    Happening In Court:
OH v. Dr. William Husel Trial Day 13 -
Arguments Outside Presence Of The Jury
Jacob Deemer - Former Mt. Carmel Nurse
    Lunch
Jamie Bourke - Former Mt. Carmel Nurse
Mark Dellinger - Mt. Carmel Physician
Jamie Bourke - Former Mt. Carmel Nurse
An Ohio doctor was charged with 25 counts of murder on Wednesday for allegedly prescribing lethal doses of fentanyl to dying patients. Franklin County Prosecutor Ron O’Brien said that he has never seen a 25-count murder indictment in his career, adding that the doses Dr. William Husel allegedly ordered in the 25 deaths “could not support any legitimate medical purpose.”
Husel, 43, was a doctor for the Mount Carmel Health System; he was fired at the end of 2018 after an internal investigation found wrongdoing.
Husel faces a potential sentence of 15 years to life in prison for each count - if convicted.
Husel’s lawyer Richard Blake claimed that, actually, “this is not a murder case.”
“I can assure you there was never any attempt to euthanize anyone by Dr. Husel. At no time did he ever have the intent to euthanize anyone,” he said.
Mount Carmel Health System, for its part, has said in a statement that it “will continue to implement meaningful changes throughout our system to ensure events like these never happen again.”
The Columbus-based healthcare system also fired 20 other employees after an internal investigation found that patients received exorbitant amounts of Fentanyl. Even though nurses doled out-and pharmacists filled-Husel’s prescriptions, the focus of the criminal investigation remains on Husel, according to prosecutors.
Mount Carmel President and CEO Ed Lamb said at the time of the investigation’s conclusion that “regardless of the reason the actions were taken, we take responsibility for the fact that the processes in place were not sufficient to prevent these actions from happening.” He added, “we’re doing everything to understand how this happened and what we need to do to ensure that it never happens again.”
The State Medical Board of Ohio suspended Husel’s license in January because the doctor failed “to meet acceptable standards regarding the selection of drugs, violations of the minimal standards of care and failing to cooperate in a board’s investigation,” the board said.
Mount Carmel has settled at least five wrongful death suits since it fired Husel. Two of the suits that were settled involved deaths of 73-year-old women. Sherry White died in 2014 after receiving two, 100-microgram doses of fentanyl within 16 minutes of each other, the suit alleged. But White’s death certificate said that she died of septic shock from a urinary tract infection (UTI).
The suit in the death of Peggy Francis alleged that she died six minutes after she was given a 200-microgram dose of fentanyl. The death certificate said that Francis-who was being treated for kidney cancer-died from septic shock caused by a UTI.
Each of the lawsuits allege that health care providers ignored excessive painkiller warnings from an electronic medical system or that the system failed to work in the first place. After Mount Carmel fired Husel in December, the health care provider updated its guidelines that a usual adult dosage of fentanyl should be between 25 and 100 micrograms, according to an Ohio Department of Health inspection report. Husel faces an additional 19 wrongful-death suits after another eight were settled, according to NBC.

My father was on his death bed in severe pain. Each breath was horrible. We begged and pleaded to help. Take away his pain. Finally a nurse burst in with a needle and gave my dad what he needed. Shortly he started breathing better and within a he he was gone . He finally got some peace. His last moments were dignified. We loved him so much and I hope this doctor is around when my time comes. Cause I would rather be without pain even if it meant one day or a week or even a month less of my life. I would give up a year if that’s what it takes. Life is not worth living if I’m suffering the whole time.

I feel exactly the same way. Dr Husel is a compassionate physician who simply wanted a 'good death' for those at the end of their life, and the best experience possible for their loved ones.
I cant believe this prosecution was launched. It's ludicrous and has affected the lives of so many professionals beyond just this doctor's.

Thank goodness for most of the State's doctor and nurse witnesses, because they have done more to back up the innocence of Dr. William Husel than the persecutors ever expected. The fact that the State of Ohio thinks they had a good case here and brought on Dr. Ely as their main backup witness shows that there is something rotten in the State of Ohio. And, the unbelievably horrible and prejudiced behavior on the part of the judge in this trial proves it!

    • @CrushtheCurveClass
      @CrushtheCurveClass 2 года назад +3

Statements made by a defendant are never hearsay, as a rule, if they are offered by the opposing party (I.e., the prosecution). They’re called “admissions by a party opponent” (even if the statement doesn’t seem like an “admission” in the generic sense of the word).
A statement made by a party can only be considered hearsay if it is being offered by that same party in a self-serving manner. So basically, under the rules of evidence, nothing the defendant has ever said is hearsay if it’s being offered by the prosecution. A defendant’s statement might still be objectionable on some other grounds (like relevance, for example), but not hearsay.

I am a retired nurse ( 36 years service) and my last 10 years wes,,,,,re Hospice. Unfortunately I HAVE known of many, many patients being overdosed to their death, by nurses doing careless assessments of their status/needwhen it was NOT indicated to give those heavy frequent meds. I had a close family member that went to her death before time as the family followed a nurse's suggestions and medicated her heavily. My practice was always to treat the symptoms,,,, not blindly just give meds to make the patient comatose. Many nurses DO medicate without properly assessing the patient and allowing meds to work . Also I have seen some family members want them medicated to a coma state,,,,, feeling they were less disruptive to their lives. Another point was if it appears the patient needs a lot of opioid meds, they found it easy to grab a number for themselves! Some heartless things occurred and it occurs even in big hospitals. I believe wholeheartedly he overmedicated most of these patients and caused their death to come sooner. I also feel ethically that any patient should only receive NECESSARY , not elephant dosing . Illness IS very sad,,,,, but euthanasia should be the choice of the patient.

I feel like the judge allowed dr Ely (the quack) to go on tangents when he was supposed to just answer yes or no but with Jacob (the nurse) the judge is enforcing the “yes, no” answering of questions. I found the judge to be a little biased but that’s typical in the trials I’ve watched.

      This nurse is extremely nervous.
He is over explaining his position and knowledge.
He is the type of nurse that wants all procedures explained numerous times.
      He has every right to.
To be in his shoes during all the investigations he has been through I think this nurse has presented well.

I think this doctor did what he could to help the patient and their families. He had nothing to gain killing these patients unless he has a funeral home or know someone close to him with one, and they all went to that funeral home.
