  • The plaintiff says she hired the defendant to work at the hair salon she owns. She says she was initially impressed by the defendant’s work, but the defendant breached their contract, so she’s suing her. The defendant says she was an up-and-coming stylist, and says the plaintiff turned out to be a manipulative con artist. She’s countersuing for a refund and emotional distress.

    This was a lesson for the young lady. Never sign contracts without fully understanding them. Ask questions. Get someone knowledgeable to look it over with you. Make sure everything is legit and agreeable. Never blindly trust in business.

    She should have gone to a cosmetology school. You learn everything about the business so you don't get played in the end.

      Thats rite..When i was under the apprenticeship n the hair solan (Mind u for a whole year) the Owner Made me do all the work on most clients and n i was coming out with.approx. $20 a day.. And when I approach the Owner..then she would not do the paper work..and so I then had to start over with a cosmotology school..

    She got 45% of the salons clients and she didn't have to bring anything. Not a bad deal. Her problem is not understanding the contract she signed and how the process works.

    I don’t like the way judge Mathis handled this case. That girl can’t send off her own application because she has to prove that she completed her hours under a certified loctitian. The “mentor” literally holds the key to her being certified and I can easily see her not turning in the paperwork for her if they had a falling out. I just hate when JM goes on these tangents. Almost like he’s PMSn or something. Sending positive vibes to baby girl tho. she’s living and she’s learning and I’m wishing many blessings for her.

      man____this girl was a whack ass youngsta who has no clue of how business is run and is the reason we as entrepreneurs can't help these young folks these days. Just because you can do a lil hair doesn't make you entitled to more money and as far as the mailing, Just like the owner said, It would have been to her benefit to get the girl certified because they both would have made more money. As far as the way it "appears that" the judge handled the case, you have to remember that this is an edited clip. He got enough info to make the case/judgements but that footage would have run over the time. they have to make decisions on what to cut out

      Really? I'm not a stylist but in the industry. Once I passed my test to get my license it was my responsibility to send in payment to have the licensed mailed. Now this is different but the point is it's NOT always the responsibility of the owner to do everything for you to get your license there are somethings the person is responsible for on their owner.

    I hate when JM cuts ppl off bc he thinks he’s summed up the situation after 2 mins of testimony. What the defendant was tryin to say was she was being mentored by somebody who DIDNT want to mentor her and it showed thru her actions. I know from firsthand experience how nasty ppl can be in situations or how uncomfortable/awkward it makes things whn dealing w someone who doesn’t really want to deal with or help u. He’s so irritating now 🙄 Always ready to try and check somebody but be dead wrong 😑

    Judge Mathis is such a poor listener at times. He ready had his mind made up that because she is a "mentor" that all of her intentions and practices are good. That 18 yr old young lady is going places. I wish her the best!!

    The contract is pretty standard for alot of salons. I don't think the young lady is ungrateful I just think she doesn't understand how things work. They could have taken 2 more minutes to tell her how she was mistaken but she'll find out over time. She seems ambitious and I wish her well.

      The term apprenticeship and internship were used to describe the beginning of her position plus she doesn’t have a license. The only thing she has any say so over is if the owners deviated from the contract. You are right she just didn’t understand.

    I could tell that the defendant had no chance at having a fair case, when Mathis at the beginning voiced his personal opinion about how the defendant made him feel negatively about internships. From that moment on everything the defendant said no matter how right or respectfully, Mathis already had his negative bias of her being ungrateful as he put it. If I was the defendant I would file an appeal in the state and base it on a biased ruling by a judge.

      She clearly is emotionally irresponsible.
      She signed a contract then blame the owner of stealing?
      She doesn't even know how much she earned OVERALL, like SHE said, so how can she sue for lost earnings??? ( if you are self employed you are REQUIRED to keep track of your earnings, If not don't get mad when you Audited)
      Then she is upset about her certification documents not being mailed by the owner??? Everyone is RESPONSIBLE for their own MAIL, and if you are really serious YOU will mail your own documents and obtain a tracking number OR you will DROP OFF THE DOCUMENTS YOURSELF, PERIOD.
      Sounds like a young sister who is new to the cosmetology industry, its time to grow up, become responsible and not blame people who are assisting you for your OWN downfalls.

    This woman was a crook, the young lady was not ungrateful this is a bad call on judge Mathis, But he seems to be making quite a few bad calls lately. You can see that she was using this young lady and she took more than what she should have taken from her had she was just renting out of booth from her. I hope she don’t let judge Mathis unjust judgment stop her from continuing on her path. Consider this a brought lesson sweetheart and warn as many young Stylist as you can about her.

      @@Nahumtheditman Yes but however, she had the girls information and never mailed it off. She never Disclosed the address of the company (sister locs) to the young girl so She played her. Not sure why JM never asked the woman if she gave the woman the address so she could MAIL her INFORMATION herself... I mean that's why he went off she even said she never had the address that only she had it. So I'm sure she learned her lesson and went to cosmetology school.

      Judge seemed very bias and seemed to favor the plaintiff from the very beginning. The defendant did a very good job with her composure. Especially for being just 18. I believe everything the defendant said.

      @@kingman1330 that is one way to look at it. But coming from the young lady's perspective, if someone doesn't want to teach you, it'll show in their actions. You can receive very poor guidance from someone who is *forced* to help you and that's what she explained. She wasn't ungrateful for the help, but they weren't any help at all 🤷🏿‍♀️

      No she would not have ! Her first mistake is counting someone else money 🤦🏽‍♀️. A salon has what?? Overhead the biggest being rent! Next utilities, advertisements and products this girl paid for NOTHING. She comparing booth rent where you are responsible for everything all you get is a space to use. Why in the world would she give her a stamped envelope if the she was mailing it for her? She was ungrateful and failed to plan or ask enough questions to fully understand. The fact that she went and got a $600 a month car note at 18 tells me her parents didn’t teach her financial literacy

      It was clear that not only did she NOT know how much money was made, it was even more obvious that she wouldn't be able to determine what is 55% of ANY money. He should have asked her, "If you did $1000 worth of work, how much would you get, not counting tips." I guarantee you she would have no idea. His decision was "emotional or rash" (like 99% of the black women comments on this thread, including yours), he clearly saw that you couldn't reason with this girl and that she was ungrateful and unappreciative.

      1: The young lady came in on commission and did Not have to worry about trying to get clients on her own- which would have marketing expenses for the young lady .
      2: The young lady came in and didn't have to purchase products in order to do the salon clients' hair- which would have been an expense to the young lady.
      3: The young lady's Sisterlocks 4 Day Training, which is at least $1495- was also paid by the Salon Owner- which would have been an expense to the young lady.
      4: The young lady received FREE TRAINING from the salon owner's designee- which people charge for mentoring programs.
      5: The Salon Owner offered to mail off the Sisterlocks Certification application package- which was the sole responsibility of the young lady- And yet, the young lady's pkg was incomplete.
      6: The young lady knew ahe had signed a contract and still seemed dumbfounded when Judge Mathis upheld the written contract.
      The Salon Owner was Not Obligated to do the following:
      1: Hire her
      2: Train her
      3: pay for her Sisterlocks training coursework
      4: offer to mail the paperwork for her
      5: explain how or where to mail the paperwork
      6: assist her in her certification process
      7: teach her anything about the sisterlocks process
      See... these self-entitled brats don't know the first thing about gratitude.
      Did she ever once say thank you? Nope. She felt like when she received the training that someone else paid for, she was entitled to the same money as the salon owner... & I have experienced ppl like this in my salon. Furthermore, with the ungrateful attitude that the young lady has, she will only go so far.

    The mentor never denied that the mentee gave her documents. She said everything wasn't there. Meaning she admitted to recieving her materials. The mentee didn't know she didn't have everything. But instead of asking if the mentor returned her paperwork or told to fullfill missing requirements, mathis just accused the mentee like she was ungrateful.
    Even if the mentor isnt responsible for getting her certified, why did the mentor take her paperwork and not return it?
    The mentee looked like she was screwed over.

    I truly believe the testimony of the defendant. I think the plaintiff is a liar and took advantage of this young lady After all, she is only 18. I love JM, but this plaintiff played him. All she had to say was she like to help up and coming young people and give back to the community, and look a certain type of way. She was attractive and she made that statement.. She looked intelligent and acted professional. He let all of that blind him and his judgement. If he had listened, he would have heard heard her say, all the young lady's stuff was not in order. Isn't that what she is there for. Why didn't she kick it back to her and said, this is not done. This is part of what she is promising; If she really mentored and cared and tried to help, that would be her job. Now that you have done everything needed to do, let's make sure your paperwork is in order before sending. When I got my MDA, my trainer made sure all my paperwork was in order before submitting. All the technical stuff was done. Judge Mathis's mind was made up before the defendant spoke. This young lady made that plaintiff heifer money and probably took more than she should have. When she inquired, she didn't like that, and she fired her. Something JM didn't even address. I heard her say it; and the plaintiff just laughed. But above all, JM should have watched the watched the plaintiff's body language. She was guarded. First she had her arms crossed and the rest of the time she had them in her pocket, and rocking from side to side.... That speaks volumes....Maybe those earrings hanging on her shoulder distracted him....I feel he got this one wrong. I pray this young lady becomes successful......and people question this salon before going to it....

    Reading is fundamental, young people (and older people). How is it she signed a contract agreeing to pay the shop owner 55%; then turns around and says, “Oh no, I thought I was getting 55%?! That’s too much to have to pay you!” ? .....Also, it’s best to live within your means. As an apprentice, just starting out, perhaps a lower car note would have been preferable; and she wouldn’t have felt so much (financial) pressure - considering she SIGNED A CONTRACT agreeing to relinquish 55% of her earnings. Smh. She agreed to it, I mean, d@#m!
    And then she complained the shop owner was too controlling; then turns around and relies on the shop owner to be solely responsible for mailing-off her own darn paperwork. She could have googled it and researched it to find out where to send it and did it herself. That’s what I would have done. .....Lesson learned young lady. Smh

It's part of growing up. She signed a contract. Had she have read the contract, she would have understood what was expected of her.     Standard commission is 45%, plaintiff charged 55%, probably because of the work she put in with regards to training. Defendant received training and signed a contract without the terms she actually wanted written down. Internship feels very exploitative in general regardless of industry. Part of professional psych and medical training is that trainees provide expert level evaluation and written reports, receiving what would be considered a poverty wage for a year of training, it's far from ideal, but we get full time training and consultation on our work so that one day we can charge hundreds of dollars for expert level services.

    The owner Doesn’t sound unreasonable. She sounds like she is running a business. All you have to do is work on the head. Dont have to hustle up clients or market yourself. Don’t even have to buy your own supplies. That’s pretty good. The aggravation alone is worth the premium. Plus you got talent but no clients so you needed her like she needed you. I thinks she took this woman’s offer for help with the license like it was no longer her responsibility to license herself. Licensing info is public information. She could have looked it up at any time on her phone. Good luck to her though.

Locs are a lot of work. Those girls deserve more than 45% of what they're bringing in. In my most humble opinion.

    I skipped over the parts when judge Mathis is completely being rude and condescending to the young lady. He’s so hot headed and rude. I think he does that for rating for the show!

    Yeah its official I can't watch judge mathis anymore so bias is sad. This lady robbed her and used her because she was young and didn't fully understand smh karma for her. The defendant will be very successful I believe it a bright future is ahead for her.

    This case was trash. lol He screwed that defendant over. I already knew the plaintiff won the second he started talking about taxes, electricity, etc. lol He looked so impressed, I knew the case was over then. He acts a certain way when he already made up his mind.
    He goes off of emotions and not facts. He also has a problem of not completely listening to what people say. He jumps on people misspeaking and stumbling on their words.
    The defendant never had a chance in this case. She would have won on the People's Court and Judge Judy.

    Let me explain how salons work. You must 1st be CERTIFIED to work in a salon, so without the apprenticeship the young lady would not have been able to work on clients.
    Where I live, weekly booth rent starts off at $200 - this is due regardless if you have clients or not.
    The owner fed her clients to help her get the hours to get certified, while still paying her - the young lady is missing the point.

      Thank you for explaining this. Many ppl commenting don’t seem to understand that this young lady would have never been hired in most salons. Also, I don’t understand why she didn’t mail off her own paperwork. Hopefully this is a lesson learned for her and I know she’ll do well in the future.

      Exactly, and have to provide their own product and personal supplies! I felt like the defendant could’ve worked another job on days off and after hours to supplement her income. My sister is a stylist and it took her years to build up her clientele. Your regulars are your bread and butter!

      In some cases judge Mathis can be obnoxious this was one.i do believe the defendent was being taken advantage of. just because the plaintiff looked good and sounds good doesn't mean she was a trustworthy instructor. I hope this young lady is able to live her passion

    I don’t agree with Judge Mathis on this one! He only jumped at the plaintiff bc she said she “mentors.” How are you mentoring when you’re taking advantage of a person. I pray the defendant is prosperous in her business and doesn’t look back at the plantiff ever again

    What everyone seems to forget is the plaintiff has the overhead of the building rent, electricity, heat, etc. All of that costs money.
    The plaintiff is taking a portion to pay for the overhead…..sounds completely logical to me. She actually made it very easy for the defendant to ramp up her own business.

    I believe the plaintiff used the defendant and took advantage of her, like alot of them do.....that girl is ready to move forward...this is a damn shame....I am glad she told on this lady regarding her taxes...The plantiff is lying about a lot of sh*t and I am surprised that Judge Mathis didn't see that...but if one more person bring her to court, then he will make a greater decision

    As soon as the plaintiff said she was a "mentor", the judge made up his mind about how the ruling would go. Why would the plaintiff have "clips and envelopes" if she wasn't the one to send off the information? Why didn't she refute being accused of tax evasion? Why would the plaintiff let the defendant keep all of her tips? The defendant was naive, true enough. She admitted that. But the plaintiff is a conman who took advantage of the girl because she wasn't certified.

    After reading many of these comments it's obvious that many watched this and became emotionally attached to the plight of the young defendant. However, the judge based his decision on the LAW. The bottom line is the plaintiff's WRITTEN CONTRACT had more credibility than the defendant's FEELINGS.

I do believe that she led you to believe things would be taken care of, but in court if there is no evidence you won't win...I think if you text her or emailed her, you could've won some money...You seem intelligent so you will do well in life.

    I think BOTH of these 2 are shady but the defendant started rattling off what she owes. $700+ rent and over $500 car note at 18? This is the problem with the youth these days, they don't want to start out at the bottom and work their way up. They want top dollar before ever knowing how to do the damn job. THEN, when/if they get top $$ they spend even more. LEAVE minimum wage alone and make these fools learn the hard way, don't spend more than you can afford. If all you can afford at the time is a hooptie then that's what you drive until you earn a higher paying wage.

    When I got a professional license in my state, I couldn't send it myself. My instructor had to send it to the state herself after I complied everything requested. Some things only the instructor had access to. I believe the defendant.

    Judge made the right call on this one. The defendant was being very ungrateful and displayed a sense of entitlement. In this case both of the women benefited from each other as is expected. Helping someone else doesnt mean neglecting your responsibilities. The defendant had zero experience in a professional environment and got over a yrs worth during that apprenticeship. That in itself is priceless. As far as the clerical aspect of recieving a license, regardless of whose responsibility it was to mail off the paperwork, let it be a lesson in life and business for the defendant to always be proactive in dotting all the i's and crossing all the t's and dont leave her future any anyone elses hands i.e. the envelope.
    The judge didnt like the fact that the girl mentioned tax evasion and other illegal things irrelevant to the case that could get the plaintiff in trouble beyond the case. She is willing to mess up that womans entire life because she feels like she shouldve mailed out some forms for her? Forget about all of the blessings she gave her for over a yr (the topic of the lawsuit being one) and just off the strength of her being a young black woman not because theres any blood relation or long history between the two or anything like that. That says alot about the defendants character and the judge wasnt with it. In his opinion when someone displays certain character flaws its very hard to trust their interpretation of an event due to that character flaw. That is why he has litigants give background in the beginning of each case. Its not just to be messy lol
    The judges dismissive and aggressive tactics are a bit much and I disagree with him alot but he was pretty easy on this girl and it was well deserved in my opinion.

      I think he got it wrong with this one because her mentioning the taxes while it’s not relevant to the case at hand, in every case he presides over he listens to facts that aren’t relevant because it leans toward the person’s credibility so why wouldn’t it matter in this case in the woman was evading paying her taxes why would you believe she’s honest in any other situation?! Also she mentioned how she had the envelopes so that must mean she accepted from the girl so if it didn’t get mailed off who’s fault is it at that point? It seems very plausible that if she took this girl under her wing to show her the ropes, that she would also tell her that she’ll help her get her things right and help her get certified and in many instances that could very well include telling her to do x y and z and I’ll send it off but as with many of Judge Mathis’ cases he comes out the gate bias to one side. Even if the judgement was going to turn out the same way he ignored a lot of things that would have had him ruling the other way had this case been another one.

    Nope the judge was exactly correct this young woman has people in her ear telling her she's being used and she needs to be getting all that money.. .NO! that's what an apprenticeship is for, you are learning all the behind the scenes skills that in the long run will get you more clients get you more business and help you not only do hair but actually become a real business woman... Everybody knows somebody that can do hair not everybody is a successful salon owner....she should've sucked it up and finish her apprenticeship

      The average selling price for new cars 37000 if you finance for 72 months at 5% interest that's about $600 per month. To give you a idea of what that is in terms of cars that's a loaded Honda Accord or a base Honda Pilot
