in? I did not find it. The incident I heard was that she was trying to leave because he kicked her out and he threw her to the ground after his sister took her daughter and locked the door. It sounded to me like she was still in the house and the daughter and sister were locked in a bedroom or some other room. She also said her son was one of the witnesses to that specific event. Maybe I missed an event.

    This is absolute nonsense. How can you have a court like this? The father is not able to defend himself or represent himself or have an attorney here I’m not a legal expert, but I know these types of things need to be fair and balanced. The judge is a witness in this. How can he be making rulings?

      They always notify parents of the scheduled hearing but they can't force a parent to actually show up to the hearing. They will often reschedule it once to give the other parent another opportunity to show up but they can't keep rescheduling hearings indefinitely so, yes, this is absolutely legal and happens a lot, regardless of whether for mom or dad. You can't force parents to care but if the opposing parent does choose to engage, then they have the opportunity to file their own motion in order to further discuss allegations and potentially change the order.

    If the father is not present or his attorney, if he has one, how is this legal with the judge now become a witness. They cannot rule on the situation. What is going on here?

      if he is notified of the court date and chooses not to show up and make his case that’s on him…this is a default judgement since nothing is contested
