I think Sifuna, you may have not got what Mbadi said. I heard him saying that he sought the advice of the AG, and he was advised to give the counties 50% until the matter is settled by Parliament. He never said that was final.
Nope! Mbadi goofed. Apart from what you have stated he also said that the Govt has no money beyond the Shs 380b per county that has been approved by Natiobal Assembly. He stepped into an area that was actually the dispute between National Assembly and the Senate. Mbadi speaks too much. Hiyo pesa si ya mama yake. Let him wait for the dispute resolution mechanism between Senate and NA to play out fully. In the meantime he can make the "little" payments as advised by AG to keep county govts afloat. The dispute over whether to pay Shs 380b or Shs 400b per county is a big dispute between the two houses. Proposal to pay Shs 400b per county is guided by law. It is a constitutional requirement of paying at least 15%. Proposal by NA that the figure be reduced to Shs 380b per county is guided by "scarcity of funds". That's where Revenue Allocation Act is stuck with a dispute resolution mechanism having kicked off.. Mbadi is smart but he talks too much sometimes.
Nope. Mbadi goofed, and Sifuna is perfectly correct. There are two issues here. Firstly there is the 50% payment advisory as given by the AG to keep counties afloat pending resolution of the dispute between the Senate and NA over whether to pay Shs 400b per County, being the 15% minimum as required by the constitution or pay Shs 380b due to scarcity of funds.
Why should he go? Do you even understand the subject matter at hand? The 2 houses of Parliament are locked in a dispute because Senate wants counties to be paid Shs 400 billion per county in accordance with the Constitution ( at least 15% of the national revenue), while national assembly wants counties to be paid Shs 380b per counties due to cash crunch. Ask your MP and your Senator to be more creative in their useless debates and resolve this matter without delay. Without concurrence if the two Houses Revenue Allocation Act cannot come into being. Mbadi has already sought legal opinion from the AG and some payments are being advanced to county govts pending passing of the Revenue Allocation Act by the two Houses
Nope. Mbadi erred in taking a stand over an issue that is in dispute between National Assembly and the Senate, more so, when the matter is now under scrutiny by a Joint Disputes Resolution Committee. Mbadi is smart but he sometimes talks too much. It is not for CS - Treasury to determine whether he will give more or less money to counties. That issue will be captured in the Revenue Allocation Act.
