First off thats an IS7, not an IS3. Second off, while the driver may be dead, nothing is stopping a different crew member from driving the tank. Third, the IS7 was completely destroyed, while the Maus was damaged. So no, the IS7 didn't win
Technically if the tracks on the maus were destroyed it would be disabled as German tracks were dam complicated and the maus were also one of the heaviest tanks so uh in my opinion it's a nice draw
