When we sign in for the first time in a banking app it has terms and conditions for how data is collected and in principle we have to tick and agree to it after that we often receive service calls from telemarketing firms accredited by the bank, even though we did not expressly and ezplicily consent to it even if we tell them to stop calling 5hey still do, do I have the right then to complain?
It is highly possible for you to file a case, especially for failing to stop contacting you after you tell them to stop. Next time, you can also tell them to remove you from their contact list; I have personally tried this and they stopped contacting me. For other banks, they will ask if they can stop contacting for 6 months, and then they'll try again. Good luck with your concern! Hello atty. We were at a resort before and there was an incident with our dogs and a child. We were able to tend to the wounds of the kid and left the resort. After a few hours we got a call from the parents. And so we discovered that the hotel disclosed our personal information without our consent. Is this a violation of the DPA or the circumstances of the incident allows the hotel to disclose our information without consent?
It depends on the purpose. If it falls within the permitted criteria for processing personal or sensitive personal information, it may be legal. I cannot guess for the hotel, but if I had to defend them, a possible ground for processing your personal information may be to establish a legal claim (or case).
However, if it is proven that they disclosed your information without justification, they may be liable. Ah I see. My answer is still the same. Check if there is a criteria for processing present, if wala, then may violation ng data privacy act.
As for the study plan, I'll consider your request, but I'll have to think about it very well because iba iba tao, and what worked for me might not necessarily work for others.
Best thing I can say right now is to choose the books you will use in advance and stick to them so you wont waste time picking new ones and starting from scratch. Stick with the familiar, what you've used in the underbar and 4th year review subjects. Because bar review is supposed to be exactly that: review of what you already know.

Atty., May I ask if a Human Resource Officer (HR) in a certain school access an Accomplishment report that I sent to a company where I am a consultant, screen shot them, and send to a school where I am permanent, and the owner used that screen shot information to relieved me from my post as Dean. Is this part of Data Privacy Act? Thank you.
Hello, it will depend on certain factors, such as if there is personal information contained in the Accomplishment Report, and if there was a legitimate purpose to process such Accomplishment Report. If there is personal information but no legitimate purpose, there may have been a violation. Thank you

Hello. The first thing you should do is to ask them to stop committing the violation of your data privacy right/s.
Should they refuse to comply, you may file a complaint before the National Privacy Commission of the Philippines, which accepts complaints via email after filling out a form.

sir ask lang po ako may expiration po ba ang certificate of employment? can someone still present certificate of employment issued 7 years ago (sealed po sya) and pano kung wala na yung company na pinagtrabahuan nya Valid pa din po ba yung certificate of employment na yun?
Hello, kadalasan, ang purpose kasi ng certificate of employment is to certify that you are currently, or have worked at that place. So yun lang ang purpose na magagamit mo siya, na patunayan na at that point in time, nagtrabaho ka doon. Obviously, di mo magagamit yun para patunayan na doon ka PA RIN nagttrabaho, lalo na at sarado na ang opisina na yun.

If yes, then posible na tama naman po ang ginawa nya kasi una, public naman po ang review nyo, and pangalawa, page naman nya po iyon. Ang di lang nya pwede ipost ay kung meron mga personal information na makaka pag-identify sa inyo, pero depende sa mga pangyayari, posibleng may lusot pa ito.

Ang mga na access nila ay kanilang ginamit laban sa akin at sa iba pa na kasama ko sa group chat upang magsampa ng reklamo sa korte na grave threat, unjust vexation, at libel na nadismiss ng korte due to lack of clearance from DOLE. Hello, mukhang mahina po laban nyo, dahil napag-desisyunan na ng Korte Suprema na pwede kumuha ng impormasyon sa Facebook, at may privacy lang kung naka "only me" setting (Vivares v STC GR NO. 202666, 29 Sept 2014).
Kung may kaso na po laban sa inyo, mainam na mag hire po kayo ng abogado para ma-depensahan po kayo ng lubos at maayos.

Hello atty, ask ko lang if saan po magfafall if magsasampa ako ng case sa immigration officer na nag disclosed ng Genuine Temporary Entrant ko for student visa. Unauthorized po kasi yun and sinend sa ibang tao as sample through messanger na nakaPDF file. Nandun po lahat ng details about sa akin such as, name,age,marital status, bank accounts with amounts, land properties, vehicles with plate number, educational background, work experience, business permits, prc license, government ID(SSS, philhealth,employment ID, passport number).
If local immigration officer yan, last na alam ko, sa website ng NPC (National Privacy Commission) pwede ka file ng complaint, di mo need ng lawyer. May directions dun in how to file online. npc.gov.ph

Pero ang nakikita ko maging issue dito ay public document naman din yan dahil yun ang effect ng notarization, na gawing public document ang isang private document. Maganda po na magsampa kayo ng complaint nang makakuha tayo ng linaw mula sa national privacy commission.

Then processing shouldn't be permitted as it is not listed in the law

Nako, hindi ko masigurado ang sagot kasi di ko naman mabasa yan, di naman po ako manghuhula. Mas mabuti po ipa-explain nyo po sa kanila. Pero in general, malamang nakasaad diyan na pumapayag ka na kolektahin nila personal data mo tulad ng pangalan, address, birthday, etc.

As far as I am aware, no cases involving the data privacy act of the Philippines have yet reached the supreme court. The law is relatively new and complaints just haven't had the opportunity to be elevated yet. Eventually, I'm sure a case will reach the Supreme Court

As far as I am aware, Yes; although I am not aware if any cases have been elevated to the Department of Justice or the Court of Appeals or other tribunals, as only Supreme Court decisions are publicly accessible.
