That was a Pennsylvania Bear and he was COMPLETELY OUT OF LINE and to andwer everyones question. YES HE WAS in Private Property which made that so called Violation COMPLETELY ILLEGAL from the word go. 1 - ANY DOT agency Bear CANNOT just walk up to a Repair shop and conduct an Inspection let alone hand out a Violation that wasn't caught in public first. The basic rule is that An Officer HAS TO CATCH you on a Public Roadway breaking the law and then and only then has the right to pull you in any lot or parking lot do any kind of Inspection even if it's on Private Property. 2 - The driver has his Dashcam rolling which will save him in Court That way the Officer CANNOT weasel his way out of that one and he's caught drad to rights lying just to hand out the violation. 3 - The Driver was On Private Property to begin with and wasnt caught on the Public Roadway and pulled over onto the Shop land and given a ticket. ANY OFFICER that does any kind of Inspection or dares to write a ticket to a driver on Private Property MUST obey the Following Rules CMV infraction MUST be clearly seen in Public by said Officer in or on a public roadway NO OFFICER is allowed to pull a DOT inspection on Private Property without the land owners Permission ANY DOT inspection on anyones Private Property MUST BE JUST AND HAVE LEGAL Reasons for being done otherwise is Illegal and CANNOT be Conducted at all
I can't even begin to tell you how many laws and civil violations that trooper is combining. Right off the bat a huge 4th ammendment where he infringed on personal off duty time. When the driver signed the truck over to the shop and got in line he is off duty. What puts him off duty automatically is he us not performing any safety sensitive task. He's on the same duty status as he would be if he was in the shower. What's next, are they gonna barge into a restroom stall and do a paperwork check while your downloading a turd?
DOT is out of order in the court. I could tell by this guy‘s tone, and I have many years experience, he had some sort of other motive. Barking for your license and paper repeatedly.
