Great information. A lot of myth around 180days rule after GC are on the net and all are opinions. I spent many days searching the internet to find where this 180 days and more were set in stone. I am not sure who spread this myth but a lot of people are/were exploited because of this myth. Thank you for sharing this video.
My father was employed by Company A and stayed with them for one year after receiving his green card. However, they did not treat my father well financially and caused him a lot of mental stress. As a result, he decided to leave his position and join Company B. Company A is currently threatening to revoke my father's green card since he relocated to Company B. After watching your video, I felt more confident and encouraged my father not to worry! Thank you so much for your clarification!!
You are the Best!! 🙏👍 Thank you for clear and straightforward answers. All other lawyers are confusing everyone! You helped me in making my decision. Thank you so much 👍🙏
Thank you so much for clarifying all my concerns. I actually got my green card approval for EB3 on August 2021. And I started working for my sponsor employer since September 2021 to present. Due to my health condition caused from the job functions. I am not even allowed to work for this particular heavy duty that being said by my primary care doctor. There was one time happened to me that my toxic employer threatened me to revoke my green card if I decided to leave the job. I was extremely terrified and just simply kept working for them until now. After watching your video, it absolutely clears off my head and I feel so much better and safe now. I do have my intention working for my employer but I guess it’s time for me to move on for my better physical health and my mental health. Also, I have just recently got a better job offer :-)
@@AnythingEverythingAll you’re absolutely right. I have been hesitating for so long leaving my sponsor employer because every time I think about it always reminds me of the moment being threatned. I am not afraid of it anymore. I realize it is okay to change jobs after receiving green card
Is there anything called “good faith” with uscis? My lawyer told me if I don’t work the full one year in Eb3 unskilled, it doesn’t show good faith towards the program.
Question 10 does not deal with employment after GC but with change during pending 1-485. It does say that the petition is for future employment with the petitioner, hence the issue of leaving the petitioner right after GC remains? Not sure this Question addresses the issue at heart.
Can I become a self-employed while waiting for I-485 being approved? And what would be criteria for that self-employment? What evidence will USCIS need?
The concern is that when it comes time to apply for citizenship they could presume the process was fraudulent because you said you’ll work in X and you left asap.
Can I wait for GC before starting work? I have i140 and EAD. My agency is threatening me that they will withdraw application. I don't want to start due to retrograssion and financial reason. It's been over 180 days since i485 is pending
After I have a green card in a sponsored program and there a contract signed which is binding to say I must first work for e.g 2yrs for the company that sponsored me before I quit coz I have to pay back some of the money during this period, can still quit regardless of the binding contract.
I have heard that one HAS to join the company or take up that job for which the GC was issued... it may not be a requirement for USCIS to be in the job for 180 days... but may be a requirement of the job offer... pls clarify...
I am switching from employer A to Employer B. Employer A: H1 , H4 approved until 2025. H4 EAD pending. (Eligible for auto extension) Employer B: transfer not started yet. Do we need to file for h4 EAD again if I do my h1 transfer from A to B? If her h4 EAD is approved prior to my h1 transfer, do I still need apply for h4 & h4 ead? Can we use current H4 EAD until new h4 ead is approved?
If I am the primary applicant and my employment based greencard is approved but my wife’s green card is still pending. Can I switch jobs? Since her greencard is tied to my greencard status and not my employer
I understand that it's quite common for employers to also have employees sponsored on a green card to commit to working for X amount of time after they receive their green card (and will draft a separate contract for that). What's the typical duration of time employers may require you to work for them once you get your green card? Is there a way to make sure employers don't try to take advantage of this and keep you essentially "chained" to the company?
My Greencard was approved 4mos ago, I worked with my employer who sponsored my green card for the pass 4mos also, now there is better opportunity offered to me. I wanted to resigned from my employer, my employer is threatening they will file legal case for me coz they are the one giving me my green card. Please advise me on what to do.
I got the green card before starting work for the sponsor company, when can I leave the sponsor company without negatively impact on naturalization? Thank you!
Thank you so much. Also, just to clarify, if a green card holder wants to quit their job and take a break from work, is that okay? We have been working with this IT employer for about 16 years and got our Green Card almost 6 months ago. Me and my wife want to take a break and upskill ourselves by enrolling for some courses and then look for jobs, me with IT and my wife outside IT. Is this okay for us to pursue. Can you please advise
What are you talking about? Your interview is based on whether or not you will do the job you are sponsored for. If the officer suspects you will not do the job, they will likely deny the green card.
This employer is giving you such a great opportunity. They trust you, so do not disrespect the sponsors, even if there are no consequences for quitting. In gratitude, work for them for a while. Don't be an ass!
What you don’t seem to realize is they they charge money out of our salary for a decade just because they are sponsoring our visa’s. Unless it is a big name employer in the fortune 500 list, the employers charge us for the visas until we get out GC’s . They are not non profit organizations.
I have shared this video with all my friends. Employers are taking advantage of this 180 days misconception. Thanks a lot for clarifying it!

Hello just checking in with you? When they tried to revoke your dad’s green card what was the result? Have they company stopped disturbing your dad?
The company does not have the power to revoke your fathers green card. Only USCIS CAN DO THAT

Agreed. That particular point was not clearly explained.
I worked for my employer more than 10 years and they still asking me to pay for the green card expenses. What are my rights here.

nope this is misconception , never happened no evidence not in the law as mentioned in the video too
No one from USCIS has time to go into the detail before 5 top 6 years and see how you quit
Thanks!

If you leave the employer who helped you get it, that would be disloyalty.

does it matter after 3 years of getting eb3 gc that uscis investigate you stayed only 3 months or 6 months with that company
Where is the link memo USCIS?
Very useful information sir.
What if i’ve been work for sponser company 2 years but i 485 still pending, can i quit job as unemplyed until i 485 approved?
what if I received a typographical error green card. Can I still leave the employer?
Thanks! A bit confused still. So, if I apply for a job that will give me an EB -3 green card, I can quit that job any time I want?
So after the contract with my emplyer ends, I can stay in the US and apply for US Citizenship after 5 years?
