In Washington State, your driver's license is not suspended immediately following a DUI arrest, but it can be suspended shortly after the arrest depending on certain factors. Here's what happens:
Administrative License Suspension: If you are arrested for DUI and you either (a) fail a breath test with a blood alcohol content (BAC) of 0.08% or higher or (b) refuse to take the breath test, the Department of Licensing (DOL) will automatically start the process to suspend your license. This is called an "administrative license suspension."
Notice of Suspension: After your arrest, the officer typically gives you a Notice of License Suspension. This suspension can begin 30 days after the arrest unless you take action to contest it.
Right to a Hearing: You have the right to request a hearing to contest the suspension, but you must do so within 7 days of the arrest. If you request a hearing, the suspension will be delayed until the hearing takes place. The hearing is conducted by the Department of Licensing, not the criminal court.
Suspension Length: If you don't request a hearing, or if the hearing results in a decision against you, the length of your license suspension depends on factors such as:
BAC of 0.08% or higher: suspension can last 90 days.
Refusing the breath test: suspension can last 1 year or more.
Criminal Case Suspension: In addition to the administrative suspension, if you're convicted of DUI in criminal court, the judge can impose a separate license suspension. This would be in addition to any administrative suspension.
Temporary License: After your arrest, if your license is suspended, you may be eligible for a temporary or restricted license (Ignition Interlock License), which allows you to drive with an ignition interlock device installed in your vehicle.
In short, often times a persons drivers license does become suspended, but it is not immediately after the arrest.
To avoid or reduce the suspension, it's crucial to act quickly by requesting a hearing and consulting with an attorney.
