yeah, looks to me as if he zip tied the trigger(or some other modification) because he was too lazy to hold it down with his finger (which is stupid. safeties are there for a reason folks) CLEARLY the gun there wasn't the work gun. it was brand new. however, a hard hat WOULD have saved her eye. may not have stopped the gun from giving her a puncture wound, but the majority of the nail would have stayed outside. the hat would have bumped the safety, the firing mechanism would have went off, the gun wouldn't have remained in contact with the helmet as the nail was fired. (anyone who has used one can tell you that if you let the gun do whatever it wants, the nail won't go in all the way) so either the hat would have taken the blow and stopped the nail and made the gun hit the floor, or the nail would have been driven with nothing but the internal hammer plus the weight of the gun and gone (in my guesstimate) about half the length of the nail into the hat. if the hate remained still, then she would have gotten poked. not pleasant, but not life altering, if the hat got knocked off her head, then it would have absorbed the energy of the nail, redirected it away from her head, and the only damage she would have suffered is soiled panties.

I had some people come do work inside my mom's house after our AC broke and it leaked into the ceiling. When the guys came to patch it up, I never went past the drape unless they said I could. I asked everytime and while they let me through easily, I usually had to wait a minute and one of them would have to walk me through the jobsite. She played herself walking in there like that. I think that's first world entitlement tbh. It sucks she lost her sight and she got hurt, but you should know better than to walk into something like that without permission and/or an escort

As a guy that works construction. Stay the fuck out of my construction zone. I've seen a lady drop a 6 month old baby on a floor laden with nails because she couldn't stay in the marked "safe" areas. It is his responsibility for any machinery and power left plugged in or active when leaving the site of work unattended, The building wasn`t the threat to her health the tools left plugged onto the compressor was a hard hat gloves and goggles will not save her from a nail-gun judging by the location it entered. As a contractor he is responsible for having insurance for accidents like this not just for employees but for nonemployees that may enter into a dangerous place and get hurt, so if he doesn't have insurance then he will be handing over a percentage of his income to her till that money is paid or, he will go to jail, unless he somehow files bankruptcy.

I've been a contractor for over 40 years and it's almost impossible for a nail gun to go off without hitting the trigger and pressing the actuator down nail gum have safety fisher to prevent them from going off ...the only thing that would make it shoot a nail would be if the nail gun was defective or the safety actuator disabled...I find that the ruling was not fair....if anyone should have gotten suede it should have been the nailgun company ....they should have tested the nail gun to show that if work properly it would have never gone off....

I had some people come do work inside my mom's house after our AC broke and it leaked into the ceiling. When the guys came to patch it up, I never went past the drape unless they said I could. I asked everytime and while they let me through easily, I usually had to wait a minute and one of them would have to walk me through the jobsite.

As a guy that works construction. Stay the fuck out of my construction zone. I've seen a lady drop a 6 month old baby on a floor laden with nails because she couldn't stay in the marked "safe" areas. You get hurt in a construction zone when you shouldn't be there... that's on you. May be your home, but if i have on going work... that's my area.

As a contractor he is responsible for having insurance for accidents like this not just for employees but for nonemployees that may enter into a dangerous place and get hurt, so if he doesn't have insurance then he will be handing over a percentage of his income to her till that money is paid or, he will go to jail, unless he somehow files bankruptcy.

As a business owner he’s basically required by law to have liability insurance and if he’s smart he has an umbrella policy on top of that so assuming this gentleman took proper precautions for expensive projects he’s hired to do, he probably had enough coverage and didn’t have to come out of pocket.

That is safety 101. Plus how you going to tell someone they can't go in their own house. She showed up early, so what.

I've been a contractor for over 40 years and it's almost impossible for a nail gun to go off without hitting the trigger and pressing the actuator down nail gum have safety fisher to prevent them from going off ...the only thing that would make it shoot a nail would be if the nail gun was defective or the safety actuator disabled...I find that the ruling was not fair....if anyone should have gotten suede it should have been the nailgun company ....they should have tested the nail gun to show that if work properly it would have never gone off....

And the amount she was asking for was wild especially since it was partially her fault. I would understand the amount if she was wearing all the ppe and was guided into her home and still got injured in the end.
