Did M3M sold any single unit to customers, No. The brokers facilitated the deals. They sold illegal 50% Frozen units from day 1. There were total 3720 units in 53 acres, half of them were frozen i.e 1860 units. These 1860 units were sold by thousands of corrupt Brokers. Due to policy change, frozen units were reduced from 50% to 10%. 40 % frozen units buyers were lucky to get bba done and 10% stuck. Blaming only builder, or 10:90 plan is not sufficient. Brokers who sold these 50% frozen units should be named in FIR. Buyers need to do own due diligence. The frozen unit plots details were available from day 1 on HRERA website but buyers say they do not even know what is a frozen unit. So whose fault is this, who is suffering...not builder not broker but buyers.....
M3M already sold these 300 units to other buyers. The main point is that they have sold these units via these brokers only. Now when the dispute has been raised by original buyers, M3M denied giving brokerage to these brokers. And now all brokers are making this as hype. Otherwise the local broker does not have any backbone or reputation to lose. They just look for their short term gain and run away. This time even brokers are cheated by M3M and faced loss so making all this hype.
Builder pays brokerage for any unit once atleast 30% payment is received from customer. Here the units were illegal as they were frozen. Now with 10% or 5% or less payment, brokers were not supposed to get any brokerage. What brokers didn't tell is they got brokerage for 40% frozen units which were converted to unfrozen due to policy change. After customers paid 30%, brokers got their high brokerage. For 10% unit still frozen, they started blaming 10:90 plan as they wnat to promote other plans where customers pays atleats 30% and their brokerage is not delayed even for a single unit. Brokers are still playing thier game....
Brokers aren't going anywhere specially in India where there is high complexity in real estate and there are always preferred rates given by builders to their channel partners. In this case people are equally responsible for their plight since they trusted the builder blindly and were still not alerted even after soft signals such as no BBA, delayed confirmation etc. Litigation in India is never the best recourse and RERA as an authority is toothless. This will just become a lesson for future buyers to be vary of such early buying without proper documentary confirmation.
It's not only M3M, ILD Millenium is also cancelling units even after 10 years of booking and with 0% construction till date, and none of authority TCP or HRERA is helping buyers. Builder *ILD Millenium / Emperium Infrastructure* for project *Emperium PREMIO and Grand Centra* in sec 37C and D have done the same flat booked in 2014 now they have cancelled the unit in 2024. 10 year mai 0% construction by ILD and now project sold to Emperium, Emperium is now making false promises in terms of utilities and feature, which they can not make as not approved in the plan
@Sakshamm07 10:90 plan was never a issue in Smartworld or M3M even....majority of units in sec 89 project were sold by 10:90 plan and tehy were sanctioned loans by bank..... The issue is Frozen units vs unfrozen.
Prashant ji, builder took the rera in two phases. They got the license of 1st phase only and sold all the units using the rera of 1st phase only. It was never told that there would be a second phase as well. Builder has hired expert legal team and MBA students from top universities for doing this scam. They have done this scam very smartly.

Buyers should not have kept silence for 03 years and alarm bells should have rung immediately when RERA was not coming

BBA doesn't restrict buyer to approach RERA. The law is slightly different wrt your views.
