    Ive heard recently, in the District of Columbia, they are fighting back with a motion to dismiss as the judges there are more likely to side with the agency.

    How do you help get an attorney assigned to the lawsuit as quickly as possible? Also when the attorney is assigned, do you send them a courtesy copy of it?

      @anemashiach8514 nothing much...its like a long process...my attorney going to fight that back..then it will go from their side and our side. My lawyer told me it could take up to years to get something....so I guess I will cancel l my mandamus and wait.

    What if the US attorney request to dismiss the case saying that uscis will adjudicate the case soon?

      Maybe ask them to agree for a stay of the case for a set period of time to allow them to adjudicate before you dismiss?

      @@sarrafgentile They wish to dismiss the lawsuit case so that USCIS can regain jurisdiction and make a decision on the N-400.

      @@youtubername That's a normal part of the process, but I can't advise you how to properly negotiate it or paper it without formally representing you.

      @kamal I had the same experience.....state attorney is going to file motion to dismiss....I don't know what to do now

    My question is, if I'm suing the uscis for i360 delayed. When that i360 get approved, do I drop the cast against them of I can use that opportunity today. Hey, how about my pending i485. Is it possible, or do you think they will be like nah it doesn't work that way.""

      It depends what you asked for in your complaint. If you only asked for an adjudication of the 360 in your complaint, then your case would be moot if they approved that.
