I *thought* any private property is classed as a public place if the public have access to it UNTIL you are requested to leave, at which point you must leave otherwise you are trespassing? Aggravated tresspass is a crime but that would require you to obstruct someone partaking in a lawful activity in that place where you are trespassing.
Section 40D of the Prison Act 1952 says that filming inside the prison, even if standing outside, is a crime. That technically means that filming through windows or through the open gate could be a crime, but the fact that many MSM media have broadcast footage including these, then it can't be an issue.
The point about leaving when asked or even before the police forcibly eject you is that you've still highlighted the actions of the staff and that they aren't even following their own guidance and policies, so you don't need to escalate it till the commit violence against you.

Advice from HMP Prison & Probation Service is that the public can film from carparks and paths used by the public. Staff are also advised to not engage and the minimum is just ask people to leave the premises. They should not escalate the situation by going straight to calling the police. They should also log the event via the Mercury reporting system.

Leaving is quite correct because there is a barrier denoting one cannot go any further & there are Private signs up, so there is no excuse. The 'I pay taxes etc' stance doesn't work in this case. The Prison Senior Officer is quite right to say "Leave Crown land".

Not sure but think prisons might be slightly different when filming inside the premises from outside I.e possible arrest, sure Live Free AKA David Platt might have been nicked for it for filming on prison property, also filming in a court is illegal

Pathetic, embarrassing and sad display by these power and ego tripping prison screws, they really do get a kick out of exercising their corrupt power, control and authority over other human beings, even when they engage with members of the general public. Koleeberks did a pretty excellent job overall, he conducted himself in a civil, polite, friendly and professional manner, asked questions and challenged the prison officers when needed. I've watched lots of prison audits over the last few years and this has to be one of the best videos I've seen, Koleeberks became stuck in limbo land, not knowing whether to stay or leave, but after quickly thinking it over he chose to sensibly depart to avoid an escalation of the situation from the prison goons and helped himself by minimising any possible problems arising when the police showed up. Auditing prisons and private property like shopping centres etc have always been troublesome and more often than not have a tendency of spiralling out out control fast, resulting in claims for assault, battery, criminal damage, unlawful detainment and arrests. Luckily on this occasion the prison officers behaved in a professional manner for the most part, although they still tried to bully, intimidate and harass Koleeberks, but done it all in a very subtle way. Sometimes it's best to just back down, play it safe and sensibly, especially if there is a risk you'll only end up making it worse for yourself. Auditing is not about trying to push your luck to see how far you can go to avoid getting into trouble and being arrested by the police, it's to try and educate as many people as you can that filming and photographing on public land is your civil right, is legal/lawful and in general there is no expectation of privacy in a public place.
