    I've represented myself in court in 15 different actions, and I won 12 of them! It cost me next to nothing and cost the other guy enough to buy a house. I love it! Attorneys want you to believe you can't, or shouldn't, represent yourself in court. One reason they do this is obvious, they don't want the competition and loss of income. The other reason is they want you to believe civil court is some king of mystical palace where the average person will get lost.

      Liars are not clever. They leave a whole sloppy mess of evidence. If ur a poor person they waive all the fees and everything else is self explanatory. Self representation is free and trusted representation with God on ur side

      Deuteronomy 6:12-25
      be careful that you do not forget the Lord , who brought you out of Egypt, out of the land of slavery. Fear the Lord your God, serve him only and take your oaths in his name. Do not follow other gods, the gods of the peoples around you; for the Lord your God, who is among you, is a jealous God and his anger will burn against you, and he will destroy you from the face of the land. Do not put the Lord your God to the test as you did at Massah. Be sure to keep the commands of the Lord your God and the stipulations and decrees he has given you. Do what is right and good in the Lord ’s sight, so that it may go well with you and you may go in and take over the good land the Lord promised on oath to your ancestors, thrusting out all your enemies before you, as the Lord said. In the future, when your son asks you, “What is the meaning of the stipulations, decrees and laws the Lord our God has commanded you?” tell him: “We were slaves of Pharaoh in Egypt, but the Lord brought us out of Egypt with a mighty hand. Before our eyes the Lord sent signs and wonders-great and terrible-on Egypt and Pharaoh and his whole household. But he brought us out from there to bring us in and give us the land he promised on oath to our ancestors. The Lord commanded us to obey all these decrees and to fear the Lord our God, so that we might always prosper and be kept alive, as is the case today. And if we are careful to obey all this law before the Lord our God, as he has commanded us, that will be our righteousness.”

    I can say that I represented myself and I did get abused for not knowing the procedure, but what they didn't expect was my persistence. I lost at trial but on appeal, I convinced the judge to remand the case back to the lower court, where I then won. Defending yourself is absolutely a daunting task, but if you know you are right and you have the fortitude to represent yourself you can absolutely win.

      Good for you my friend. In the four years since I created this video there has been some recognition in various courts that self-represented persons should be treated with respect, and that judges must do more to 'assist' ordinary people who are forced to represent themselves. I'll be re-launching this channel in October 2021 and will be able to devote more time to educating both citizens and the legal profession about the realities of self-representation in the courts. Citizens deserve access to justice, but the system is established and operated to favour members of the legal profession - not to bring justice people deserve. Cheers and keep up the good fight.

      Do any of you people know the difference between common law and admiralty law? Do any of you know the difference between natural rights and civil rights? Has anyone of you done any research to have actual proof to place a FACTUAL opinion vs. listening to people with no facts to back up their opinions that they have been brainwashed with all their lives. I don't believe any of you people can present actual facts in the form of citations written their law books in which their operate from and use against you due to your IGNORANCE evidenced by your unsupported unverified OPINIONS. the courts do not have an American flag which is a flag without a gold fringe with tassels around it. A gold fringed flagcan be found in every courtroom today because they are operating under admiralty maritime law not your common law which is your Bill of Rights as was created from our forefathers and the Declaration of Independence 1776 the unincorporated United States of America hence the states Union will the union of stateswhich is not part of the United States located in the District of Columbia.to make my point clear the United States is located in the District of Columbia it is a federal Corporation and you can read it for yourself under title 28USC 3002 15A.
      To further verify my facts, Google UCC 9 - 307 h. Most Americans are asleep at the wheel. All these courtsa private corporations extorting money out of your people through statutes which are not laws they are penal codes and ordinances violations of their private Corporation and all of us have been categorized as their employees.
      Are you a FEDERAL CORPORATE EMPLOYEE ?
      DO YOU RESIDE IN THE UNITED STATES?
      all of you and most Americans do not know and cannot answer this question correctly due to the ignorance and lack of education in-law only. You shouldknow the correct answer to that question if you have researched the two citations the law codes given above. the constitutional United States of America unincorporated under our Declaration of Independence of 1776 is that unincorporated.
      The United States is a federal Corporation Department of REVENUE. THEY'RE MAKING MONEY OFF OF YOU WHEN THEY HAVE NO JURISDICTION.
      Do any of you people KNOW the difference between an ARTICLE 1 court and an ARTICLE 3 Court?
      Article 1 courts are created by congress with limited jurisdiction to only hear cases THAT DEAL WITH COMMERCE. ARTICLE 3 courts are JUDICIAL, COURTS OF RECORD, Supreme Court's. Supreme Court rulings are LAW of the LAND and super seed over statutes which are not laws because you haven't looked up the definition of what is statutes and statutory law in the law dictionaries., Cornell Law is free online but West's can Law, Black's Law and Bouvier's law dictionaries are what the legal system uses for their manipulated definitions of commonly used words that have been manipulated for their own benefit and fool you with this word trickery into their jurisdiction and their control whether in the courtroom or in the streets(Land).

      Honestly though, he is telling the truth. Pro se is incredibly tough... I've had to research and study and write all day for the last 11 months... it's so exasperating... Sooo many rules, laws and technicalities, forms, motions, filings, trips and calls to the Court, notices, deadlines, proof of services, procedures, favoritism/bias, long lines, parking fees, court fees, waiting on hold, continuances, numerous hearings, it's impossible to learn and do them all... if not for the COVID 19 two month extensions and stay at home order I would never have the time or energy to do or learn it all, nor make the deadlines, ... at all... or especially without going insane... I got new bags under my eyes and my head hurts...as I constantly think and study about my old and new arguments all day and night.. this is a LOT! it's crazy... Luckily everything got extended 2 months... Really think about doing this pro se, seriously. It consumes an incredible amount of your time, energy, intellect, joy, peace of mind, sanity and it still will exhaust your money. I probably could have hired a lawyer with all the time, money and mental exhaustion... but sometimes, you just gotta do it, but be mentally prepared. It's not going to be easy, I don't recommend this to anyone.

    I did much better representing myself in family "court" than I did with an overpriced attorney. How can they call it a court when Child Support falls under the Executive Branch while courts are supposed to fall under the Judicial Branch? In "Family Court" you are also stripped of your constitutional right to Due Process. Family Court is a Kangaroo Court where nothing is done in the best interest of the child, it's all about the money as the child support agency is a cooperation, not a government agency and its sole purpose is to make money to keep all the family court employees employed and keep their corrupt agency funded. Have you ever noticed that in family "Court" most cases are heard by "Commissioners" rather than Judges??? It's all very corrupt. Unfortunately the USA is not the home of the Free that they taught us about in grade school. Your "Rights" are worth the paper they are written on and can be thrown away any time the "courts" wish.

      Are you still in litigation? I tell everybody, to write down the laws and documents to force judgement, which is when the judge has to make a ruling based on what you want even if they don't like you or agree. You could probably research it somewhere, but I like to use www.youwontlose.com because it has every step clearly with the forms and laws for forcing the judge to rule on your behalf in any case. I personally think it's the best one-stop-shop resource for representing self because each law and motion is for tying up the opponent and forcing the court to rule based on the law whether they like it or not.

    I'm in California going thru a divorce. This man has said everything that has happened to me. I originally had a Lawer, charged me $4000. This guy was bad, very poor representation. Heck , I talked more in court more than he did. He left the case while it was still on going. I now represent myself, I also filed a complaint with the state bar against him and opposing counsel. It is a club, the Judge cant stand me, he hates the fact I'm representing myself. He wont allow me to talk in court. Has shut me down dozens of times (will file a complaint against him also) this case has lasted almost 3 years. The Judge even stated "Well, at least your saving money on Attorney fees". The complaints against the Lawyers was denied. I'm going back to court soon, and going to ride it out. I wouldn't advise what I'm doing to anyone else. But am saving money like the Judge said.

      Then when you go before a judge, try at always, be civil don’t interpret while the other party talks, no intervention., wait your time speak slowly and avoid emotions, it is easy folks, lawyers gut money especially on civil rights and injury cases for nothing, research, know the law, have evidence backed with facts on your side, my brother you make it.

      I agree. It's worth the gamble to get them to violate basic rights and hold them under 18 USC 241 and 242. If the court violates the Constitution for profit hold them under 18 USC 1951. Their oath is under 5 USC 3331, 3332, and 3333 and violations punishable under 5 USC 1711. Make an Affidavit of truth Criminal Complaint and send it to the FBI and let a Federal Prosecutor be your lawyer. Few judges will answer jurisdiction questions and in a court of record....BINGO! If the case is a traffic ticket where no damage or injury exists those tickets are considered a Bill of Attainder which is illegal under Article I of the legal Constitution and a fraud. Be sure to include in complaint damages legal Constitutional Dollars as at this time a Federal Reserve Note is worth around 14 legal Silver Dollars.
      The 5th Amendment of the Constitution for the United States of America determines the legitimate grounds for passing through the portals of the courthouse and for using the tax financed court. All processes in Commerce are legislated, judicated (adjudicated), executed, challenged, rebutted, and consummated by the parties in Commerce within the realm of Economics, labor, contracts, surety, credit, liens, distresses and honorable combat by reason-all without the Courts. Only those processes belong in the tax-financed court which will not be resolved without libel, slander, violence, and dueling, human sacrifice through mortal combat, double jeopardy, self destruction, adverse possession or eminent domain.
      The first four Amendments (1-4) of the Bill of Rights keep Commerce on the streets, outside of the courts and out of the public tax coffers. The Fourth Amendment protects the public from a government, which takes from Citizens by bearing false witness.
      The Fifth Amendment is intended to keep the courthouse doors closed against the capricious and unlawful use of public tax money, and, for example, prohibits and outlaws the private use of its facilities by an organized labor union known as the Bar Association.
      The Sixth Amendment provides a method of maintaining the commercial continuity of the nation while at the same time it prevents the government from converting the courthouse into a profitable commercial enterprise, a witch hunting institution, a public slaughterhouse, and a political genocide institution.
      The Eighth Amendment forbids government to terrorize the public to assert government’s will. It demands that the punishment of crimes be proportional to the degree of public offense. It is well known that all governments rule by force, that power corrupts, and that absolute power corrupts absolutely. Therefore the Eighth Amendment is provided and serves to limit the expansion of corruption.
      The Ninth Amendment allows the Citizen to create a remedy by Affidavit.
      The Tenth Amendment empowers the same Citizen to exercise an un-rebutted choice of remedy.

      *t There is no video Phillip. The Constitutional lawyer Stephen Pidgeon et al produced criminal charges vs barack and co in an effort to stop the general election in 2012 as barack is not a natural born citizen and a vast fraud was being perpetrated upon the American public by the Democrat Party. While the original Constitution is short in pages it takes many books defining it. A much bigger fraud was made under the Act of 1871 where a new constitution, the corporate constitution was created by Congress yet never ratified by Convention of States and where the original 1789 Constitution was never dissolved by an Article V Convention of States. Here is that story, presscore.ca/two-constitutions-in-the-united-states-1st-was-illegally-suspended-in-favor-of-a-vatican-crown-corporation-in-1871
      The new constitution is illegal yet still had to exist in harmony with the common law. The new constitution left a loophole to create a remedy to exit any contract (bill of attainder mentioned in Article I of the original Constitution) and the remedy is found in UCC 1-207. 207 was so very effective it was moved to UCC 1-308. Lower courts do not recognize these code remedies, but higher courts do. When a name appears in all capital letters in court and we have to sign on a dotted line always sign "UCC 1-308 WITHOUT PREJUDICE" with your name tus reserving your rights, ALL OF THEM as the new corporate constitution is all about violating our rights and held true to 18 USC 241 and 241. When the courts are used to profit the corporation and rights are violated t may also bring in 18 USC 1951 and combined with 241 and 242 those attempting the extortion are looking at up to 31 years in prison. What the criminal charges against barack et al did was insist on the money fines to be paid in real legal Constitutional Dollars, based on Silver. While a Federal Reserve Note is not Constitutional money it can be made into Constitutional money based on Silver. Today it takes around 14 Federal Reserve Notes to make one Constitutional Dollar, so the fines under 18 USC 241 and 242 can be demanded under Constitutional Dollars taking the fine from $250,000 to $7 million Fed Notes and that fine doubles for the corporation behind the court of color which is hell bent on violating uor rights under this faux constitution. Most all crimes are commercial crimes and tried under the color of law in courts of The simple remedy is to state "I do not consent and waive the benefit" as the Information handed Defendants is actually information within a contract for which you, we will never be allowed to see the finest of print. Since it is against contract law to be harassed and coerced into a contract simply never consent and never understand the "charges" as these charges are actually an illegal bill of attainder and by never understanding the charges the court can't go forward legally. Of course they do in the name of commerce. When they violate our rights make a formal Affidavit of Truth and send it to the FBI whose responsibility is to investigate public corruption and the violation of the citizens rights. I have a massive criminal complaint via Affidavit of Truth in a Grand Jury in Oklahoma this month on the Federal level. I'm currently writing a book on all of this.

I have seen Magistrates ask additional questions if the attorney failed to do so; and I have also seen Judges accept "objections" when they were not timely made because he knew the attorney was inexperienced and was not going to let the experienced attorney take advantage of him. I agree with your advice to a certain degree, you shouldn't take the outcomes of other ppls cases as a guarantee that yours will end in the same way, thinking it hopeless. I would hope doing enough research and knowing your shit pretty thoroughly would be enough to arm yourself with all you need to defend yourself in court. But on the other hand, how realistic is it to sit in on court cases and prepare by doing the "homework" required in order to achieve that end in a criminal court case for instance, where you've been charged with a felony outta left field? You're getting booked, processed and then housed until you go to court. Where's there time for homework in that kinda scenario? I've been to jail more times than I care to admit and, although I did commit some pretty reckless thefts and burglaries, I saw enough court cases in custody that I can assure you 100% that justice is not what the players are after. They're after all that they can get from anyone who sets foot on their field from the public sector. One thing I observed at least a half dozen times, something I found very odd and suspicious, was the courts, judges, DAs, lawyers, tended to show sort of an intentional ignorance, you could say, when it came to child molestation cases, and leniency towards the accused suspects. Too many times. I watched one man in custody next to me, supposedly still innocent as he had not yet been convicted of anything, be scarred and intimidated into taking a plea with shoddy evidence against him for fear of losing and getting worse penalties, and then watch a man accused of a violent molestation case be Treated almost as though he hadn't done anything nearly as heinous, bail granted, or reduced to some petty misdemeanor with a very short leash. And next, what's this? Caught with drug periphernalia and dope? Bail denied, 1st offer 2 yrs with half... then next, found naked with a little girl who was his neighbors child? Bail set at 5k or the fuckers werent even in custody yet, then issued another court date for later down the road. Also seen a man get 3 yrs with half time for beating the shit outta some old man who had sex with his 11 yr old niece. It was rape actually, like his niece testified, but was dropped down to some lude and lascivious act with a child BS, which was hardly even noticed cuz they were too hell bent on demonizing the guy who beat the shit outta the pervert. Call me crazy, but I sensed some favoritism towards sickos.

    These cases are when NOT to represent yourself, I would only do it in criminal cases and I have grown up in the system. I've been in over 20 bar brawls and loads of charges, had a lot of cases related to assaults and weapons, all have been pleaded down to seem like I'm not that bad of a guy, which I'm not, I beat up bullies. Always have, always will. So, remember You have to play to the "club's" hand... I plea down charges to appease their need to win, the thing to realize is they need to keep their jobs, if criminals stop doing crime, they are out of a job. DO NOT FORGET THAT!!! I have heard that from multiple people in the Justice system. In a criminal proceeding the Public Defender is basically railroading you into a substantial charge so that they can all collect a paycheck from your situation, it may seem like a good deal but usually they are just offering you some chicken scratch. The kicker is that if you represent yourself, you have a lot better hand due to this one fact and statement... (and I've threatened DA's with this before) "We can come to a fair conclusion in this matter or... I can drag the trial out as long as possible and demand a retrial for inadequate representation, meaning myself... It is a legal loophole that they will all hate, because it ties up their docket and lowers their clearance numbers and rates and they cannot legally stop you from doing this. You will be granted a Re-Trial." THIS IS YOU LOOSING GRACEFULLY!!! YOU WILL NOT WIN ANY CRIMINAL COURT CASE WITHOUT A HIGH PRICED LAWYER OR TRULY DEDICATED PUBLIC DEFENDER. Remember, in a court of law the testimony of a Peace Officer is entered in as FACT! DO NOT MESS AROUND.

    I have no idea what case(s) you went to court for. However, I went back on a criminal case which if not I would have lost 20 years over a minor drug case when I was in my early twenties. I not only appealed my case twice and won; but also had my entire sentence vacated. I did become a paralegal in College (prison) and since my release 20 plus years ago I have won traffic tickets as well as helped many others. If you are intelligent and have a real desire or must to win you will learn all the court procedures and bylaws. If you can draw up a motion with supporting case-law you have a good shot at a fair shake. I agree they are all in the same club but ALWAYS REMEMBER THE RECORD IS YOUR FRIEND.

    I notice that the commenters below are split between agree and disagree with this man's viewpoint. I think it depends a lot on how corrupt the judiciary is in your local area. Everything he said is true in the Caribbean courts. They don't even follow their own rules half the time. Canada is a lot different. I found the judges there to be quite helpful to self represented parties. I've had the experience of proving my point in court in a civil case for a noise nuisance only to be told by the magistrate that I should refile the action as a private prosecution. Heads you lose, tails you can't win. All the same, I think people who have a good basic education should take the initiative to educate themselves on court procedure and etiquette and try to become independently proficient. If you flunked out of school you are definitely screwed whichever way you go. Time and time again I have found that lawyers put very little time and effort into your case. They get paid whether you win or lose and I think that is a fundamentally massive problem with the system that we have today.
    There are lots of great uploads on RUclips but it does take up a lot of time to absorb it all. The rule books and the statutes are complex and endless. All I can say is if you persevere and you can get in front of an honest judge you do have a chance to succeed.

    • @donaldbest1295
      @donaldbest1295  6 лет назад +1

      Hi Sysprog999 - Everything I said is about the Canadian courts - although it sure applies throughout the USA and the Caribbean too. Ontario, Canada is where a judge convicted me in absentia (while I wasn't in court) of contempt of court in a civil case during a hearing that I was unaware of and hadn't been notified of.
      To obtain my conviction, three lawyers falsely told the judge (in writing and orally) that I had informed them during a phone call that I had received a certain court order. This was false as I had several times during the call denied receiving the court order and asked that it be sent to me.
      When I returned to Canada with voice recordings of the call that showed the lawyers perjured themselves to obtain my conviction, the court refused to allow new evidence in the case. The corrupt judge did this to protect the lawyers who are fellow members of 'the Club'.
      Over 100 lawyers refused to represent me when I returned to Canada because they did not wish to incur the wrath of the legal profession for turning on the corrupt lawyers. I was therefore forced to represent myself before the corrupt judge and the opposing corrupt lawyers.
      You can read my full story at my website: donaldbest.ca/faqs-about-best-v-ranking/
      Cheers and thanks for taking an interest.

      Hi Donald. You got screwed. What they did was "fraud on the court". You should look into the mechanics of an action for fraud on the court. One of the aspects of such an action is that it can be done at any time in any court and by its very nature you would be able to present your evidence. You need a tough honest lawyer who will work on contingency ( no win - no pay) for a percentage cut of the damages you should be getting from those lawyers who screwed you over.

    • @donaldbest1295
      @donaldbest1295  6 лет назад +2

      Hi Sysprog999. Yes, it was a fraud on the courts, and I do have a tough and competent lawyer. So here's how it all played out... I returned to Canada and the corrupt judge refused to consider my 'fresh evidence' - the recordings that prove the lawyers lied about several things that were foundational in my conviction.
      So... the judge threw me in prison for 3 months. When some friends approached defense lawyer Paul Slansky and showed him the evidence, he came on board immediately and had me sprung on bail to appeal.
      But the Court of Appeal would not let me appeal unless I paid several hundred thousand dollars in court costs already assessed against me on the basis of the false evidence. I didn't have that kind of money so I went back to prison to complete my sentence.
      I was not even allowed to cross-examine the lawyers and other witnesses that the courts relied upon to convict and imprison me. I was not allowed to cross-examine the corrupt Ontario Provincial Police officer, Jim Van Allen, who worked illegally for the lawyers as an unlicensed private investigator, and whose ‘expert’ evidence was also used to convict and sentence me.
      To this day, no court has listened to the forensically certified voice recordings of my telephone call with the lawyers that prove the lawyers lied to the court to convict and imprison me.
      That is wholesale corruption where each court and judge tossed out the rule of law to protect the corrupt lawyers and judge who started the series of events.
      My website has the details and the evidence that allows anyone to listen to the voice recordings, examine all the evidence and to judge for themselves.
      Here's a summary:

I appeared 22 times for this trial. Many times the judgeband prosecutor called me aside and offered me a deal. I wouldnt take it. I also didnt wave my right to a speecy trial, something almost every defense attorney will do.

    WHAT he is saying is partially true, however the legal symbol is a two side scale meaning there IS injustice and there IS justice.
    You will ONLY be abused if you don't fight back and learn the law and your constitutional rights. When representing yourself the judge and lawyers assume you are uneducated in law, however once you demonstrate otherwise the tide WILL turn. Furthermore evidence is key so if you can prove bias, misconduct, you have a case to present to the bar association and file a grievance against the opposing parties.

    14. When Justice Rosenberg considered the question of whether the Applicant had sufficient means to appoint counsel, he noted that based on the findings of Nordheimer J. (on the original Rowbotham application), the Applicant was not without means to fund counsel. However, having first concluded that the Applicant had not met the “merits” test to justify the appointment of counsel, this finding was arguably obiter. Additionally, in any event, to the extent that there is an arguable basis to challenge Justice Nordheimer’s dismissal of the Rowbotham application with the benefit of additional materials and/or arguments that Justice Rosenberg did not have at the time of the original s.684 application, it would be circular to rely on that ruling as a basis for concluding that the Applicant has means to retain counsel.
    15. Additionally, whatever the Applicant’s financial circumstances at the time of Justice Nordheimer’s order, he is in no position to fund counsel. In fact, to the extent that the Applicant has any money available to him to fund counsel, but were frozen by the courts and taken away by bad lawyers before the due process and court prove him guilty which could be not used to defend his constitutional rights, the Canadian Charter of Rights and Freedoms.
    It is respectfully submitted that, if the Applicant otherwise satisfies the court that his appeal has merit (including appealing the Rowbotham decision) and that the Applicant requires the benefit of counsel to be able to effectively advance his appeal, the means test has been satisfied.
    (2) Merits of the proposed appeal based on the supplemental record or supplemental arguments not before Rosenberg J.A.
    16. It is respectfully submitted that the Applicant’s appeal against conviction and sentence is not frivolous. Although the appeal will be a difficult one for the Applicant, the following grounds of appeal have some merit1:
    (a) Nordheimer J. erred in refusing to appoint counsel for the Applicant pursuant to his R. v. Rowbotham application;
    (b) The evidence of the Crown forensic accounting “expert” should not have been admitted as he was an investigator as opposed to an “independent”;
    (c) The trial judge erred in finding that this was an appropriate case for a fine in lieu of forfeiture given the purpose of such an Order (ie. to deprive fraudsters of their unlawful personal gain);

    5. The Applicant filed an inmate notice of appeal against his conviction and sentence received by the court on March 1, 2013. He applied for legal aid to fund his appeal but was refused. He has exhausted all appeals from that decision.
    6. On June 12, 2013 the Applicant brought an application before Mr. Justice MacPherson for bail pending appeal. He made submissions without wanting the assistance of duty counsel. Ultimately, Justice MacPherson concluded that, on the basis of the material before the Court at that time, the Applicant had failed to satisfy the Court that his appeal had any merit.
    7. On February 21, 2014, Mr. Justice Rosenberg (having been designated by the Chief Justice) heard the applicant’s application for a direction to review Justice MacPherson’s order of June 12, 2013. Justice Rosenberg considered the Applicant’s application and found that there was no basis to review Justice Macpherson’s finding that the appeal had no merit. He noted at paragraph 2 of his endorsement that “I have reviewed the materials especially those related to the Rowbotham motion and the charge to the jury. I can see no basis for coming to a different conclusion that Nordheimer J. for refusing the Rowbotham motion as set out in his ruling of September 29, 2011. He may have underestimated the sentence the appellant was likely to receive, but in all other respects his reasons justify the order made. The Applicant also sought the appointment of counsel pursuant to s.684(1) of the Criminal Code. The Court rejected the application finding that there was insufficient merit to warrant appointing counsel and that, additionally, based upon the findings by Nordheimer J. the Applicant was “not without means to fund his legal proceedings.”
    8. On April 9, 2014, the Applicant’s appeal was scheduled for hearing on the inmate appeal list in Kingston, Ontario. The Applicant appeared. Duty Counsel also appeared. Duty counsel identified two potential areas of appeal for the Applicant in relation to the expert forensic accounting evidence adduced at trial and a sentence appeal. The Applicant submitted that there were additional materials relevant to the Rowbotham application that should also be produced so that he could revisit the s.684 application and because it was relevant to an appeal of the Rowbotham application. The Court ordered the Crown to produce further materials and asked duty counsel to review the material and, also, to assist the Applicant in revisiting the s.684 application if the circumstances warranted. With that direction, duty counsel offers the following analysis.

    There is no court of justice, son; only a court of 'law'. Need to appear by 'special visitation' as your ALL CAPS name is a Cestui Que Vie Trust straw man. A natural, living sentiment man is NOT your name in ALL CAPS. Implied concent is where they get you. Always say out loud "I do not understand (stand under their statute) and I do not concent'.

    Sir you should not tell people not to represent themselves in court. If we do not stand up to those criminals then nothing will change.people can do whatever they set their mind to..I DO NOT LOOSE IN COURT BECAUSE I KNOW THE LAWS..I HAVE NEVER LOST IN COURT AND DONT PLAN too.
    People need to do this more.fight for our rights do not roll over .being negative only makes people dout. Themselves.and that's not cool..encourage and build up not DOWN YOU CAN ROCK IN COURT. BECAUSE if you do not try to make a change it won't happen.its easy to win in court! They work for me...

      Hi Sue. I understand your perspective, and as I make clear in the video - sometimes you can't walk away and are forced to represent yourself. You can't afford a lawyer, or (as in my case) none have the courage or integrity to take your case, but the stakes are so high that you must pro se.
      In 2022 in urban US and Canadian family and civil courts, as high as 80% of the citizens are forced to represent themselves. Yet only 3% to 5% of self-reps win in civil court. That's not a justice system - that's a profitable law-union protected business.
      My caution to all remains though... self-representing yourself in court is far more difficult and dangerous than most people know. Only after they get into the system do they realize that the process is used as punishment, and that the justice systems are so heavily weighted against self-reps.
      As George Carlin used to say.... "It's a club, and you ain't in it!"

      Are you telling me to roll over and pay or not to listen to this guy I'm confused.. if you know how to hold them accountable that mean you've learned a game and you should have went to law school to be one of them you took your life in time to prove a point when you could have paid someone who went to school for that that's all he said you should walk away if you not part or pay for part of the crew to represent you

    I only had to represent myself in court once. It was over a minor plate violation so it wasn't that serious. I was easily able to prove was my local DMV's error.
    Let's back up a bit. I learned the hard way that my renewal tag didn't match my plates during a traffic stop. After getting a citation over my plates & giving myself a night to cool off ( I was reasonably angry) I went to my local DMV & asked a lot of questions. Turns out because my sister had me co-sign for her loan, my name was on her title. I found out we both owned cars from the same manufacturer & year so when they sold me my tags the clerk accidentally clicked on the wrong vehicle as they both show up next to each other in there system looking identical. Turns out it was an honest mistake on there part. I had to pay again to get the tags fixed (probably should of pushed for a refund on the bad tags if that was even an option. At least I was able to settle that with my sister when I told her what happened)
    I wasn't certain what my legal options where so I got the advice of a lawyer. They told me that I was best representing myself as it was a minor citation & his fees greatly exceeded the amount of the fine.
    As I could prove these facts with bank records because I had written checks for both transactions (that they oddly didn't even care to look at) I managed to get the fine reduced ( I only saved $15 off a $115 fine so I didn't save much).
    I keep thinking that if it wasn't the government that screwed up & instead a store I'd have better options. The store I work for offers refunds on bad products & there are laws agents entrapment & extortion that are supposed to protect consumers from these kinds of issues. However, I learned that if the organization is the government they get to play by different rules then the rest of us. I considered suing my local DMV for damages but after speaking to a lawyer it appeared to be not worth the effort. I'd likely be paying $500 in fees just to get a $100 settlement (my fine amount) at best. Also if I'm paying court costs, is the government really getting punished if I am going after government? The whole mess feels a lot like extortion to me.
    It may not be enough to satisfy me but I decided to never set foot in that specific DMV ever again as I feel a need to hold them accountable somehow. I have also noticed that I now hold a more negative view of my local government after this experience & it has had an effect on how I vote on local issues. Recently, I voted to deny the police tax $ to build a new facility they wanted. I figure if they want to build that, they can use the $100 I already gave them on that. I don't care if it's not enough.

    The law is simple, it is statutes, rules, procedures that make it difficult. None of these are law. The law is the constitution and the sheriff is the highest constitutional officer in the land who works for the people and is elected by the people. The sheriffs office also has a duty to act when presented with unconditional issues. Use the constitution and trust law I feel is the way to go. Finally, pay very close attention to the state BAR rules of scope of practice. BAR attorneys are bound and limited by these in your state. I’m not an attorney, I do not practice law, seek an attorney for legal (and not necessarily lawful) advice.

    Just yesterday I self-represented again as a Defendant in Family Court. The last few experiences of how the Judge treated me during proceedings, ignored my evidence, assumed that I was dishonest in all my sworn testimony, was crushing to me as a person. How court this "moral authority" conclude that I was a bad actor, let alone render extremely unfair decisions that cost me almost everything financially and in the relationship with my children.
    Yesterday, I thought I had improved in every single way. I was confident the Judge would not even hear the matter as it defied all the evidence, which was documentary, and the law was crystal clear. But it happened again.
    Opposing counsel was allowed to make wild accusations and misrepresent facts and yet the Judge only interrupted her to ask her about how much she was seeking in costs and whether she thought she was entitled to double costs.
    In contrast, I was interrupted by the Judge every few sentences and challenged. I quoted Opposing counsel a few times and each time the Judge came to her defense claiming that the lawyer didn't actually say that, and offered excuses for the lawyer. When I stated that I was seeking costs the Judge flat out stated that I was not entitled to costs as I didn't incur legal fees.
    The matter will be ruled on next week but I went in convinced that the matter would not even need to be heard, and left thinking that I'm going to lose with double costs charged to me.

      A recent study concluded that many trial lawyers as well as business lawyers suffer from psychopathic personality disorder. Most of the judges I have dealt with in my life fit the bill for psychopathy. Don't take it personally. They really have no higher feelings or conscience.
