I’m pretty sure AA’s in-house legal department had every opportunity to review this filing before it went out. So, either way it shows a lack of care for the victims.
This makes more sense to me. Blaming the victim is typical insurance company behavior. They LOVE collecting the premiums and RARELY if ever paying a claim.
Even if they pay, they cancel you or jack the premiums up on ya, so if you work it out, it’s cheaper to self pay.

It sickens me that an attorney would include such a statement in an attempt to defend a client whether an individual or large corporation. American Airlines didn’t say in what was shown of their statement trying to right an egregious wrong to a child if that entire legal firm was fired, the specific attorney who filed the statement was fired or if AA’s statement was just for the sake of public image. I can't believe those attorneys are blaming a child for a grown adult's crimes. Victim blaming children. How would a child even suspect they would be filmed on an airline.
This reminded me of when I was 11 and went to an art gallery my grandpa's girlfriend owned. There was a camera in the bathroom in the ceiling pointed down towards the one toilet. I didn't notice it until I was already going to the bathroom, and because of how girls and women are treated, I didn't feel safe enough to tell anyone about it. I assumed I wouldn't be believed and would get in trouble. It was the girlfriend who made me feel that way too, not my grandpa but because of people like that girlfriend I wouldn't tell people about many things that happened to me.
If I was treated badly on top of what had already happened, didn't think I could take it so I stayed quiet. I hope those little girls get the right kind of therapy or have the right kind of discussion to nullify that sort of thought process before it gets worse.

This is the fault of the insurance company who retained that attorney, AA doesn’t review court filings like these before they are filed.
The attorney is using the wrong defense. It was never going to work in front of a jury. The proper defense would be to argue that the airline had no way of knowing of the flight attendant’s rogue actions and that he bears 100% of the fault.

The media ALL started using the wording appears/appeared to about a year ago. Or should I say overuse. This wording should only be used if there's any doubt or question about it! In this case there's no maybe about it. They clearly said it was her own fault and negligence. It's not the appearance of blaming her, it's 100%, they used the words "her fault" they tried to shift the blame to her!
I’ve flown on American Airlines several times. Never really had a good experience with the flight crew. They seem to be extremely rude. I had one flight crew push me while I was bent over and said you need to step back while shoving me which knocked me into the old lady behind me, which knocked her down, which knocked her into the man behind her. That was the last time I flew American Airlines and I have flown hundreds of times since then.
